Requirement No.1

Bidders, third-party supporters and subcontractors must not be found in the foreseen situationslooks at articles 164, 165, 167 of Law no. 98/2016, respectively art.177, 178, 180 of Law no. 99 / 2016.

The method of fulfillment

The DUAE will be completed in accordance with art. 193 para. (1) of Law no. 98/2016. The DUAE will be completed through SEAP facilities. The supporting documents proving the fulfillment of those assumed by completing the DUAE will be presented, upon requestthe area of the contracting authority only to the bidder ranked first in the intermediate ranking drawn up at the end of the evaluation of the offers are: 1. Certificates confirming the lack of outstanding debts regarding the payment of taxes, taxes or contributions to the general consolidated budget (local budget, state budget, etc. .) at the time of presentation; 2. The criminal record of the operatorand economic and of the members of the administration, management or supervision group of the respective economic operator or of those who have power of representation, decision or control within it, as it results from the certifying certificate issued by the ONRC / the constitutive document; 3. If applicable, documents proving that the economic operator can benefit from the pre-exemptionsseen in art. regarding public procurement: art. 166, paragraph (2), art. 167, paragraph (2), art. 171 of Law no. 98/2016; 4. Other edifying documents - as the case may be. If in the country of origin or the country in which the bidder / supporting third party / subcontractor is established, documents of the nature provided for above are not issued or the respective documents do not cover all the situations provided in art.164, 165 and 167, the contracting authority will accept a declaration on its own responsibility or, if there is no legal provision in the respective country regarding the declaration on its own responsibility, an authentic declaration given in front of a notary, an administrative or judicial authority or a professional associations that have competences in this regard.

Requirement no.2.

Bidders, third party supportersand the subcontractors must comply with the Rules for avoiding the conflict of interests provided for in art. 59-60 of Law no. 98/2016-regarding public procurement. All participants in the award procedure will present a declaration of non-compliance with the provisions of art. 59-60 of Law no. 98/2016, together with DUAE according to FORM 1. The framework agreement will be concluded with a single operator economically, for each batch of products separately, without re-supplying pfinancial breakdown. In case, the offers ranked first have equal values (equal prices), the contracting authority will request the economic operators, through SEAP and in the written address, to upload documents containing the new prices.

The number of days in which they can be request clarification before the deadline for submission of tenders is 15 days, and the deadline inwhich the contracting authority will respond clearly and completely to the clarification requests / additional information regarding the award documentation is 10 days before the expiry of the deadline for submission of tenders.
