Reference Number: The minimum and maximum estimates of the frame agreement for Lot 2, as well as the minimum and maximum estimatedmay be the subject of a single subsequent contract for lot 2 are set out in the annex to the tender specifications.

The participation guarantees for each lot are: - - Lot 1 - 4 640 RON, - Lot 2 - 6 432 RON,

- Lot 3 - 4 480 RON,

- Lot 4 - 1 230 RON.

The guarantee will be constituted under the conditions stipulated in art. 36 of H.G. no. 395/2016. For the warranty of parttransferring, the following information shall be used: account RO59TREZ7065006XXX000135, open to the State Treasury sector 6, fiscal code: 4364349. The participation guarantee can also be made in foreign currency. Its amount shall be calculated taking into account the exchange rate communicated by the NBR for the respective currency from the date before the deadline for submitting bids by 5 days. Documethe documents certifying the constitution of the participation guarantee shall be submitted to the contracting authority no later than the deadline and deadline set for the submission of tenders. The guarantee is for a period at least equal to the period of validity of the offer. Tenderers submitting bids for multiple lots must be the separate participation guarantee for each lot in-part. The guarantee of participation must be irrevocable and unconditional.

The performance guarantee is 10% of the value of each subsequent contract without VAT and is valid for all 4 lots. The guarantee of good execution shall be constituted by any means provided by art. 40 of H.G. no. 395/2016, within 5 working days from the signing of the subsequent contract. authorsthe contracting party shall issue / refund the performance guarantee in accordance with the provisions of art. 42 para. (4) of H.G. no. 395/2016. Within the technical offer, the tenderer will make a mandatory mention of the way it wishes to constitute the good execution guarantee.

The award procedure is carried out on-line so that the correspondence with the potential bidders will take place via the SICAP at the announcedincluding the possible requests for clarifications, as well as the answers of the tenderers. In the event that there are two or more first-ranked offers at the same price, the contracting authority will ask these bidders for a new financial proposal, in the form of clarifications to the SICAP, which will contain new prices. The framework agreement will be perfected with the recipientand the bidders placed on the top three places in the final ranking for each batch. The final ranking procedure is valid for all 4 lots. The Purchaser undertakes that whenever he wishes to conclude a subsequent contract, he / she will invite the Promissory-Provider placed first in the final ranking. If the promissor-provider ranked first in-the final classification communicates that he / she can not sign the subsequent contract, the purchaser will address the promoter-provider ranked second in the final ranking. If he also states that he can not sign the subsequent contract, the purchaser will address the promoter-provider ranked third in the final ranking. Tenderers submitting bids for multiple lots are required to fill in and submit a separate DUAE for each batch. If it is necessary to modify the contract, this may be done only under the conditions provided in art. 221 of the Law no. 98/2016. Any interested economic operator is rightto request clarifications or additional information regarding the awarding documentation, in compliance with the deadline, 14 days before the deadline for the submission of tenders. To the extent that requests for clarification or additional information have been addressed by the economic operators within the stipulated deadline, the response of the contracting authority will be sent by 10 daysbefore the deadline set for the submission of tenders
