Food Supply Framework Agreement - Deadline for requesting clarifications 20 days before the deadline for submission of offers, address: SEAP. The contracting authority will respond in a clear and complete manner to all requests for clarification on the 10th day beforeis the deadline set for the submission of tenders.

Requirement no. 1

Declaration on non-compliance with the provisions of art. 164 of Law no. 98/2016 on Public Procurement.

The economic operator (leader, associate, subcontractor, third party) will fill in the corresponding requirementin the DUAE form in the awarding documentation.

Incorporation in the situation provided in art. 164 of Law no. 98/2016 regarding the public procurement attracts the exclusion of the bidder from the procedure applied for awarding the public acquisition contract. 2

Declaration on non-compliance with the provisions of art. 165 of Law no. 98/2016 on public procurement corroborated with art. 166 (2) of-same economic act

The economic operator (leader, associate, subcontractor, third party supporter) will fill in the corresponding requirement in the DUAE form in the awarding documentation. 165 of Law no. 98/2016 on public procurement entails excluding the tenderer from the procedure applied for awarding the public procurement contract.:

- a certificate of fiscal attestation for legal persons regarding the payment obligations to the consolidated state budget from which the lack of overdue debts regarding the payment of taxes, duties or contributions to the consolidated general budget at the moment of its presentation is revealed. will be presented, at the request of the contracting authority, only by the tenderers-ranked in the first three places in the intermediate rankings completed at the evaluation of the bids (including associate, subcontractor, supporter). 3

The economic operator (leader, associate, subcontractor, third party) will fill in the corresponding requirement in form DUAE from the awarding documentation.

Incorporating the situation provided in art. 167 of Law no. 98/2016 regarding the public acquisitions attracts the exclusion of the bidder from the procedure applied for awarding the public acquisition contract.

The supporting documents will be submitted, at the request of the contracting authority, only by the tenderers placed on the first 3 places in the intermediate rankings completed at the evaluation of the tenders (including the associate, the subcontractor, the supporting party). 4
