The subject of the orders are services in the field of forest management in accordance with the definition in art. 6 par. 1 point 1 of the Act of 28.9.1991 on forests (consolidated text: Journal of Laws of 2017, item 788 with further amendments: "Forest Act")working in the field of forest breeding and protection, fire protection, harvesting and skidding of wood and forestry services for forestry and seed production, to be carried out in the Lubsko Forest District in 2019. The material scope of the order includes total amounts of work in the field of breeding and forest protection, fire protection, harvesting and skidding, and forest serviceswithin the scope of work on forestry school and seed production resulting from Annex 3 to the SETC, which consists of Annex No. 3.1. the size of works by activity, attachment no. 3.2. difficulty zones and logging distances, and Annex No. 3.3, assortment system for obtaining timber.

1) The subject of the order is forest management services in accordance with the terms of art. 6 par. 1 point 1 of the Act of 28.9.1991 on forests (consolidated text: Journal of Laws of 2017, item 788 with further amendments: "Law on forests") covering works in the field of forest breeding and protection, fire protection, harvesting and skidding of timber and forestry services for work on forest and seed schoolc) to be carried out in the Lubsko Forest District in 2019.

2) The scope of the subject matter of the order covers the total amount of timber harvesting and logging work resulting from Annex 3 to the SETC, which consists of Annex No. 3.1. the size of works by activity, attachment no. 3.2. zones of difficulty and the distance of skidding and Annex No. 3.3 assortment system for obtaining timber.

3)A detailed description of the works (activities) included in the subject of the order has been included in Annex 3, respectively. The material ranges listed in Annexes 3.1 to 3.3. are estimated,

4) A detailed description of the technology for the implementation of individual forest works (activities) included in the subject of the order is included in Annex 4 to the ToR.

5) Descriptions of activitieswriting individual works (activities) included in the subject of the order are described in Annex 4 to the ToR.

6) The description of the procedures for the acceptance of works has been included in Annex No. 5 to the ToR.

The Employer does not make any specific requirements for the description of compliance with this condition participation in the proceedings.

1. In order to confirm the lack of grounds for exclusion from the proceedings and in-In order to confirm compliance with the conditions for participation in the proceedings, the Contractor will be required to provide the Employer with the following statements and documents: a) Contractor's statement constituting preliminary confirmation of compliance with the conditions of participation in the procedure set out in this SIWZ and no grounds for exclusion, submitted on the uniform European order form document (hereinafter referred to as : "HEDZ), b) excerpt from the relevant register or central records and business information, if separate regulations require an entry in the register or records, in order to confirm the absence of grounds for exclusion under Article 24 (5) (1) of the PPL; a certificate from the competent head of the tax office confirming that the contractor is not in arrears with paying tax; d) a certificate of ownershipthe local organizational unit of the Social Insurance Institution or the Agricultural Social Insurance Fund or other document confirming that the contractor is not in arrears with paying social security or health insurance contributions; e) g) information from the National Criminal Register in the scope specified in art. 24 sec. 1 items 13, 14 and 21 of the PPL and, regarding a conviction for a prison sentence, to the extent specified by the awarding entity under Article 24 (5) (5) and (6) of the PPL; (f) a statement by the contractor that he has not issued a final court decision or final administrative decision on late payment of taxes, social security or health insurance premiums or in the case issuing such a verdict or decision documents confirming the payment of thesereceivables with possible interest or fines or conclusion of a binding agreement on repayment of such receivables; g) declaration of the contractor about the lack of a ruling against him as a precautionary measure prohibiting the use of public orders; h) declaring the contractor about the lack of a final conviction judgment for offenses committed against restriction of liberty or a fine in the field-determined by the contracting authority on the basis of art. 24 section 5 items 5 and 6 PZP;

i) the contractor's statement that he did not issue a final administrative decision on violation of obligations under labor law, environmental law or social security provisions to the extent determined by the contracting authority under Art. 24 sec. 5 point 7 PZP;

j) declaration of the contractor o-not paying for taxation and local fees, referred to in the Act of January 12, 1991 on local taxes and charges.

2. In order to confirm the lack of grounds for exclusion from the procurement procedure, the proclamations mentioned in art. 24 sec. 1 point 23 PPL The Contractor will be required to submit a certificate of belonging or non-membership in the same groupsy capital.

3. Detailed information on documents submitted by contractors is included in the SIWZ, including information about documents submitted by contractors having their registered office or place of residence outside the territory of the Republic of Poland. In confirmation of fulfillment described abovej the Contractor shall submit:

a) information on financial resources or creditworthiness, which the contractor has at his disposal, which should be provided in Part IV (a) B row szosty EAT;

b) information of the bank or cooperative savings and credit union confirming the amount of funds owned or creditworthiness of the contractor, in a period not earlier than one month before the end of terminu of submitting offers.

If for justified reasons, the contractor can not submit documents regarding the financial or economic situation required by the contracting authority, he may submit another document, which sufficiently confirms fulfillment of the condition of participation in the procedure described by the contracting authority. The Contracting Party requires a deposit to be paid in the amount specified below for the Packages:

2 . When choosing offers in each Package, the Employer will be guided by the following assessment criteriay offers: 1) Price for Packages from 01/19 to 07/19 60%, 2) Independent implementation of key parts of orders from 01/19 to 06/19 - 20%, 3) Age of forestry machine type harvester for Packages from 01 / 19 to 03 / 19- 20%, 4) Independent implementation of key elements (parts) of orders for the Package07 / 19 40%, 5) Experience of persons designated for the implementation of orders - operator pilarki from 01 / 19do03 / 19 20%



3. The evaluation of compliance with the conditions for participation in the proceedings will be made in accordance with the formula "meets" / "does not meet", based on information contained in EED (Single European Order Document), then confirmed in documents or statements submitted by Contractors. The proceedings are conducted in accordance with the rules provided for the so-called "Reversed procedure", referred to in art.-24aa paragraph 1 and 2 PPL. Pursuant to the aforementioned provisions, the Awarding Entity will first evaluate the offers and then examine whether the contractor whose tender has been rated as the most advantageous is not subject to exclusion and meets the conditions for participation in the procedure. The ordering party requires a performance bond to be provided by the contractor whose offer has been considered the most advantageous-in a given Package. The security for proper performance of the contract will amount to 5% of the total price offered for the given part of the order.

6. In the scope of Package / Parts 07/19, the Employer informs that the order will be carried out using the school equipment, which is the property of the Ordering Party (with the exception of equipment required in the procedure for participation in the Package / Part 07/19); prior to the conclusion of the public procurement contract for the Package / Part 07/19, the Contractor shall enter into a contract with the Employer to lease the school equipment, which is the property of the Ordering Party. Particular provisions regarding the lease and free access to machinery / equipment / equipment of the Ordering Party necessary for the performance of the subject of the contract contain the model contract for Package / Part 07 / 19.

7. InIn the case of contractors jointly applying for the award of a contract, each of the conditions for participation in the procedure set out in point 6.2. at least one of these contractors or all of these Contractors must meet at least one. None of the contractors jointly applying for the award may be excluded from the procedure. If the Contractor is applying for several packages, the contract should be orderedthis may not, in order to demonstrate fulfillment of the conditions for participation in the proceedings, indicate the same experience, i.e. the same processing value resulting from the contract, the same technical potential, the same persons referred by the contractor to perform the contract, or the same financial means or ability credit in more than one Package.9. Based on Article. 22d ust.2 PPL The Awarding Entity may, at any stage of the proceedings, consider that the contractor does not have the required capacities if the involvement of technical resources or professional contractors in other economic undertakings of the contractor may have a negative impact on the implementation of the order.
