Subjectthe order includes comprehensive sale of high-methane gas with the symbol E with a total estimated volume of 14, 947, 9660 kWh during the delivery period, to the facilities listed in Appendix No. 1 to the ToR. Number of collection points - 88. Detailed description of the subject of the order, among others the list of collection points together with tariff groups, contracted capacities and forecasted quantities of gas fuel consumption includesdisappearing No. 1 to the ToR. The Contractor shall perform all activities and arrangements with the DSO necessary for the change of the seller and the effective start of the sale of gas fuel, including in particular: reporting to the DSO new contracts for the sale of gaseous fuel. These activities shall be performed by the Contractor on the basis of the relevant powers of attorney granted by the orderer together with the conclusion of a contract for the sale of gas fuelego. Given gas fuel must meet technical standards in accordance with the provisions of the Energy Law, executive acts and Polish Standards. The sale of gaseous fuel will take place on the basis of contracts concluded separately by the individual organizational units of the Employer, described in detail in Appendix No. 1 to the ToR.

The Ordering Party requires that the Contractor:

a. he possessed at present oa binding license for running a business in the field of gas trading, issued by the President of the Energy Regulatory Office in accordance with the requirements of the Act of 10.4.1997 Energy Law valid for the period of performing the order or document confirming that the contractor is registered in one of the professional registers or transactions carried out in a Member State of the Unionand European, in which the contractor has its registered office or place of residence;

b. held the currently valid license for running a business in the area of gaseous fuel distribution issued by the President of the Energy Regulatory Office or in the case of Contractors who are not the owners of the distribution network, has a valid contract with the Distribution System Operator (DSO) for the provision of-gas distribution services in the area where the natural gas supply is located.

The contracting authority requires the Contractor to have civil liability insurance in the scope of activities related to the subject of the order for a minimum sum of PLN 2, 000, 000.00 (in words: two million zlotys) .

1. The Contractors, who:

1) can not apply for the orderare subject to exclusion,

2) meet the conditions for participation in the proceedings specified by the Ordering Party in the notice of procurement and this SIWZ.

2. Grounds for exclusion:

2.1. The Procurer will exclude the Contractor from the proceedings for granting the order in the cases referred to in art. 24 sec. 1 point 12-23 of the Act (obligatory conditions).

2.2. Proceedings from the procurement procedurealso teaches the Contractor in the following cases, optional by the Employer, provided for in art. 24 sec. 5, points 1, 3, 8 of the PPL Act:

2.2.1. in relation to which the liquidation has been opened, in the court-approved system in the restructuring proceedings, the creditors are expected to satisfy their creditors by liquidation of their property or the court ordered the liquidation of its assets inybie art 332 par. 1 of the Act of 15.5.2015. Restructuring law or whose bankruptcy was announced, with the exception of the contractor who, after the bankruptcy, concluded an arrangement approved by a final court decision, if the arrangement does not provide for the creditors' satisfaction by liquidating the bankrupt's assets, unless the court ordered the liquidation of its assets in in art mode 366 para. 1 of the Act of 28.2.2003. Bankruptcy law.

2.2.1. if the Contractor or persons referred to in art. 24 sec. 1 point 14 of the Public Procurement Law, authorized to represent the Contractor remain in the relationship specified in art. 17 sec. 1 pt 2-4 Pzp with:

a) Employer,

b) persons authorized to represent the Employer,

c) members of the tender commission,

d) persons who made a statement referred to in art. 17 sec. 2a cunless it is possible to ensure impartiality on the part of the ordering party in a different way than by excluding the contractor from participation in the procedure - 2.2.3 who has violated obligations regarding tax payments, fees or social security or health insurance premiums, which the Purchaser is able to demonstrate by means of appropriate evidence medium, except in the case referred to in Article 24 sec. 1 pkt 15 of the Act, unless the Contractor has paid the due taxes, fees or social security or health insurance contributions with interest or fines or has entered into a binding agreement regarding the repayment of these debts
