Successive purchase, delivery and unloading of light fuel oil for heating purposes for organizational units (real estate) of Poczta Polska SA located in the province of Silesia and Opole administered by the Infrastrukture Departmentry, Operational Area for Real Estate in Katowice (abbreviation: Purchase and supply of heating oil to the Polish Post SA subordinate to PI in Katowice).

Main Site: Organizational units (Real Estate) of Poczta Polska S.A. specified in the appendix to the contract. - Successive purchase, delivery and unloading of light oil type heating oil for heating purposes for organizational units (real estate)you Polish S.A. located on the territory of the Śląskie and Opolskie voivodeships administered by the Infrastructure Department, the Operational Area for Real Estate in Katowice. • A detailed list of fuel oil supply locations along with quantities, specified in Annex No. 2 of the contract constituting an annex to the ToR. A request for the abovementioned real estate is: 106, 600 m oil.

The ordering party requires oil supply-lightweight fuel with parameters compliant with PN-C-96024: 2011 with valid approvals (quality certificates) - Detailed description in the Terms of Reference for essential orders - table. The Employer allows the possibility of offering a fuel oil equivalent to that described in the SIWZ, ie one that meets all the technical and quality requirements set by the Employer, and from-the description of the subject of the order specified by the Ordering Party differs from the trademark, trade mark or origin.

The Contractor who cites the equivalent solutions is obliged to prove that the fuel oil he offers meets the requirements (parameters) specified by the Employer. a declaration in the form of a Single European Documenta standard form set out in the European Commission's implementing regulation issued on the basis of art. 59 par. 2 of Directive 2014/24 / EU and art. 80 ust. 3 of Directive 2014/25 / EU (hereinafter referred to as EED) in electronic form bearing a qualified electronic signature. The information contained in the statement will constitute the preliminary confirmation that Wykthe debtor is not subject to exclusion and meets the conditions for participation in the proceedings. The scope of the statement is indicated by the Ordering Party in the xml format on the Employer's website for the PI.TPZKat.2600.111.2018 Procurement Number.

The Purchaser informs that:

- The Contractor may also use the tool available on the ec.europa website when completing the declaration on the EJSE form. eu / growth / tools-databases / ESPD. The Contractor shall download the EMS in xml format, placed on the Ordering Party, filled in the tool referred to above, then signed with a qualified electronic signature (issued by the qualified trust service provider who is the certification service provider), encrypts and transmits encrypted and signed with a qualified electronic signature JEDZ to the email address e-mai: zakupy.katowice @ poczta-polska.pl,

- on the website of the Public Procurement Office https://www.uzp.gov.pl/baza-wiedzy/jednolity-europejski-dokument-zamowienia available there are auxiliary materials for filling in the EAT, including the Instructions for Filling the EAT,

- Contractor completing the EFA in the scope of Part IV: The eligibility criteria may be limited to filling in the section "α: General statement regarding all qualification criteria "and does not have to fulfill any of the other sections in part IV.

2. Declaration of entities submitting a joint bid and entities making available to the Contractor potential is submitted on the EAT form must be in the form of an electronic document signed with a qualified electronic signature by each of themthis agreement is to confirm compliance with the conditions for participation in the proceedings and the lack of grounds for exclusion to the extent that each of the Contractors demonstrates fulfillment of the conditions for participation in the proceedings and no grounds for exclusion. In connection with the adopted so-called with the reverse procedure, the Ordering Party, prior to the order being awarded, will call the Contractor whose offer has been best assessed, to submit in the designated, not shorter than 10 days, the date valid as at the day of submission of bids, the following statements or documents confirming the circumstances referred to in art. 25 ust. 1 of the Public Procurement Law in the scope of: - 1) no grounds for exclusion: a) information from the National Criminal Register in the scope specified in art. 24 sec. 1 point 13, 14 and 21 of the Public Procurement Law, issued not earlier than 6 months before the expiry of the term splacing bids,

b) excerpt from the relevant register or central records and information about business activity, if separate regulations require an entry in the register or records, in order to confirm the absence of grounds for exclusion under Art. 24 sec. 5 points 1 of the Public Procurement Law Act,

c) the Contractor's statement that he has not been the subject of a final court judgment or final administrative decision against himby posting payment of taxes, fees or social security or health insurance premiums, or in the event of issuing such a verdict or decision documents confirming payment of such receivables with possible interest or fines or conclusion of a binding agreement regarding repayment of such receivables (Annex No. 5 of the Terms of Reference), d) declaration of the Contractor about the lack of a decision against him, the backbone of the prohibition to apply for public orders (Annex No. 5 to the ToR),

2) competences or entitlements to conduct a specific professional activity, i.e .: current concession for liquid fuels trade granted by the President of the Energy Regulatory Office (entry in the ToR).

1. Contractor within 3 days from the date of posting on the website information referred to in art. 86-paragraph. 5 of the Public Procurement Law, will provide the Employer with a declaration of belonging or non-affiliation to the same capital group as referred to in art. 24 sec. 1 point 23 of the Public Procurement Law. The pattern of the declaration is attached as Appendix 4 to this ToR. With the submission of a statement, the Contractor may provide evidence that links with another Contractor do not lead to distortion of competition in theOrder elation. In the event of a joint application by the Contractors, the above-mentioned the document is submitted by each of the Contractors.

2. The offer must include the following statements and documents:

1) completed application form prepared using the template constituting Annex 2 to this SIWZ,

2) completed sheet of valuation constituting Annex No. 1 to SIWZ / contract and offer, - 3) statements-(EAT) listed in Chapter VI. 1-2 of this ToR (provided to the Employer before the deadline for submission of tenders in electronic form bearing a qualified electronic signature) and power of attorney (original or notarized copy) in the event that the Contractor is represented by a representative.

3. Information on Contractors who have their registered office or place of residence afterfor the territory of the Republic of Poland described in the specification of essential conditions of the order.

In order to conclude the contract, the Contractor is obliged to provide the Employer before signing the contract: a copy of the civil liability insurance policy with the subject of the order for PLN 30, 000.00 (detail description of - 3 paragraphs 12 and 13 of the draft contract).
