The subject of the order is: "Receipt and management fromMunicipal waste from owners of real estate residing in the Czechowice-Dziedzice commune is providing a collection and management service of municipal waste generated on the property in the commune of Czechowice-Dziedzice, on which the residents live.Special scope of the subject of the contract is set out in Annex 7 to the Terms of Reference orders.

The subject of the order: "Collection and management of municipal waste from owners of real estate residing in the Czechowice-Dziedzice commune" is the provision of collection and management of municipal waste generated in the real estate in the Czechowice-Dziedzice commune, on which residents live. The scope of the subject of the contract is specified-is in Annex No. 7 to SIWZ description of the subject of the order.

If in the documents making up the description of the subject of the order, the trade name of the company, product or product is indicated, ordering in relation to the parameters specified directly in the tender documentation, or data (technical or any other ), which identifies directly or indirectly the product or the product - dopushave equivalent solutions in accordance with the technical data and parameters contained in the above-mentioned documentation. The ordering party requires, pursuant to art. 29 para. 3a of the PPL Act of employment by the Contractor or Subcontractor based on a contract of employment by executing personsdirectives in the performance of the contract.

The contracting authority requires, in particular, the following activities under the contract to be performed by persons employed under a contract of employment:

- handling specialized vehicles intended for waste collection,

- handling the selective collection point of municipal waste.

During the execution of the order, the Ordering Party is entitled to performcontrol activities towards the Contractor regarding fulfillment by the Contractor or Subcontractor of the employment requirement on the basis of a contract of employment for persons performing work covered by the contract. • The detailed way of documenting employment of persons referred to in art. 29 section 3a of the Public Procurement Law, the powers of the Ordering Party in the scope of control of compliance by the Contractor with the requirements referred to in art. 29 para. 3a statutesy Pzp and sanctions for non-compliance with these requirements, the type of activities necessary to carry out the order, which relate to the employment requirement under the contract of employment by the Contractor or Subcontractor persons performing activities during the implementation of the contract are included in the draft contract Annex No. 8 to the ToR. predicted the ecological nature of the order in the assessment criteriay offers. Orders from art. 67 sec. 1 point 6 of the Public Procurement Law, include: receiving municipal waste from real estate residing in the Communeiny Czechowice-Dziedzice, waste management, running a selective collection point for municipal waste, equipping the real estate inhabited with containers, containers and bags intended for municipal waste collection - Conditions under which orders can be issued consisting in the same type of services being repeated: in the case of a prolonged procedure giving moreorder it; the order will be preceded by a single-source procurement procedure, including negotiations with the Contractor. The subject of the contract will be implemented from the day of signing the contract until December 31, 2020, with the reservation that the collection and management service of municipal waste from real estate residing in in the Czechowice-Dziedzice commune will be witnessingwife from November 2, 2009

1. The contractor will fulfill the condition if it proves that:

1.1. has an entry in the register of entities introducing products, products in packaging and management of waste managed by the marshal of the voivodship of Silesia. The ordering party will call the Contractor, whose offer will be rated the highest to submit the following declarations or documents:

2.1. in the case of conditionsin the proceedings concerning competences or entitlements to conduct a specific professional activity, if it results from separate provisions: a) a license, permit, license or document confirming that The Contractor is registered in one of the professional or trade registers kept in the European Union Member State in which the Contractor has his registered office or place of residence.

3. The assessment of the fulfillment of the above conditions of participation in this proceeding will consist in checking the completeness and correctness of submitted documents and statements according to the principle meets / does not meet (zero one one method).

1. The contractor will fulfill the condition if it proves that:

1.1. is insured against civil liability in the scope of conducted activities related to the subject of the order in-not less than PLN 2, 000, 000.00.

1.2. has financial resources or creditworthiness in the amount not less than PLN 2, 000, 000.00.

2. The ordering party will call the Contractor, whose offer will be rated the highest to submit the following declarations or documents:

2.1. in the case of conditions for participation in proceedings regarding the economic or financial situation:

a) confirming that thethe insurer is insured against civil liability in respect of the business related to the subject of the order for the guarantee sum specified by the Employer,

b) information of the bank or cooperative savings and credit fund confirming the amount of financial resources held or creditworthiness of the Contractor in the period not earlier than one month before expiry dateat the submission of offers.

3. If the Contractor has indicated, in order to demonstrate fulfillment of the conditions of participation, a non-Polish currency (PLN), the average NBP exchange rate as at the date of publication of the contract notice in the Official Journal of the European Union will be used for the conversion. - Assessment of the fulfillment of the above conditions for participation in this the procedure will be to check completeness and afterthe legality of submitted documents and declarations according to the principle meets / does not meet (the zero one method) - the Contractor may, in appropriate situations and with regard to a specific order, or part thereof, rely on technical or professional abilities to confirm compliance with the conditions of participation in the proceedings or financial or economic situation of other entities, regardless oflegal nature of the legal relationship that it has with him

1. The Procurer will exclude the Contractor from the proceedings for granting the order, which will be subject to the exclusion conditions described in art. 24 sec. 1 point 12-23 Pzp.

2. The Contracting Authority provides for the possibility of excluding the Contractor based on art. 24 sec. 5 point 1, 2 4-8 PzP.

In order to confirm the lack of grounds for exclusion of the Contractor from participating in the progressThe Awarding Entity shall call the Contractor, whose offer shall be the highest rated for submitting declarations or documents indicated in section VI of the SIWZ, item 3.1.

3. In order to confirm the absence of grounds for exclusion from the proceedings and fulfillment of the conditions for participation in the proceedings, the Contractor should submit with the offer (using means of electronic communication and signed with a qualified signature electronic) statement, in the form of a Single European Order Document (abbreviation: JEDZ) attachment No. 3 to the ToR.

5. The ordering party demands from the Contractory, which relies on the abilities or situation of other entities under the terms of art. 22a of the Public Procurement Law:

5.1. in order to demonstrate the absence of grounds for exclusion and fulfillment to them, to the extent that the Contractor relies on their resources, the condition of participation in the procedure for submitting documents of the GOOD of these entities

5.2. presentation, by the Contractor, whose offer will be the highest ratingfor those entities referred to in the ToR, Section VI point 3.1.

6. If the Contractor has a registered office or place of residence outside the territory of the Republic of Poland, instead of the documents referred to in the ToR, Section VI, point 3.1, submits a document or documents issued in the country in which the Contractor has its registered office or place of residence, confirming that: a) no opening cycleit is its liquidation and bankruptcy not announced,

b) it is not in arrears with paying taxes, fees, social security and health insurance contributions or has obtained legally required exemption, postponement or installment of overdue payments or suspension of the execution of the decision of the competent authority in full, ) he has not been banned from applying for the order,

d) he is giving information with appropriate informationregister, or, in the absence of such a register, another equivalent document issued by a competent judicial or administrative body of the country in which the Contractor has its registered office or place of residence is the person concerned by the information or document, to the extent specified in art. 24 sec. 1 items 13, 14 and 21 and par. 5 points 5 and 6 of the Public Procurement Law - 7.
