Supply of dried onions, minimum frame agreement 1 515 kg, maximum 2 020 kg.followed by at least 307 kg, maximum 409 kg.

According to the provisions of art. 193 of Law no. 98/2016, the contracting authority will accept the preliminary proof as part of the DUAE (Single European Procurement Acquis), in order to demonstrate the qualification requirements. The bidders, third parties and subcontractors must not be found in the situations provided by art. 164, 165, 167 of Law no. 98 / 2016.

Prior to the award of the framework agreement, the contracting authority shall require the tenderer ranked first after applying the award criterion, up-to-date justifications:

- Certificate of absence of overdue debts, taxes or contributions to the general consolidated budget (local budget, state budget, etc.) at the time of presentation,

- The judicial record and each member of the administrative body, leadership or oversight or those who have the power of representation, decision-makinghave the control within it, as it results from the certifying certificate issued by the ONRC / constitutive act,

- as the case may be, documents that may benefit from the derogations provided in art. 166 par. (2), art. 167 par. (2), art. 171 of Law no. 98/2016,

- Other editing documents demonstrating the fulfillment of all qualification criteria according to the information contained inin DUAE. DUAE will be submitted by the third party and the subcontractor, if applicable.

If more bidders submit the financial offer of the same value and are ranked first, the contracting authority will request a new the financial offer, which will be filed electronically, in which case the bidder with the lowestThe contracting authority has the right to withhold the guarantee for participation, the bidder thus losing the amount set up, when the latter is in any of the following situations:

(a) withdraws the offer during the period of its validity,

(b) If its bid is established winning, it refuses to sign the contract / framework agreement for public acquisition in the period dis the validity of the offer.

Communication and data transmission rules:

The economic operators will send the answers to the clarifications and the possible documents requested during the evaluation offerthrough the SEAP ("Questions" section), in electronic format, signed with an electronic signature.

Within 3 days, calculated incon the day following receipt of the prior notification, the contracting authority shall provide a response indicating whether or not to take steps to remedy the alleged breach. If the contracting authority sends a response in the sense that it is going to take remedial action, it has a 7-day period for their effective implementation. Pa person who considers himself or herself to be prejudiced by the answer to the prior notice or who has not received any response within the above 3-day period and any person who considers himself / herself injured by the remedial measures taken by the contracting authority may refer the matter to the council for annulment the act of the contracting authority, its obligation to issue an act or to aaddressing remedies, as well as recognizing the claimed right or legitimate interest within 5 days.
