The subject of the order is the purchase along with the supply of fuel material - 5 parts orders.

The subject of the order is the purchase with the delivery of coarse coke with a grain size above 40 mm, heating content over 27, 000 kj / kg, ash content up to 11%, content, moisture content up to 7%, sulfur up to 0.8%, sub-aggregate content up to 10% in the maximum amount to the town:

Giżycko (Warmian-Masurian Voivodeship) 800 tons,

Węgorzewo (Warmian-Masurian voivodship) 1 200 tons;

Hajnowka (podlaskie province) 70 tons;

Osowiec (podlaskie province) 100 tons;

1) If the Contractor's offer is selected, it will always be accompanied by a certificate / quality certificate for the product delivered or a laboratory certificate in accordance with applicable regulations and standards.

2) The Contracting Authority informs that it is exempt from excise duty pursuant to art. 31 a para. 1 point 8 of the Excise Duty Act.

3) Name and code regarding the subject of the order specified in the Common Procurement Vocabularyeń (CPV): 09113000-4 coke.

4) The Ordering Party reserves the right to reduce the purchase of the object of the contract up to 30% in relation to the quantity indicated in Annex No. 2.1 to the ToR. Price form.

5) The terms of contract execution are included in the draft contract constituting Annex No. 4 / 1-2 to the SETC Project contract.

1. Contractors who are not subject to exclusion can apply for awarding the contracttawie art. 24 sec. 1 item 13-22 of the Public Procurement Law and art. 24 sec. 5 points 1 of the Public Procurement Law and meet the conditions for participation in the proceedings.

2. In order to confirm tentatively that the Contractor is not subject to exclusion, he must submit a current declaration on the day of submitting bids in the form of a Single European Order Document (EED) Annex No. 6 to the Terms of Reference, to the extent indicated by the Contracting Authority inannouncing about the order and SIWZ. The information contained in the EED will constitute a preliminary confirmation that the Contractor is not subject to exclusion and meets the conditions for participation in the proceedings. - prepared in accordance with the Single Order Document Form attached as Appendix No. 2 to the Commission Implementing Regulation (EU) 2016/7 of 5.1.2016 establishing a standard form for a European documenton orders (Official EU L 3/16) to the extent indicated in Annex 6 to the ToR.

3. The ordering party shall call the Contractor whose bid has been the highest rated, to submit within the prescribed, not shorter than 10 days, the current day as of the date of submitting the following documents listed in section III.1.2. ie ...

1) List of deliveries including:

- at least 2 deliveries - at least dknows the supply of coke for the amount of min. PLN 500, 000.00 gross each for part 1 of the order,

- at least 2 deliveries - at least two deliveries consisting of coke delivery for the amount of min. 300, 000.00 PLN gross for each part of the order 1a,

- at least 2 deliveries consisting of coal delivery for the amount of min. PLN 80, 000.00 each for parts 2 orders,

- at least 2 dostawa consisting in the supply of heating oil for the amount of min. PLN 80, 000.00 gross each for part 3 orders,

- at least 2 deliveries consisting in the supply of heating oil for the amount of min. PLN 10, 000.00 gross each for parts 3a orders.

Made, and in the case of periodic or continuous services also performed, within the last 3 years before the deadline for submission of tenders, and ifthe period of business is shorter during this period, together with their value, subject, dates of completion and entities for which deliveries have been made, and attaching evidence determining whether these deliveries have been made or are carried out properly, the evidence referred to, there are references or other documents issued by the entity for which the supplies were inthey are performed, and in the case of periodic or continuous benefits are executed, and if for a justified reason of objective nature the Contractor is unable to obtain these documents, the Contractor's statement; in the case of periodic or continuous benefits, ongoing references or other documents confirming their proper performance should be issued not earlier than 3 monthsd the expiry of the deadline for submitting offers of model list is attached as Annex 5 to the Terms of Reference. The contracting authority allows the summation of several deliveries and the demonstration of these deliveries in separate tasks; 2) in information from the National Criminal Register in the scope specified in art. 24 sec. 1 point 13, 14 and 21 of the Act, issued not earlier than 6 months before the deadline for submission of bids; 3) excerpt from the relevant register or-from central records and information on business activities, if separate regulations require an entry in the register or records, in order to confirm the absence of grounds for exclusion under Art. 24 sec. 5 point 1 of the Act or will not call if it is obtained through free and publicly accessible databases of details of public registers; 4) the Contractor's statement that he has not been granted the right to hima strong court ruling or final administrative decision on default of taxes, fees or social security or health insurance premiums, or in the event of issuing such a verdict or decision documents confirming payment of such claims together with any interest or fines or a binding agreement regarding repayment of such receivables - the pattern was madeand Annex 7 to the ToR; 5) declaration of the Contractor about the lack of a decision against him as a preventive measure of the prohibition to apply for public orders - the model is attached as Appendix 7 to the Terms of Reference; 6) if the Contractor intends to entrust the execution of a subcontractor's part of the order (which is not an entity on whose capacity or situation the Contractor relies on the principles set out in Article 22a of the Act) documents listed in point 2) 5); 7) if the Contractor relies on the abilities or the situation of other entities on the terms specified in art. 22a of the Act, in relation to these entities the documents mentioned in point 2) 5);

Cd. minimum level of possibly required standards:

1. The Contracting Authority informs that in the present proceedings Article 24aa paragraph 1 of the Act, i.e. Zamathe first party will evaluate the offers and then examine whether the Contractor whose tender has been rated as the most advantageous is not excluded,

2. The Contractor submitting the offer is bound by it for a period of 60 days. The period of being bound by the offer starts as soon as the deadline for submission of tenders expires.

3. By entering into the proceedings, the Contractor is obliged to pay a bid bond in the amount of: - for partand 1- 50, 000.00 PLN (fifty thousand zlotys 00/100), - for part 1a 15 000.00 PLN (fifteen thousand zlotys / 100), - for part 2 - 2, 000.00 PLN (two thousand zlotys) 00/100),

- for part 3 - 3, 000.00 PLN (three thousand zlotys 00/100),

- for part 3a - 500.00 PLN (five hundred zlotys 00/100).
