Collection and management of municipal waste from the owners of real estate residing in the city of Zduńska Wola in 2020 2021

1. The subject of the contract is the implementation from 1.7.2020 to 30.6.2021 of services for the collection and management of municipal waste from property ownersresiding in the city of Zduńska Wola (parts I and II) and the creation, operation of a stationary substitute point for the selective collection of municipal waste PSZOK, as well as management of the collected waste (part III) in accordance with the Act on Civil Rights Protection. Main Site: City of Zduńska Wola

1. Under Part 1, the Contractor is obliged to collect and manage municipal waste:

1) selectively fromcollected:

a) paper;

b) metals;

c) plastics;

d) glass;

e) multi-material packaging waste;

f) bio-waste

g) bulky waste, waste electrical and electronic equipment, windows and doors ( during collection);

h) expired drugs and chemicals (pharmacies and clinics);

i) waste not eligible for medical waste generated in the household inreceiving medicinal products in the form of injections and monitoring the level of substances in the blood, in particular needles and syringes (pharmacies);

j) construction and demolition waste, concrete debris (for reporting up to 500kg property calendar year);

2) unsorted (mixed) ) municipal waste.

The scope of the provision of municipal waste collection services from residential property ownersall must comply with the resolution of the Zduńska Wola City Council regarding the detailed manner and scope of providing services in the field of collecting municipal waste from property owners and managing this waste, in exchange for the municipal waste management fee paid by the property owner, hereinafter referred to as the "Resolution on the detailed method and scope of providing servicesug "and a resolution of the Zduńska Wola City Council regarding the regulations for maintaining cleanliness and order in the city of Zduńska Wola. 5 points 1 and 4 of the PZP Act;

3. they meet the conditions for participation in the proceedings regarding technical or professional capacity, the Contractor will meet the condition if he demonstrates that:at least one service consisting in the collection of municipal waste with a total mass of municipal waste received in a consecutive 12 months in an amount of at least 5, 000 Mg,

Applies to Part I and Part II of the order.

In the case of submitting an offer for Part I and II orders, the Employer will also recognize one municipal waste collection service with a mass of at least 10, 000 Mg.

B) in approx.last 3 years before the deadline for submission of tenders, and if the period of business is shorter, then in this period he has duly performed or performs at least one service consisting in the collection and management of municipal waste collected separately in the form of paper, plastics, glass, within consecutive 12 months, with a total weight of at least 200 Mg.

Dapplies to Part I and Part II of the contract.

If an offer is made for Part I and II of the contract, the Ordering Party shall also consider one service for the collection and management of municipal waste that is separately collected and weighing at least 400 Mg.

- adapted to peeling selectively collected municipal waste - 2 pcs,

- to collect waste without a compacting function 1 pc

In the case of submitting an offer for Part I and II of order The Employer will deem the condition fulfilled when the Contractor demonstrates that for the purposes of the contract he has the specified quantity and typeI eat vehicles that meet the conditions set out in the Regulation of the Minister of the Environment of 11 January 2013 on detailed requirements for the collection of municipal waste from property owners (Journal of Laws of 2013, item 122):

- adapted to receive mixed municipal waste 4 items,

- adapted for peeling selectively collected municipal waste - 4 items,

- to collect waste without a compacting function 2 items

4. In the case of Contractors jointly applying for the award of the contract, the conditions referred to in point I.2 will be met only if each of the contractors separately meets the conditions for participation in the procedure in the scope of entitlement to conduct specific professional activities.

5. The contractor may confirm that the condition has been metin, referred to in point I.3 of this ToR, in appropriate situations and in relation to a specific contract, or part thereof, rely on the technical or professional capacity or financial or economic situation of other entities, regardless of the legal nature of the legal relations linking it .

6. The Employer also informs that the "relevant situation" referred to in point I.5 of these ToR will occur only if:

1) The Contractor, which relies on the abilities or situation of other entities, proves to the contracting authority that, by carrying out the contract, he will have the necessary resources of these entities, in particular presenting the undertaking of these entities to make available to him the necessary resources needs to fulfill the order.

2) With respect to the conditionsconcerning education, professional qualifications or experience, contractors may rely on the capacities of other entities if these entities carry out the works or services for which they are required. II. List of statements or documents confirming the fulfillment of the conditions for participation in the procedure and no grounds for exclusion.

1. The contractor is obliged to adduse the Single European Procurement Document (hereinafter the Single EAT) document valid for the day of submission of the offers. The information contained in the JEDZ Single Document constitutes preliminary confirmation that the Contractor is not subject to exclusion and meets the conditions for participation in the procedure. The Employer informs that the Contractor may use when completing the statement on the EAT formalso the tool available on the website https://espd.uzp.gov.pl/ IV.regarding the principles set out in chapter VII of the ToR.

1. The contracting authority does not provide for the possibility of awarding contracts referred to in art. 67 section 1 point 6.

2. The Awarding Entity allows partial offers to be submitted.

3. The Purchaser does not allow the submission of variants.

4. The Employer does not reserve the obligation for the Contractor to personally execute the order.

5. Purchaserit does not intend to conclude a framework agreement.

6. The Awarding Entity does not anticipate an electronic auction.

7. The Employer specifies the following requirements regarding the employment by the Contractor or Subcontractor of persons performing the activities indicated by the Employer in the implementation of the contract under an employment contract:

1) The Employer requires that all activities involving the actual performance of servicescovered by the scope of the contract, in the scope of:

2) collection of municipal waste from residential real estate (Part I and II);

3) equipping all owners of single-family properties from which municipal waste is collected in a selective manner with bags for collecting segregated waste ( Parts I and II);

4) operating a substitute point for selective municipal waste collection, up totime of creation of M-PORT (Part III)

Unless they are performed by a given person as part of their business activities, they were performed by persons employed (by the Contractor or Subcontractor) on the basis of an employment contract.

8. The scope of the provision of municipal waste collection services from owners of residential properties must be in accordance with the resolution of the Zduńska Wola City Council ine a detailed method and scope of providing services in the field of collecting municipal waste from property owners and managing this waste, in exchange for the municipal waste management fee paid by the property owner, hereinafter referred to as the "Resolution on the detailed method and scope of providing services" and a resolution of the City Council Zduńska Wola regarding the regulations of utthe pursuit of cleanliness and order in the city of Zduńska Wola.

9. The contractor is obliged to ensure the functioning of the substitute point on all Saturdays and Wednesdays in a month. As part of the offer, the Contractor may undertake to ensure the functioning of the replacement point on additional dates, so that the substitute point functions on one, two, three or four additional days a week.

Pthe replacement unit operates on Saturdays from 9.00 to 15.00, while on Wednesdays from 10.00 to 18.00. At the replacement point, the waste indicated in chapter IV point 1, point 1 OPZ from a) to m) and from o) to q), without limits. In the case of item n) construction and demolition waste, concrete debris (including doors, windows and glass) a limit of up to 500 kg / calendar year / residential property is set.

10. The city of Zduńska Wola was divided into sectors by resolution No. XXIX / 352/12 of the Zduńska Wola City Council of November 29, 2012 regarding the division of the City of Zduńska Wola into municipal waste collection sectors (Journal of Laws of Ł-dź Voivodeship from 2013, item 1

11. The Contractor is obliged to lodge a security deposit of PLN 320, 000.00 (say: three hundred and twenty thousand zlotys) before the deadline for submissionand offers including:

1) Part 1 PLN 120, 000.00,

2) Part 2 180, 000.00 PLN,

3) Part 3 PLN 20, 000.00.
