Within the Feasibility Study Elaboration for VO Bistritthe following services will be provided and the following documents will be elaborated: • • Elaboration of the Feasibility Study, taking into account the full applicability of the legislation in force (norms, norms, standards, laws, etc.) • • Preparation of the supporting documentation and assistance Beneficiary for submitting and supporting the financing application; • • Preparing the awarding documentationthe contract for the design and execution of works and the granting of the necessary technical assistance during the period of the public procurement procedure for the design and execution of the works.

In accordance with the provisions of art. 20 of the Service Contract, any modifications that may occur during the execution of the contract refers to the following without being limited to: modifiers of the parties to the contractante; modifications generated by changes / amendments legislative / normative / STAS / norms / orders / instructions / etc .; (MT, MFE, Central and / or Local Institutions, ARR, Beneficiary, MIA, SRI, Ministry of Economy and Energy, Certified Auditors, etc.); prolonging delivery / delivery times; changes caused by staff replacement; changes caused by subcontractors replacement / introduction; changes caused by the application of the law on historical monuments, road safety audit, PUZ development, if applicable; modifications generated by research and archaeological research requirementsif they will be carried out after the signing of the contract, with the contractual preconditions, only if they do not represent substantial modifications within the meaning of art. 221 par. (7) of the Law no. 9. The duration of the contract may be in accordance with Article 20 of the Service Agreement. More info in the contract.

To demonstrate the fulfillment of the qualification criteria / requirements will bepresent:

I. The sole Tender / Associate Bidder / Subcontractor / Tenderer must prove that it does not comply with the provisions of Art. 164 of Law no. 98 / 2016.

In this respect, the Single Offeror / Associate Bidder / Subcontractor / Supplementary Territory will complete the DUAE - Part III "Exclusion Grounds" - Section A "Reasons for Criminal Offenses."

ranked first after application of the award criterion, prior to the award of the contract, shall present, at the request of the Contracting Authority, the following editorial documents proving / confirming non-compliance with the situations referred to in art. 164 above, both for the Single Offeror / Associate Bidder and for the Supported Subcontractor / Terter stated in the offer:

- the recordjudiciary of the economic operator and of the members of the management, management or supervisory body of the respective economic operator, or of those who have the power of representation, decision or control within the economic operator as it results from the certifying certificate issued by the ONRC / act constitutive, - other editorial documents, as appropriate. II. Sole Bidder / Affiliate Bidder / Subconthe tract / supporter must prove that they do not comply with the provisions of art. 165 of Law no. 98 / 2016.

In this regard, the Single Offeror / Associate Bidder / Subcontractor / Supporter will complete the DUAE - Part III "Exclusion Reasons" - Section B "Reasons for Paying Taxes or Social Security Contributions.", the bidder ranked on the first loc after applying the award criterion, prior to the award of the contract, shall present, at the request of the Contracting Authority, the following editorial documents proving / confirming the non-compliance with the situations stipulated in art. 165 above, both for the Single Offeror / Associated Offeror and for the Supported Subcontractor / Tertiary stated in the offer:

A. Romanian Legal Personsmust present: - a certificate of fiscal attestation regarding the fulfillment of the obligations to pay taxes, duties or contributions to the general consolidated budget, from which the lack of overdue debts at the moment of its presentation shall occur. B. Foreign legal persons shall present any edifying documents issued by the authorized institutions of the country of origin (certificates offiscal records, criminal records, other equivalent documents, etc.) proving that they have fulfilled their obligations to pay taxes, duties or contributions to the consolidated general budget in accordance with the national law of the country of residence of the sole bidder / Associate Bidder / Subcontractor / Supporter or Country where the Single Offeror / Offerassociate teller / subcontractor / supporter is established. From the editorial documents submitted, there must be a lack of overdue debts at the time of their presentation.

III. The sole Tender / Associate Bidder / Subcontractor / Tenderer must prove that it does not comply with the provisions of Art. 167 of the Law no. 98 / 2016.

In this regard, the Bidder / BidderAssociate / Subcontractor / Supportive Tertiary will complete the DUAE - Part III "Exclusion Reasons" - Section C "Insolvency, Conflicts of Interest or Professional Misconduct."

1. The deadlines specified in the Payment Agreement are justified by the complexity of the road infrastructure project (major interest projects), as well as by the financial circuits of the funds involving several state institutions. The duration of the contract is d14 months from the start date of the contract. In order to complete the DUAE, the bidders will use the editable form provided by the Contracting Authority in SEAP, in accordance with the model published by ANAP by the Notification of 01.09.2016. 4. The awarding documentation is attached in full in SEAP. Documents are signed by electronic in accordance with the provisions of art. 22, paragraph (2) of GD no. 395/2016. 5. The person who considers himself / herself injured by an act of the contracting authority may be awareThe National Council for Solving Complaints with a view to the annulment of the act of the Contracting Authority, its obligation to issue an act or to take remedial measures, as well as to recognize the claimed right or the legitimate interest, within 10 days, according to the provisions of art. 8 par. (1) lit. a) of Law no. 101/2016. For judicial settlement, personthe year considered to be injured may be referred to the competent court, according to the provisions of art. 49 of Law no. 101/2016. To resolve the objection formulated in the conditions of art. 8 or art. 49 of Law no. 101/2016, under the sanction of its rejection, the person who considers himself / herself injured must be a bail in advance under the conditions provided by art. 61 index 1 din Law no.101 / 2016.

6. The public procurement procedure is initiated under the following conditions: - The conclusion of the public procurement contract is conditioned by obtaining / approving the financing of services from funds from the state budget and / or European non-reimbursable funds, the signing of the contract being possible only in the situation where it is observed employment provisionsbudget expenditures under public finance legislation. If, for any reason, the obtaining / approval of the financing of services from funds from the state budget and / or European non-reimbursable funds is not achieved, the Contracting Authority shall apply the provisions of art. 212 alin (1) lit. c) the second sentence of Law 98/2016, it is impossible to conclude cpublic procurement. Although at the date of initiation of this public procurement procedure there is no signed financing agreement, the Contracting Authority estimates that it will obtain the financing required to sign the contract in the second semester of 2019.
