Provision of services related to the service of coal deposits with heavy equipment for Polska Grupa Gornicza S.A. KWK Mysłowice Wesoła branch

1) The Ordering Party will apply the mandatory conditions for exclusion from the proceedings set out in art. 24 sec. 1 uPzp, including the provisions of art. 133 ust. 4 uPzp.

2) Ordering will exclude from the proceedings based on art. 24 section 5 point 1), subject to the regulation of art. 24 sec. 8 and par. 9 of the Public Procurement Law Act, the Contractor: - In relation to which the liquidation was opened, in the restructuring arrangement approved by the court, the creditors' satisfaction is foreseen by liquidation of their property or the court ordered the liquidation of its property pursuant to art. 332 par. 1 of the Act of 15.5.2015. Restructuring law (Dz.U.. from 2015, item 978 from zm.) or whose bankruptcy was announced, with the exception of the contractor who, after the bankruptcy, concluded a system approved by a final court decision, if the arrangement does not provide for satisfying the creditors by liquidating the assets of the bankrupt, unless the court ordered the liquidation of its property in accordance with art. 366 para. 1 of the Act of 28 February 2003 on Bankruptcy Law (Journal of Laws from 2015r. item 233 from d.)
