Continuous flow working technology in up-to-date operations involves moving staff worker, specialized training, tools and devices necessary for accidental interventions on machinesis a leader in the technological flow and / or other work points in the mining perimeter. The transportation with the requested vehicles implies the transport of the personnel, of the tools necessary for the interventions, to the daily work points, carried out at 1-3 shifts within the daily work program of 5-7 days / week.

The frequency of awarding the subsequent contracts will be 3 months during the implementation of the framework agreement. km AC min. 3 570, max. 90 580.

1) Declaration on own responsibility regarding non-compliancethe shortage in the provisions of art. 177, 178, 180 of Law no. 99/2016. The DUAE will be completed regarding the reasons for exclusion from the procedure, as the case may be, both by the tenderer, associate, subcontractor, and third party;

2) Declaration on his own responsibility regarding the non-classification in a conflict of interest situation, as is regulated by way of example in art. 73 of Law no. 99/2016. A declaration will be completed. The persons holding decision-making functions within the contracting entity are:

- Head of the Services Procurement Service Services for the Mining Activity of Mitioi Dumitru; 3) The DUAE form according to art. 202 para. (1) of the Law99/2016, this being attached to the announcement of participation on the SEAP portal www.e-licitatie.ro

DUAE will be completed regarding the reasons for exclusion from the procedure, as the case may be, both by the bidder, associate, subcontractor, and third party supporter. 4) according to the provisions of art. 205 of Law 99/2016 the updated supporting documents proving the fulfillment of those assumed by completing the DUAE regarding the reasons for the exclusion of the tenderer from the procedure will be presented, at the request of the contracting entity, only by only the tenderers ranked on the first 3 places after applying the criterion dit`s attribution. If there are uncertainties / uncertainties on the content of the relevant documents submitted by the tenderer, the contracting entity has the right to request additional details / details / confirmations.

These documents can be:

- Certificates confirming the lack of outstanding debts regarding the payment of taxes, taxes or contributions to the general consolidated budgetat (local budget, state budget, etc.) at the time of presentation, as a result of the entity request. contr.,

- the criminal record of the economic operator and of the members of the administration, management or supervision body of the respective economic operator or of those who have the power of representation, decision or control within it, as it results from the certifying certificate issued from ONRC / the constitutive act,

- other edifying documents, as the case may be, by which it is demonstrated that the economic operator can benefit from the derogations provided in art. 179 para. (2), art. 180 paragraph (2), art. 184 of Law 99/2016 on sectoral acquisitions;

5) according to the provisions of art. 202 of Law 99/2016, if applicable, DUAE will also include the requested information regarding the terthe sponsor and / or the subcontractors. In this case, for each third party developer / subcontractor a separate DUAE document will be presented.

Requirement no. 1 - oper. econ. bidders submitting the offer must prove a form of registration under the law of the country of residence, stating that the bidder is legally constituted, that it is not in any of the situations ofcancellation of the constitution, as well as the fact that it has the professional capacity to carry out the activities that are the object of the contract. 1) In case 2 or moreoffers / lot are ranked on the first place with equal prices, for separation, the evaluation commission will ask the bidders in this situation, new financial proposals, which will be transmitted electronically in SICAP;

2) The bidders have the right to request clarifications regarding to the mandatory contractual clauses. If following the clarifications these clauses will be amended / modified, they will be amade known to the economic operators until the deadline for submission of tenders. No modifications of the mandatory contractual clauses after the deadline for submission of tenders are allowed;

3) Any amendments to the specific contractual clauses in the draft framework agreement / contract will be submitted with the offer. The amendments made after the submission of tenders will not be taken into considerationtion. Negotiations of contractual clauses that have not been objected by the submitted offer are not allowed;

4) Without prejudice to the provisions of Law no. 182/2002 regarding the protection of classified information with subsequent modifications and completions, the economic operator will specify in the submitted offer which from the information submitted in the technical and financial offer are considered to be confidential, classified, protected by an intellectual property right, insofar as objectively, their disclosure would harm their legitimate interests, especially regarding the commercial secret and intellectual property;

Economic operators have the right to submit several individual and / or joint projects / offers or to be nominated as subcontractors on several different lots, related to the same award procedure, the prohibitions provided by art. 180 letters a) and b) of Law 99/2016, referring to the submission of tenders within the same / sameand lots related to an award procedure.

According to the provisions of art. 180 paragraph (1) lit. d) of Law 99/2016, "The contracting entity excludes from the award procedure any economic operator that is in any of the following situations: [...] d) the contracting entity has sufficient reasonable indications / concrete information to consider that the economic operator ended with other workseconomic ratios agreements aimed at distorting competition in or in connection with the procedure in question [...] ".
