I. The sole bidder / associated bidder /the supporting subcontractor / third party must prove that it does not comply with the provisions of art. 164 of Law no. 98 / 2016.

In this respect, the sole tenderer / associated tenderer / subcontractor / supporting party will complete the DUAE Part III "Exclusion Reasons" Section A "Grounds for Criminal Offenses." Bidder ranked first after applying the award criterion, previously aof the framework agreement, shall present, at the request of the contracting authority, the following editorial documents proving / confirming the non-compliance with the situations provided in art. 164 above, both for the sole offeror / associated offeror and for the subcontractor / third party stated in the offer:

- The criminal record of the economic operator and the members of the administrative bodymanagement, or supervision of that economic operator or those having the power of representation, decision-making or control within it, as evidenced by the certifying certificate issued by the ONRC / Act of incorporation, - Other editorial documents, as the case may be ;

II. The sole tenderer / associated offeror / the subcontractor / third party must prove that it does not fitThe provisions of art. 165 of Law no. 98 / 2016.

In this respect, the sole tenderer / associated offeror / subcontractor / third party will complete the DUAE Part III "Exclusion Reasons" Section B "Reasons for Paying Taxes or Social Security Contributions."

The Bidder on the First place after application of the award criterion, prior to the award of the framework contract, will be presented, at the request of the contracting authority, the following editorial documents proving / confirming non-compliance with the situations stipulated in art. 165 above, both for the sole tenderer / associated bidder and for the subcontractor / third party stated in the offer:

A. Romanian legal persons must submit supporting documents proving the fulfillment of the assumed onescompleting the DUAE:

- Certificate of fiscal attestation regarding the fulfillment of the obligations to pay local taxes and fees and other local budget revenues - in original / legalized copy / legible copy, with the mention "according to the original", showing the lack of overdue debts at the moment of their presentation,

- Certificate of fiscal attestation regarding the fulfillment of the payment obligationstaxes and social security contributions to the general consolidated budget (National Agency for Fiscal Administration, General Direction of Public Finances), in original / legalized copy / legible copy with the mention "according to the original", showing the lack of overdue debts at the moment of their presentation.

B. Foreign legal persons will present any edifissued by the authorized institutions of the country of origin (certificates of fiscal attestation, criminal records, other equivalent documents, etc.) proving that they have fulfilled their obligations to pay taxes, duties or contributions to the general consolidated budget, in compliance with the national law of the country of residence of the sole offeror / offerort / the subcontractor / third party or the country where the sole bidder / associated bidder / subcontractor / supporter is established. From the editorial documents submitted, there must be a lack of overdue debts at the moment of their presentation.

III. The sole tenderer / associated offeror / subcontractor / third party must demonstrate that they do not comply with the provisions of art.. 167 of the Law no. 98 / 2016.

Duration of the contract - 23 months, out of which:

- Duration of the services - 11 months,

- Duration of the noticeapproval and approval of the Technical and Economic Indicators (HG issue) and the issuance of GD for expropriation and expropriation decision - 12 months.

Duration of execution of services - 11 months, of which:

1 month preparatory activities,

8 months for the elaboration of SF and obtaining the approvals and agreements,

2 months for the CAP and obtaining the building permit from the date of issuing the commencement order of catis the beneficiary after issuing the expiration decision.

Rules for communication and data transmission: requests for clarification regarding this tender documentation will address exclusively to the SICAP in the "Questions" section of the award procedure conducted by electronic means, and responses to them will be published in the SICAP at the "Documentation andclarifications and decisions "in the announcement / invitation to participate, the contracting authority will not respond to the requests addressed by another means of communication.

For the submission of requests for clarifications regarding the awarding documentation, the economic operators will register in SICAP www.e-licitatie .ro as economic operators and as participants in the awarding procedurefor the subsequent submission of tenders: The evaluation committee will send the clarification requests in relation to the offer by using the technical facilities available in the SICAP (the "Questions" section). The economic operators will send the answers to the clarifications and any requested documents during the evaluation of the offers through the SICAP (the "Questions" section), inelectronic format, signed with electronic signature, according to Law no. 455 / 2001.

During the performance of the contract, the contracting parties have the right to agree to modify the clauses of the contract by means of an additional act, including in the event of occurrence of circumstances prejudicial to their legitimate commercial interests and which could not be foreseen at the conclusion of the contract, in accordancewith art. 221 of Law no. 98/2016 on Public Procurement.

The public procurement procedure will be canceled if the financing and commitment appropriations are not secured by the date of signature of the contract.
