The contract aims to provide food for the Sighetu Marmatiei Municipal Hospital. Alimets will be provided on the basis of orders from the Contracting Authority. Estimates of the minimum and maximum quantities that may be required throughout the entire framework agreement: describeaccording to the specification and Annex B (Information on batches). The deadline for the contracting authority to respond to the clarification requests is 10 days before the deadline for submission of tenders.

Requirement 1: The bidders, associates, third parties and subcontractors must not find themselves in the situations referred to in art. 164, 165, 167 of Law no. 98/2016-Methodthrough which it can be demonstrated the fulfillment of the requirement: IT SHALL COMPLETE DUAE by the economic operators participating in the award procedure, with the information related to their situation.

The supporting documents are requested by the bidders placed on the first three places in the intermediate ranking list drawn up at the completion of the tender evaluation. Documents can be:

1. certificates relating tod lack of outstanding debts related to the payment of taxes, duties or contributions to the general consolidated budget (local budget, state budget, etc.) at the moment of presentation; the criminal record of the economic operator and the members of the management, management or supervisory body of that economic operator, or of those having the power to represent, decide or co-operatentrol within it, as it results from the certifying certificate issued by the ONRC / Constitutive Act

3. as the case may be, documents demonstrating that the economic operator may benefit from the derogations provided for in art. 166 paragraph (2), art. 167 par. (2), art. 171 of Law 98/2016 on Public Procurement; other editing documents, as the case may be.

Requirement 2: Bidders, associates, third partiessupporters and subcontractors should not find themselves in the situations provided for in art. 60 of Law 98/2016

The manner in which the fulfillment of the requirement can be demonstrated: The economic operator (leader, associate, third party, subcontractor) will fill in the corresponding requirement in the DUAE. -60of Law no.98 / 2016 is submitted by all participants in the procedure (economic operator submitting the offer individually or in association, subcontractor or third party) with the DUAE until the deadline for the submission of tenders and with the deadline for receipt of the tenders in the tender notice.

III.2.1.b) The ability to exercise professional activity

Information and formalities necessary for evaluating if requirements are met:

Ofertantii, Subcontractors participating in the awarding procedure must have an authorized economic activity (at the headquarters, work points, etc.) in relation to the subject of the procedure and the requirements of the specifications.

The tenderers, the supporting third parties and the subcontractors submitting the tender must prove a form registration under the conditions of the law of the country of residence, from which it appears as the operatoreconomic is legally constituted, that he is not in any of the situations of cancellation of establishment and that he has the professional capacity to perform the activities that are the subject of the contract.

The way to demonstrate the fulfillment of the requirement: YOU WILL COMPLETE DUAE, to all participants in the award procedure (bidders, third parties, subcontractors) with• The supporting documents proving the fulfillment of the assumed ones by completing the DUAE, respectively: Constricted certificate issued by the ONRC, or in the case of foreign tenderers, equivalent documents issued in the country of residence, are to be presented at the request of the contracting authority only by the bidders placed on the top three places in the Intermediate Rankingdari elaborated at the completion of the evaluation of the offers. According to art. 175 of Law no. 98/2016, the contracting authority has the right to establish through the awarding documentation requirements regarding the economic and financial situation that are necessary and appropriate forto ensure that economic operators have the necessary economic and financial capacity to secure the public procurement / framework agreement and to be protected against a possible risk of proper non-fulfillment of the contract

The contracting authority will conclude a framework agreement with a maximum of 3 economic operators.

When two or more offers have a totally equal value-of the financial proposal and are ranked in the same place, for the purpose of the division, the contracting authority requests new financial proposals to them, without this affecting the top positions in the ranking according to art. 139 par. (3) of GD 395 / 2016.

The submission of tenders is done by electronic means, in the "Questions" section.uploading in SEAP, it is necessary for the economic operators to hold / install on the workstation, the application that allows verification of the electronic signing and viewing electronically signed documents (available on the website of the electronic signature providers).

The bidders will indicate the confidential information / items, classified or protected by an intellectual property right, based on the applicable law, which the contracting authority has the obligation not to disclose.

The clarification requests of the potential bidders will be addressed exclusively in SEAP, in the "Questions" section and in the "Documentation and clarification" section of the announcement the contracting authority will not respond to the requests addressed in another waymunication than that established in accordance with the provisions of art. 64 of Law 98/2016 for the subsequent posting of tenders.
