Chromatograph Gas Acquisition System for Alcohol Determination

The contracting authority is pursuing the acquisition of a gas chromatograph system for the determination of alcoholism by applying an open tender procedure with the final phase of an electronic auction, which will result in an agreement - 48 months with occupantthe first three places declared winners.

The Contracting Authority, through the application of this procedure, intends to acquire a gas-chromatograph system for the determination of alcohol, the framework agreement which will end for a period of 48 months with three economic operators. piece, the maximum amount of the frame agreement 2 pieces

Minimum quantity of the subsequent contract: 1 piece, maximum quantity of the subsequent contract 2 pieces

The supporting documents proving the fulfillment of the assumed by completing the DUAE can be:

1) Certificate regarding the lack of overdue debts, taxes or contributions to the consolidated general budget (local budget, tat etc.), at the time of the presentation; (2) The judicial record of the economic operator and of each member of the administrative, management or supervisory body of that economic operator or of those having the power of representation, decision or control within it, as it results from the certifying certificate issued by the ONRC / constitutive act; 3) as the case may be, documentswhich demonstrates that the economic operator may benefit from the derogations provided in art. on public procurement; art. 166 par. (2), art. 167 par. (2), art. 171 of Law no. 98/2016, with subsequent additions and modifications; 4) Other editing documents, as appropriate.

The supporting documents proving the fulfillment of the assumed by completing the DUAE are to be presentat the request of the contracting authority, only by the tenderers ranked on the first three places in the intermediate rankings drawn up after the electronic auction stage and the application of the award criterion.

List of persons holding decision-making positions in the contracting authority regarding the organization, the completion of the award procedure, is the following:

Tenderers, third parties and subcontractors must not find themselves in the situations provided for in art. 60, art. 164, 165, 167 of Law no. 98/2016 with subsequent additions and modifications.

The manner by which the fulfillment of the requirement can be demonstrated: it will be completed by the economic operators participating in the award procedure with the information related to their situation. The supporting documents demonstrating the fulfillment of the assumed completion by the DUAE are to be presented at thecontracting of the contracting authority, by the tenderers placed on the first three places in the intermediate ranking elaborated after the electronic auction stage and applying the award criterion. Failure to meet the requirement, failure to comply with DUAE for all participants in the procedure with the offer, attracts its rejection as unacceptable (according to art. 137 par. (2) lit. b) from HG br. 395/2016 with cocrafts and subsequent modifications]. In case of an association, each associate is obliged to submit this document for the part / s of the contract he / she will make.

At the request of the contracting authority, the foreign tenderers ranked on the first three places in the intermediate rankings drawn up at the end of the final stage electronic auction and applying the award criterion willpresent all the documents required by the awarding documentation, translated into Romanian by authorized translators. DUAE will be filled in by the economic operators participating in the award procedure with the information related to their situation.

The bidders will provide proof of possession of the opinion issued by the Ministry of Health mentioning the manufacturer and being the distributor of the productoffered according to art. 926 of the Law no. 95/2006 on health reform, with subsequent amendments and completions. In order to submit requests for clarifications regarding the awarding documentation, the economic operators will register SEAP www.e-licitatie.ro as an economic operator, according to the provisions of art. 5 par. (1) of GD no. 395/2016 and will transmit the requests having regard to the contracting authorities' terms of reference provided under art. 160 161 of Law no. 98 / 2016.

According to art. 215 of Law no. 98/2016 with subsequent additions and modifications, the contracting authority shall inform each tenderer of the decisions taken regarding the outcome of the procedure, namely the award / conclusion of the framework agreement, including the reasons for any decision not to conclude a framework agreement or to resume the atr procedureibuire, as soon as possible but no later than 3 days after the respective decisions are issued.

Any communication, request, information, notification and the like are transmitted in writing, by electronic means of communication or as an exception, the electronic ones.

Loading of all documents related to the submitted documentation will have to be signed with the electronic signatureextended, based on a qualified certificate, issued by an accredited certification service provider.
