Period valide: 90 days from the deadline set for The participation guarantee is constituted by a bank transfer or by a guarantee instrument issued under the law by a bank or an insurance company that is not in special situations regarding the authorization or the supervision, according to the law.

The participation guarantee must be in the amount-and for the period of validity stipulated in the awarding documentation, respectively 90 days from the deadline set for. the guarantee must be irrevocable.

The guarantee instrument must stipulate that the payment of the participation guarantee will be executed unconditionally, at the first request of the beneficiary, on the basis of his / her statement regarding the person's faultand shall be submitted to the contracting authority no later than the closing date and time limit for the submission of tenders (in accordance with art. 36 par. (4) of H.G. 395/2016, with subsequent amendments and completions.)

If the bidder opts for the establishment of GP by bank transfer, the account in which the participation guarantee will be submitted: RO27CECECJ0152RON0430385 - CEC Cluj.will be made at the NBR exchange rate from the date of publication of the tender notice.

The performance guarantee: 5% of the price of the contract without VAT and will be constituted according to art. 40 of H.G. 395 / 2016.

If the first ranked tenders are found to have equal prices, the contracting authority will ask for clarification through SEAP, for the electronic loading by theeconomic agents of documents containing new financial proposals.
