Delivery and assembly with the design and commissioning of 10 biomass boiler plant installations and 62 natural gas boiler installations

The subject of the order is the exchange of individual heat sources in the area Tłuszcz commune: delivery and assembly along with design and commissioning of 10 boiler plant installationsfor biomass and 62 installations for natural gas boiler, as part of the project entitled "Limiting the emission of air pollution in the municipality of Tłuszcz", on private properties located in the municipality of Tłuszcz, divided into two parts.

Under part I - delivery and assembly with the design and commissioning of 10 installations biomass boiler room:preparation of design documentation for 10 biomass boiler house installations in private buildings belonging to the residents of the Tłuszcz municipality and supply of installation elements and installation of biomass boiler installations on the spot based on the design documentation, including commissioning and instruction. Three types (sets) of biomass boiler room installations are planned, depending on their typeminimum capacity and capacity of the heater, in quantities:

- Set I: biomass boiler with a thermal power of minimum 15 kW with a hot water heater o. min. 140 l, in an amount of 4 pieces;

- Set II: biomass boiler with a thermal power of minimum 23 kW with a hot water heater. o. min. 140 l, in the amount of 2 pieces;

- Set III: biomass boiler with a thermal power of minimum 23 kW with a hot water heater o. min. 190 l, in the amount of 4 pieces.

1. The Contractor is obliged to complete the Investment by 15.12.2019, subject to the provisions of subpara. 2 and 3.

2. It is required that the installation within one building does not last longer than 1 day. It is not allowed that without a justified reason the Contractor interrupted the started work in the scope of one building.

3. The Contractor is obliged to obtain a written educationResident`s consent regarding the permission to perform the installation within the deadline indicated above. In the event that the Resident does not agree to the installation, the Employer will postpone the date of implementation of these installations for the period from 16.4.2020 to 22.5.2020. The Employer stipulates that both consent and the lack of consent must be expressed by the Resident in writing. Not applicable.

Ordersstating that the above-mentioned condition will be met if the Contractor proves that he is insured against civil liability in the scope of his business related to the subject of the order for a guarantee sum not less than:

- 70, 000.00 PLN (in words: seventy thousand zlotys) in the scope of Part 1,

- PLN 400, 000.00 (in words: four hundred thousand zlotys) in the scope of part 2.

In the case ofan offer for both parts will be met if the Contractor proves that he is insured against civil liability in the scope of his business related to the subject of the order for a guarantee sum of not less than PLN 400, 000.00. In the case of applying for a contract jointly by two or more Contractors, the condition will be considered fulfilled ifand Contractors will demonstrate jointly the fulfillment of the abovementioned condition - in the case of the Contractor, in order to demonstrate fulfillment of the conditions of participation, a currency other than Poland (PLN), in order to convert it will be used: - average NBP rate on the date of publication of the contract notice in the Official Journal of the European Union,

- The average NBP exchange rate from the first business day preceding the day of publication of the announcementsin the Official Journal of the European Union, if the date of publication of the notice is Saturday.

The contractor is excluded from the contract award procedure, in respect of which any of the circumstances referred to in Article 24 sec. 1 point 12 of the Public Procurement Law Act

In addition, the Contracting Authority will exclude the Contractor:

1) in relation to which the liquidation was opened, in a system approved by the court in posRestructuring restructuring is provided for the satisfaction of creditors by the liquidation of its assets or the court ordered the liquidation of its assets under the procedure of art. 332 par. 1 of the Act of 15.5.2015. Restructuring Law (Journal of Laws of 2017, item 1508, as amended) or whose bankruptcy was announced, except for the Contractor who, after the bankruptcy, concluded an arrangement approved by a legally valid order of the courtu, if the arrangement does not provide for the satisfaction of creditors by liquidation of the assets of the bankrupt, unless the court ordered the liquidation of its assets in accordance with art. 366 para. 1 of the Act of 28.2.2003 Bankruptcy Law (Journal of Laws of 2017, item 2344, as amended),

2) who, for reasons attributable to him, did not execute or did not properly execute the earlier contract to a significant extent regarding public ordershim or a concession contract, concluded with the Ordering Party, referred to in art. 3 par. 1 point 1 4 of the Public Procurement Law, which led to the termination of the contract or award damages;
