Economic operators submitting a tender must prove a form ofregistration under the law of the country of residence, showing that the economic operator is legally constituted, that he is not in any of the situations of cancellation of the establishment and that he has the professional capacity to carry out the activities covered by the contract. The supporting documents proving the fulfillment of the assumed ones by completing the DUAE are: certificate issued by the National Trade Register Office, or in the case of foreign tenderers, equivalent documents issued in the country of residence, are to be submitted at the request of the contracting authorityonly the bidder placed on the first place in the intermediate rankings drawn up at the completion of the tender evaluation.
These documents may be:
1) certificates showing the lack of debts related to the payment of taxes, duties or contributions to the general consolidated budget, state budget, etc.) at the time of the presentation;
2) the criminal record of the economic operatorand of the members of the management, management or supervisory body of the economic operator or of the persons having the power of representation, decision or control within it, as it results from the certifying certificate issued by the ONRC / as the case may be, documents demonstrating that the economic operator may benefit from the derogations provided for in artt. 166 par.
