Continuous flow working technology in the day-to-day mining operations involves moving the personnel to the points working within the mining units, specialized formations, tools and devicesnecessary for the accidental interventions to the driving equipment (rotor excavators, welding machines with arm in console, KSS, AsG in coal deposits, etc.) within the technological flow.

Main Site: Rosia Career from CEO SA component. mixed transport of persons and materials, includes the transport of the personnel, the tools needed for the interventions, the material basee, at the work points, within the mining perimeter, within the daily work program carried out at 1 3 shifts / day, within the daily work schedule of 8 17 hours / day and 5 7 days / week.

The bidders must not can be found in the situations provided in art. 177, 178, 180 of Law no. 99/2016

The DUAE will be presented according to art. 202 paragraph 1 of Law 99/2016. Fair documentsfcative proving the fulfillment of those assumed by completing the DUAE will be presented at the request of the contracting entity, only by the bidder ranked on the first place in the intermediate ranking prepared at the end of the evaluation of the bids.

Until the deadline for submission of bids, economic operators will submit in SEAP DUAE form, completed at the dedicated internet address https: // ec.europa.eu/growth/tools-databases/espd/filter.

In accordance with the provisions of art. 202 of Law 99/2016, if applicable, the DUAE will also include the requested information regarding the third party and / or subcontractors. In this case, for each third party / subcontractor a separate DUAE document will be presented.

The persons who hold management positions within entitiesand the contractors are:

The DUAE will be completed by the economic operators participating in the award procedure with the information related to their situation.

The supporting documents proving their fulfillmentto those assumed by completing the DUAE:

- certifying certificate issued by ONRC,

- certifying certainty regarding the lack of outstanding debts regarding the payment of taxes, taxes or contributions to the general consolidated budget (local budget, state budget, etc.) at the time of presentation,

- the criminal record of the economic operator and the members of the administration, management or suitessafeguarding of the respective economic operator, or of those with power of representation, decision or control within it, as it results from the certifying certificate issued by ONRC / the constitutive document,

- documents demonstrating that the economic operator can benefit of the derogations provided in art. 179 para. (2), art. 180 paragraph (2), art. 184 of Law 99/2016 onpublic procurement,

- other edifying documents.

The supporting documents proving the fulfillment of those assumed by completing the DUAE, respectively certifying certificate issued by ONRC, or in the case of foreign bidders, equivalent documents issued in the country of residence, will be presented, at the request of the authority contracting, only by the bidder ranked 1st in the ranking iIntermediate drawn up at the end of the evaluation of the bids.

- A certifying certificate issued by the National Trade Register Office will be presented. The information contained in the certifying certificate must be real / current at the deadline for submission of tenders. The object of the contract must have a correspondent in the CAEN code from the certifying certificate,

(1) In case, two or more offers / lot are ranked first with equal prices, for separation, the evaluation commission will ask the bidders in this situation, new financial proposals, which will be transmitted electronically in SEAP.

(2) The bidders have the right to request clarifications regarding the mandatory contractual clauses. If, following the clarifications, these clauses will be amended / modified, they will be notified to the economic operators by the deadline for submission of tenders. No modifications of the mandatory contractual clauses are allowedafter the deadline for submission of tenders.

(3) Any amendments to the specific contractual clauses in the Draft framework agreement / contract will be submitted with the offer. Amendments made after the submission of tenders will not be taken into account. Negotiations of contractual clauses that were not objected by the submitted offer are not allowed.

(4) Without prejudice to the provisions of Law no.182/2002 regarding the protection of classified information with subsequent modifications and completions, the economic operator will specify in the submitted offer which from the information submitted in the technical and financial offer are considered to be confidential, classified, protected by an intellectual property right, insofar as in objectively, their disclosure would harm their legitimate intereststo the economic operator, especially with regard to commercial secrecy and intellectual property.

(5) Completing the DUAE form is mandatory for all economic operators submitting the offer. In this regard they will consult "Instructions for use DUAE Form" on the SEAP home page.
