The subject of the order is the provision of services consisting in collection and managementmunicipal waste separately collected and mixed waste as well as waste electrical and electronic equipment, used tires and large-size waste from property owners residing in the Brzeziny Municipality.

Main Site: Area of the Brzeziny Municipality

1. The object of the order is a service consisting in receiving and managing municipal waste from residential real estatein the Brzeziny commune.

2. As part of the order, the contractor is obliged to collect and manage any amount of municipal waste from all residential real estate and real estate on which there are summer houses or other real estate used for recreational purposes, used only for a part of the year, located in the Brzeziny Municipality. requiresalso receive pickups, which were placed next to the containers in the bags, when they did not fit and the freezing of additional private containers.

3. Place of execution of orders: the whole administrative area of the Brzeziny Commune, including the following towns: Adamow, Bielanki, Bogdanka, Bronowice, Buczek, Dąbrowka Duża, Dąbrowka Mała, Eufeminow, Gaj, Gałkowek, Cologne, Grzmiąca, Helenow, Helenowka, Henrykow, Ignacow, Jabłonow, Janinow, Jaroszki, Jordanow, Kędziorki, Małczew, Marianow Kołacki, Michałow, Paprotnia, Pieńki Henrykowskie, Poćwiardowka, Polik, Przanowka, Przecław, Rochna, Rozworzyn, Sadowa, Stare Koluszki, Strzemboszewice, Siberia, Szymaniszki, Sciborow, Tadzin, Teodorow, Tworzyjanki, Witkowice, Zalesie, Żabieniec;

5. The scope of the order also covers the equipment of the property owners throughout the period of the order's implementation with containers and sacks to collect waste (containers will be the property of the Contractor) in quantities necessary to collect municipal waste generated in the Brzeziny Municipality. Organized and carried oute in 2020, a waste collection of large-size, used-up tires and waste electrical and electronic equipment.

7. Organization of the Collection of Waste (PSZOK) in the place designated by the Employer of the Selective Point and equipping it with the number of containers necessary for proper functioning.

8. A detailed description of the subject of the order is included in the description of the subject of the order, stAnnex No. 5 to the ToR.

The condition will be considered fulfilled if the Contractor shows that he has the current entries indicated below:

a) current entry in the register of regulated activity referred to in art. 9b of the Act of 13.9.1996 on maintaining cleanliness and order in communes (ie, Journal of Laws of 2018 item 1454, as amended), kept by the relevant Wojta,

b) current entry in the register afterentities that introduce products, products in packaging and waste management, referred to in art. 49 and following of the Act of 14.12.2012 on waste (ie, Journal of Laws of 2018, item 922, as amended), and which register is an element of the Waste Database, as regards the collection of used equipment electric and electronic in accordance with the Act of 11.9.2015 on used equipmente, electric and electronic (ie: Journal of Laws of 2018, item 1466, as amended),

c) current entry in the register of entities introducing products, products in packaging and management of waste, referred to in art. 49 and subsequent acts of December 14, 2012 on waste (consolidated text from 2018, item 922, as amended), and which register is an element of the Waste Database, in the field of transportadow,

The assessment of compliance with the conditions for participation in the procedure will be made on the basis of documents submitted by the Contractor, on the principle fulfills / does not meet.

3.3. Contractors who are not subject to exclusion from the proceedings may apply for the award of the contract. The Awarding Entity will exclude Economic Operators from the proceedings regarding the award of a public contract in the circumstances referred to in Article 24 sec. 1 point 12-23 Public Procurement Laws

3.4. In addition, the Employer foresees the exclusion of the Contractor in the following circumstances referred to in Article 24 sec. 5 points 1 and 8 of the Public Procurement Law Act

Contractors who are not subject to exclusion and meet the conditions of participation in the procedure specified by the Contracting Party may apply for the order.

The Contractor is obliged to attach the offer valid as of the date of submission of the draftand a statement confirming that the Contractor:

a) is not subject to exclusion,

b) meets the conditions for participation in the proceedings.

The statement referred to above shall be submitted by the Contractor in the form of a uniform document of the Contractor's EQUIPMENT completed in accordance with the template attached as Appendix 2 to the ToR. and in accordance with the instructions for completing the GAS as Annex 3 to the ToR, available also underInternet address https://www.uzp.gov.pl/baza-wiedzy/jednolity-europejski-dokument-zamowienia, submitted in electronic form, signed with a qualified electronic signature. - Contractor, within 3 days from the date of providing information about which referred to in art. 86 par. 5, shall provide the Ordering Party with a declaration of belonging or non-affiliation to the same capital group as referred to inrt. 24 sec. 1 point 23 Pzp. Along with the submission of a statement, the contractor may provide evidence that links with another Contractor do not lead to distortion of competition in the procurement procedure. In the event of a joint application for contracting by the Contractors, a declaration of affiliation or non-affiliation to the same capital group shall be submitted by each of the Contractors.from the Contractor, which relies on the abilities or situation of other entities, on the terms set out in art. 22a of the Public Procurement Law, present the documents referred to in - 9 para. 2 points from 2.1. to 2.3 and from 2.7. to 2.13 of the SIWZ.

Contractor who refers to the resources of other entities, in order to indicate the absence of grounds for exclusion and compliance with them, to the extent thatrefers to their resources, the conditions for participation are also submitted to the EED regarding these entities. Contractors may apply for this order at the same time. Each entity jointly submits separate documents specified in the ToR in - 9 para. 2 points 2.1 to 2.3 and from 2.7. to 2.13 and EAT. Other documents and statements may be jointly submitted by Contractors appearing inspolnie.

The Contractor will demonstrate fulfillment of the condition, if he will have liability insurance in the scope of business activities related to the subject of the order for a guarantee sum of at least 1, 000, 000.00 PLN. You must present a document confirming your insurance in the above-mentioned scope.

I. Information clause regarding the GDP.

According to art. 13 para. 1 and 2 of the RegulationOf the European Parliament and of the Council (EU) 2016/679 of

27.4.2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and the repeal of Directive 95/46 / EC (General Data Protection Regulation) (Official Journal EU L 119, 4.5.2016, page 1), hereinafter "RODO", the Contracting Authority informs that:

1) It is the administrator of the Contractor's personal data aboutonce persons whose data the Contractor has provided in the present proceedings;

2) personal data of the Contractor will be processed pursuant to art. 6 par. 1 lit. c ROPE for the purpose related to the public procurement procedure for the task "Collection and management of municipal waste from property owners residing in the Brzeziny Municipality", case number: RIiRG.271.04.2019 kept in tribunale of the unlimited tender;

3) the recipients of the Contractor's personal data will be persons or entities to whom the documentation of proceedings based on art. 8 and art. 96 para. 3 of the Act of 29.1.2004 Public Procurement Law (Journal of Laws of 2017, item 1579 and 2018), hereinafter the "PZP Act";

4) personal data of the Contractor will be stored in accordance with Article 97 paragraph 1 of the PPL, for a period of 4 yearsat the end of the contract award procedure, and if the duration of the contract exceeds 4 years, the retention period covers the entire duration of the contract;

5) the obligation to provide the personal data directly by the Contractor is a statutory requirement set out in the Public Procurement Law, related to the participation in the proceedings for the award of a public contract; consequences not recommendedand specified data results from the Public Procurement Law,

6) with respect to the Contractor's personal data decisions will not be taken in an automated manner, application to art. 22 RODO;

7) The Contractor has: - pursuant to art. 15 RODO right to access personal data concerning the Contractor;

- pursuant to art. 16 RODO the right to rectify personal data, if their change does not result in a change in the result of the proceedingrequest for a public order or a change in the provisions of the contract to the extent incompatible with the Public Procurement Law and does not affect the integrity of the protocol and its annexes;

- pursuant to art. 18 RODO the right to request the administrator to restrict the processing of personal data, subject to the cases referred to in art. 18 para. 2 RODO;

- the right to lodge a complaint to the President of the Protection Office of Danych Personal, if the Contractor considers that the processing of his personal data regarding the breach of the provisions of the GDPR;

8) The Contractor is not entitled to: - in connection with art. 17 sec. 3 lit. b, d or e RODO right to delete personal data;

- the right to transfer personal data referred to in art. 20 RODO;

- pursuant to art. 21 RODO the right to object to the processing of personal data, as the legal basispersonal data processing of the Contractor is art. 6 par. 1 lit. c RODO.

II. The two-month period specified in section IV.2.6) should be understood as 60 days counted from the date set for the submission of tenders.
