Provision of ferry transport services through Odra in the Lubuskie voivodship:

Main Site: Droga wojewodzka nr 282 Zielona Gora Milsko. Transportation between Milsko and Przewoz

Order includes:

1. The carriage of inter-shore ferry with a bottom-valley drive of motor vehicles, horse-drawn vehicles, cattle and passengers within the hours set in the schedule constituting Annex No. 1 to the contract.

2. The Contractor shall supervise the ferry at a berth in accordance with the provisions of the Act on Inland Navigationlead description of the subject of the order and technical requirements are set out in Chapter III of the ToR.

Statements and documents that contractors must provide to demonstrate the absence of grounds for exclusion and confirmation of compliance with the conditions for participation in the proceedings:

1. The Contractor is obliged to attach to the offer an affirmative statement constituting the initial confirmation as of the day of submitting the offerse that the Contractor:

a) is not subject to exclusion,

b) meets the conditions for participation in the proceedings

2. The declaration referred to in point 1 is to be submitted by the Contractor in the form of a single European order document (EED) drawn up in accordance with the standard form provided in the Commission Implementing Regulation issued on the basis of art. 59 par. 2 of Directive 2014/24 / EU, fromhereinafter referred to as the "single document" (attachment No. 1 to the tender form) under pain of nullity, in electronic form, bearing a qualified electronic signature, in accordance with the principles of point 8.2 of the SIWZ.

3 The contractor requires that the Contractor in the scope of qualification criteria described in part IV EAT only filled in the ALFA section in Part IV and did not fill any of the other sections in the section-IV. 4. Contractor, within 3 days from the date of posting on the website information referred to in Article 86 par. 5 of the Public Procurement Law, will provide the orderer with a declaration of belonging or non-affiliation to the same capital group, referred to in art. 24 sec. 1 point 23 of the Public Procurement Law. Along with the submission of a statement, the contractor may provide evidence that links to another contractor failthey lead to distortion of competition in the procurement procedure.

5. At the request of the contracting party, the contractor is obliged to submit the following statements or documents:

5.1 To confirm that the contractor meets the conditions for participation in the proceedings (for all tasks):

1) documents confirming that the contractor is insured against civil liability in the scope ofactivity related to the subject of the order for a guarantee sum not less than PLN 200, 000.00

2) list of persons, directed by the contractor to perform the public order, in particular those responsible for the provision of services, including information on their professional qualifications, qualifications and experience and education necessary to complete the public contract, as well asesu of their activities and information about the basis for disposing of these persons - if for justified reasons the contractor can not submit the documents required by the contracting party, referred to in point 5.1.1), the contracting authority allows the contractor to submit other documents referred to in Article 26 par. 2c of the Public Procurement Law - the Contractor will fulfill the condition if he shows the minimum level of ability, -ie: (for all tasks)

1) is insured against civil liability in the scope of conducted activities related to the subject of the order for a guarantee sum of not less than PLN 200, 000.

In the case of submitting an offer by entities acting in co-operation, the condition may be met in total.

I. The Contracting Authority provides for the application of the procedure referred to in art. 24 aa paragraph 1 of the Pz actp.

II. Premises for exclusion of contractors: 1. The contractor is excluded from the contract award procedure in respect of which any of the circumstances referred to in Article 24 section 1 items 12 - 23 of the Public Procurement Law. 2. In addition, the orderer will exclude a contractor pursuant to art. 24 sec. 5 points 1, 5, 6, 7.8 of the Public Procurement Law - III. At the request of the ordering party, the contractor is obliged to submit the followingdocuments or documents: In order to confirm the lack of grounds for exclusion of the contractor from participation in the proceedings, the contractor is required to submit documents in accordance with the Regulation of the Minister of Development of 26/7/2016 regarding the types of documents that the contracting authority may request from the Contractor in the procurement procedure (Dz.U. item .1126) ie pairs 5. point: 1), 2), 3), 4), 5) 6), 7), 8), 9). If the Contractorhas its registered office or place of residence outside the territory of the Republic of Poland, and also if the person whose document relates is domiciled outside the territory of the Republic of Poland, paragraph 7 of the abovementioned Act applies. Regulation on the types of documents. Contractor based in the territory of the Republic of Poland, in relation to a residentoza of the territory of the Republic of Poland, the document of which applies - paragraph 8 of the abovementioned Regulation on document types IV. The Contractor is bound by the offer 60 days from the deadline for submission of offers. The bid validity period begins with the expiry of the deadline for submission of bids (Article 85 paragraph 5 of the Public Procurement Law).

V. Requirements regarding the bid bond: 1. The contractor is obliged to pay the bid bond in a high amount20, 000.00 PLN (in words: twenty thousand PLN 00/100) - for each task separately

Before the deadline for submitting offers.

2. The bid bond can be contributed in:

1) money,

2) bank guarantees, or social and credit union guarantees, except that the surety is always a cash guarantee;

3) bank guarantees;

4) insurance guarantees;

5 ) guaranteedgranted by entities referred to in art. 6b par. 5 point 2 of the Act of 9.11.2000 on the establishment of the Polish Agency for Enterprise Development (Journal of Laws of 2016, item 359). 3. The bid bond in the form of money must be paid by bank transfer to the bank account GETIN NOBLE BANK S.A O ZIELONA GORA account no. 38 1560 0013 2263 6869 1000 0011, with a note on the transfer: "Wadium in proceedings ZDW-ZG-WZA-3310-109/2018 on "Provision of transport services by ferries through Oder in the voivodship of Lubusz: Task No. ..."

VI. The offer should contain:

1) completed offer form,

2) commitment to share resources - appendix 2 to the offer form (if the contractor relies on the resources of another entity)

3) proof of payment of the bid bond,

4) completed price form.

5) power of attorney to sign the offer in the originalle or a copy certified by a notary public - in the case of signing an offer and confirming the true copy of documents by a person not mentioned in the excerpt from the relevant register or central records and information about the contractor's business activity.

VIII. Supplement to section III.2.3) - The contracting authority requires contractors to indicate the name and surname of employees who have navigational rights to carry across the river, i.e. the patent of the carrier along with information about the experience of those persons subject to the criterion of evaluation ofert. Name and surname and information on the qualifications and experience of employees possessing a sailing license will be given by the Contractor whose offer will be evaluated as the most advantageous at the request of the Employer.
