Performing forest management services in the Złotoryja Forest District in 2020

Reference Number: ZB.270.2.1.2020

1. The subject of the order are forest management services as definediem in art. 6 clause 1 point 1 of the Act of 28 September 1991 on forests (Journal of Laws of 2020, item 6) covering works in the field of farming and seed production, fire protection, to be carried out in 2020 in the Złotoryja N-District, and farm hunting in the hunting season 2020/2021 at the OHZ Michał-w (in part out of reach of the Złot Forest District)

Main Site: Land of the Złotoryja Forest District.Forestry school located in Wojcieszow.

The object of the contract is forest management services as defined in art. 6 clause 1 point 1 of the Act of 28.9.1991 on forests (Journal of Laws of 2020, item 6) covering works in the field of nursery management and seed production in 2020. A detailed description of the works (activities) included in the subject of the contract an appropriate one is includedand in Annex 3 to the ToR. A detailed description of the technology for performing individual forest works (activities) included in the subject of the contract is included in Annex 4 to the ToR. Description of the rules for the procedure of acceptance of works is included in Annex 5 to the ToR.Contractors who are not subject to exclusion from the contract award procedure in the circumstances referred to in art. 24 paragraph 1 point 12-23 Public Procurement Law, art. 24 paragraph 5 points 1 2 and 4 8 of the PPL and meet the conditions for participation in the procedure. In order to confirm the lack of grounds for exclusion from the procedure and to confirm compliance with the conditions for participation in the procedure, Contractorsand will be required to provide the Employer with the following statements and documents (within the time limits specified in the ToR):

a) the Contractor`s current statement as at the date of submitting bids constituting a preliminary confirmation of compliance with the conditions for participation in the procedure specified in the ToR and no grounds for exclusion, submitted on the form of a single European document orders (hereinafter: EAT), whose modelset out in the Commission Implementing Regulation (EU) 2016/7 of 5.01.2016. EAT must be submitted with the offer. EAT The Contractor prepares, under pain of nullity, in electronic form, accompanied by a qualified electronic signature. The rules related to sending the EAT form in the form of an electronic document are described in chapter 8 of the ToR. EAT folds each of the performers togethercontracting authorities (confirming compliance with the conditions for participation and the absence of grounds for exclusion to the extent that each of the contractors demonstrates compliance with the conditions for participation and no grounds for exclusion) and the Contractor, which relies on the resources of other entities on the principles set out in Article 22a paragraph 1 PZP (confirming the fulfillment of the conditions for participation in the proceedings regarding the condition, as applicableto which he shares his potential and no grounds for exclusion). Detailed rules for submission of the EAT are described in chapter 7 of the SEIT.

B) an excerpt from the relevant register or from the central register and information on economic activity, if separate provisions require an entry in the register or the register, in order to confirm the absence of grounds for exclusion pursuant to art. 24 paragraph 5 point 1 Public Procurement Law,

c) certifyan order from the competent head of the tax office confirming that the contractor is not in arrears with tax payments, issued not earlier than 3 months before the deadline for submitting bids or another document confirming that the contractor has entered into an agreement with the competent tax authority regarding the repayment of these receivables together with any interest or fines, in particular he obtained theraw release, deferment or installment of overdue payments or suspension in whole of the implementation of the decision of the competent authority, d) certificate of the competent organizational unit of the Social Insurance Institution or Agricultural Social Insurance Fund or other document confirming that the contractor is not in arrears with payment of social security contributions or health, issued onnot earlier than 3 months before the deadline for submission of bids or other document confirming that the contractor has entered into an agreement with the competent authority regarding the repayment of these receivables together with any interest or fines, in particular, he obtained the exemption provided for by law, deferment or installment of overdue payments or suspension of execution of the decision in fullhim,

e) information from the National Criminal Record in the scope specified in art. 24 paragraph 1 point 13, 14 and 21 of the PPL and, regarding conviction for an offense against imprisonment, to the extent specified by the contracting authority pursuant to art. 24 paragraph 5 points 5 and 6 of the PPL, issued not earlier than 6 months before the deadline for submission of bids,

To confirm complianceand this condition, the Contractor shall be obliged to provide the Employer with:

1) information on financial resources or creditworthiness - information should be provided in the Single European Order Document form "EAT" constituting a preliminary confirmation of compliance with the condition of participation in the procedure.

2) information from the bank or cooperative cash register savings and credit confirming the amount afterfinancial resources or the creditworthiness of the contractor, not earlier than 1 month before the deadline for submission of bids.

The document indicated in point 2) The Contractor will be obliged to submit within the time limit indicated by the Employer, not less than 10 days, specified in the call issued by the Employer to the Contractor after opening the offers.

In order to confirm the lack of grounds for exclusion from the procedure and to confirm that the conditions for participation in the procedure have been met, the Contractor shall be obliged to provide the Ordering Party with statements and documents (within the time limits specified in the ToR) - continuation of section III 1.1 of the announcement:

f) statements of the contractor with respect to FOR INthe grounds for exclusion described in art. 24 paragraph 1 point 15, 22 Public Procurement Law, art. 24 paragraph 5 points 5 and 6 of PPL, art. 24 paragraph 5 point 7 Public Procurement Law, the contractor`s statement on the non-payment of taxes and local fees, referred to in the Act of 12.1.1991 on local taxes and fees (consolidated text Journal of Laws of 2019, item 1170 as amended). as amended) (described in point 7.1 letter j - m of the ToR) - Annex 9 to the ToR.

g) statement opaffiliation or non-belonging to the same capital group

1) documents referred to in Section III.1.1) of announcement lit. b) e) and in Section VI.3 points 1 lit. f) and g) will be obliged to submit each of the contractors jointly applying for the award of the contract,

2) Contractor who demonstrating compliance with the conditions referred to in art. 22 paragraph 1b PZP, relies on the resources of other entities on zassadas defined in art. 22a paragraph 1 PZP will be required to submit, with respect to these entities, the documents listed in Section III.1.1) announcement lit. b) e), and in Section VI.3 point 1 lit. f) -2. If the Contractor has its registered office or place of residence outside the territory of the Republic of Poland instead of the documents:

1) referred to in Section III.1.1) lit.b, c, d of the announcement, submits the documentor documents issued in the country in which he has his registered office or place of residence, confirming accordingly that: (a) its liquidation has not been opened or bankruptcy has been declared, (b) it has not been in arrears with taxes, fees, social or health insurance contributions, or that it has concluded an agreement with the competent authority regarding the repayment of these claims together with any interest or fines, he has obtained the legally required exemption, deferment or installment of overdue payments or withholding in full of the decision of the competent authority,

2) referred to in Section III.1.1) point e of the notice, submits information from the relevant register or, in the absence of such registry, another equivalent document issued by the competent judicial or administrative authority of the country in whichthe contractor has its registered office or place of residence or place of residence is the person to whom the information or document relates to the extent specified in art. 24 paragraph 1 point 13, 14 and 21 of the PPL and in art. 24 section 5 points 5 and 6 of PPL

3. The documents referred to above in point 2 item 1) lit. (a) and in item 2 point 2) should be issued not earlier than 6 months before the deadline for submission of tenders. Dokumentions referred to above item 2 item 1) lit. (b) should be issued not earlier than 3 months before the offer submission deadline.

4. If in the country in which the contractor has its registered office or place of residence or place of residence, there is a person to whom the document relates, no documents referred to in point 2 shall be replaced by a document containing the relevant statementthe contractor, indicating the person or persons authorized to represent him, or the statement of the person to whom the document was to be submitted, made before a notary public or before a judicial, administrative or professional or economic self-government body competent for the seat or place of residence of the contractor or the place of residence of that person . The provisions of item 3 shall apply accordingly.5.
