The standard form approved by the European Commission DUAE will be presented, in which the bidders are not found in the situations stipulated in art. 164, 165, 167 of the Law no.98 / 2016, in electronic format, only up to the depot limit date and timeThe supporting documents proving the fulfillment of the assumed by completing the DUAE are to be presented at the request of the contracting authority only by the tenderers placed on the first 3 places in the interim ranking made at the completion of the evaluation of the offers are: 1. In accordance with Art.137 par. (2) lit. b) of GD no. 395/2016, the bid is rejected if the bidder did not complete the DUAE.

For viewing the awarding documentation uploaded in SEAP it is necessary for the bidders to hold / install on the workstation the application that allows checking the electronic signature and viewing electronically signed documents, available on the site (s) of the signatory supplierselectronic hate. The maximum allowed size of the uploaded files in SEAP is 40Mb, the number of which is unlimited.

The contracting authority reserves the right to request information directly from the competent authorities (institutions with attributions in the field), in case of uncertainty regarding the exclusion reasons included in the FDA.

The competent institutions from which the economic operatorscan obtain detailed information on mandatory regulations in the fields of environment, social and labor relations are the Ministry of Environment, Waters and Forests and the Ministry of Labor, Family, Social Protection and the Elderly.

How to distinguish offers with equal prices:

1) To conclude the framework agreement / batch, the way of bidding with equal prices: inwhen the 1st, 2nd or 3rd places have equal prices, a new financial proposal will be required through the SEAP.

In case of equal prices for segments 2 and 3, bidders can not improve the price up to the price level offered by the economic operator ranked the previous one. If there are more than 3 after the improved financial proposalbidders placed on the first three places will all be declared winners of the framework agreement; 2) For the conclusion of the subsequent contracts / lot as a result of the resumption of the competition, the way of ranking the offers with equal prices will be as follows: the "lowest price" has two or three bidders, the contracting authority will require themsubmission of a new improved financial proposal (the unit price will be expressed in lei without VAT, with 2 decimal places / lot) in closed envelope at the headquarters of the contracting authority: Military Unit 02301, Ghencea Blvd. The Framework Agreement may be amended and / or supplemented without the organization of a new award procedure, with the agreement of the parties, within the limits of the provisions laid down221 222 of the Law no. 98/2016, corroborated with the provisions of art. 164 and 165 of GD no. 395/2016, as amended and supplemented. Changes are non-substantial and involve the possibility of purchasing additional or decreasing quantities from initial quantities or adjusting unit prices according to the formula in the model contract clause.
