Wykonywanie usług z zakresu gospodarki leśnej na terenie Nadleśnictwa Drewnica in 2020

Reference Number: ZG.270.1.2020

The subject of the contract are services in the field of forest management including works in the field of forest breeding and protection, fire protection, logging and skidding, tourist development and maintenance of the Forest Promotion Complex, to execution in the area of the Drewnica Forest District in 2020.

Economic servicesforest cover including works in the field of forest breeding and protection, fire protection, logging and logging and development.

Forest management: 8 882 rh, 368 ch. Logging and logging 11 311 m3; Crop fencing -33.65 HM

Contractors who are not subject to exclusion from the contract award procedure in the circumstances referred to in art. 24paragraph. 1 point 12-23 PZP, art. 24 paragraph 5 points 1 2 and 4 8 PZP. Based on:

1) art. 24 paragraph 5 item 1 of the PZP. The contracting authority will exclude a contractor from a public procurement procedure in respect of which liquidation has been opened, the arrangement approved by the court in the restructuring proceedings provides for satisfaction of creditors by liquidation of its assets or the court ordered liquidationhis property pursuant to art. 332 paragraph 1 of the Act of 15 May 2015 - Restructuring Law (consolidated text: Journal of Laws of 2019, item 243, as amended) or whose bankruptcy was announced, with the exception of the contractor who after the declaration of bankruptcy has concluded the approved arrangement by a final court decision, if the arrangement does not provide for satisfaction of creditors by liquidation of the assets of the bankrupt, unless the court ordersliquidation of his assets pursuant to art. 366 section 1 of the Act of February 28, 2003 - Bankruptcy Law (consolidated text of the Journal of Laws of 2019, item 498);

2) Art. 24 paragraph 5 item 2 of the PZP. The contracting authority will exclude from the procedure for awarding a public contract a contractor who has seriously violated his professional obligations, which undermines his integrity, in particular when the contractor as a result of the intendedhe did not perform or grossly negligent failed to perform or improperly performed the contract, which the Employer is able to demonstrate by means of appropriate evidence;

3) art. 24 paragraph 5 item 4 of the PZP. The contracting authority will exclude from the procedure for awarding a public contract a contractor who, for reasons attributable to him, has failed to perform or improperly significantly performed an earlier contract regardingpublic procurement or concession contract concluded with the awarding entity referred to in art. 3 clause 1 item 1-4 of the PZP, which led to the termination of the contract or the award of damages;

4) art. 24 paragraph 5 item 5 of the PZP The contracting authority will exclude from the procedure for awarding a public contract a contractor who is a natural person who has been validly convicted of an offense against an employee's rights or an offenseagainst the environment, if imprisonment, restriction of liberty or a fine of not less than PLN 3, 000 were imposed on him;

5) art. 24 paragraph 5 point 6 of the PZP. The Awarding Entity will exclude from the procedure for awarding a public contract if an office member of its management or supervisory body, a partner in a public or partner company or a general partner inlimited partnership or limited joint-stock partnership or commercial representative, a final conviction for the offense referred to in art. 24 paragraph 5 item 5 of the PZP;

6) art. 24 paragraph 5 point 7 of the PZP. The Awarding Entity will exclude a contractor from a public procurement procedure for which a final administrative decision has been issued on the breach of obligations arising from the provisions of labor law, environmental protection law orof social security, if the decision was imposed with a financial penalty of not less than PLN 3, 000;

7) Art. 24 paragraph 5 point 8 of the PZP. The Awarding Entity will exclude from the procedure for awarding a public contract a contractor who has violated obligations regarding the payment of taxes, fees or social security or health insurance contributions, which the Awarding Entity is able to demonstrate by appropriate meansthe public races, except in the case referred to in art. 24 paragraph 1 item 15 of the PZP, unless the contractor has made payments of taxes, fees or social security or health insurance contributions together with interest or fines, or has entered into a binding agreement on the repayment of these debts.

Contractors who meet the conditions of participation in the procedure may participate referred to inrt. 22 paragraph 1b of the PZP regarding:

1) competences or powers to conduct specific professional activities, provided that it results from separate provisions.

does not impose specific requirements as to the description of compliance with the condition of participation in the procedurein relation to the condition regarding economic viability. The condition with regard to the financial situation will be met if the Contractor demonstrates that he has the financial means or creditworthiness not less than:

1. The awarding entity envisages the possibility of awarding the orders referred to in art. 67 section 1 item 6 of the PZP, within a period of 3 years from the date of the basic order. Orders these boxthey will repeat services similar to those covered by this contract.

2. The Purchaser requires a deposit in the amount specified below for the Packages:

For Package I in the amount of PLN 6, 200

For Package II in the amount of PLN 8, 500

For Package III in the amount of PLN 10, 000

For Package IV in the amount of PLN 11, 000

The deposit should be submitted before the deadline for submission of bids.

3. The bid bond maymay be provided in one or several of the following forms:

1) money,

2) bank guarantees or cooperative guarantees of a savings and credit union, with the guarantee that the guarantee is always a monetary guarantee,

3) bank guarantees,

4) insurance guarantees,

5) sureties granted by entities referred to in art. 6b paragraph 5 points 2 of the Act of November 9, 2000 onestablishment of the Polish Agency for Enterprise Development (consolidated text: Journal of Laws of 2019, item 310, as amended).

4. The bid bond paid in cash should be made by transfer to the bank account of the Employer at PKO BP SA IV O / Warszawa account number: 56 1020 1042 0000 8002 0009 4441 with the note: bid bond for securing the offer in the proceedings on "Provision of forest management services infor the Drewnica Forest District in 2020, Package ___________________. "A deposit in cash will be effective if it is credited to the Purchaser's bank account within the given deadline.

5., insurance guarantee or sureties granted by the entityy referred to in art. 6b paragraph 5 points 2 of the Act of November 9, 2000 on the establishment of the Polish Agency for Enterprise Development should result unconditional, on the first written request submitted by the Employer within the time of the offer, the guarantor's obligation to pay the Employer the full amount of the bid bond in the circumstances specified in art. 46 section 4a PZP and art. 46 section 5 PZP

6. defectsID submitted in a form other than money should be submitted together with the Offer in the original in electronic form, i.e. bearing a qualified electronic signature of persons authorized to issue it. The bid bond must secure the offer for the part of the contract throughout the period of the offer. The offer of the Contractor who does not pay the bid bond or lodges the bid bond incorrectly will be rejected fromproceedings based on art. 89 paragraph 1 point 7b PZP.

7. The content of the bid bond must contain the following elements:

1) name of the principal (Contractor), beneficiary of the guarantee / surety (Purchaser), guarantor (bank or insurance institution providing the guarantee / surety) and indication of their registered offices,

2) specification of the claim which they have be secured with a guarantee / a suretyspecification of the subject of the order

3) amount of the guarantee / surety,

4) obligation of the guarantor / guarantor to pay unconditionally

and irrevocably the amount of the guarantee / surety at the first written request of the Ordering Party in the circumstances specified in art. 46 section 4a PZP and art. 46 section 5 PZP.
