40 level crossings, of which 20 will be selected finally for which the feasibility study will be drawn up. 177, 178, 180 of Law no. 99/2016. The DUAE declaration will be completed directly in the SEAP, in the dedicated section of the procedure of interest (the DUAE already configured by the entitiescontracting party). Obligation to complete the initial of DUAE by bidders / candidates (including for associates / subcontractors / third parties)supporters) as the first evidence of non-inclusion in the situations of exclusion and of meeting the capacity requirements. - the criminal record of the economic operator and the members of the administration body, ofmanagement or supervision of the respective economic operator or of those with power of representation, decision or control within it, as it results from the certifying certificate issued by the ONRC / the constitutive act,

- as the case may be, documents proving the fact that the economic operator can benefit from the derogations provided in art. 179 para. (2), art. 180 paragraph (2), art. 184of Law no. 99/2016 regarding the sectoral acquisitions.

For foreign natural / legal persons any document considered edifying issued by the competent authorities of the respective country.

1) If it is found that the offers ranked first have equal scores, The AC will ask the respective bidders, for separation, a new financial proposal, in a sealed envelope, in which case the contract will be awarded to the bidder whose newfinancial proposal has the lowest price;

2) No alternative offers are accepted;

3) The bidders will specify in the technical proposal the information they consider confidential and which cannot be disclosed to third parties, mentioning the reasons why this information should be confidential .

The interaction with the bidders, respectively the process of evaluation of the bids will take placeaccording to the following rules:

- In order to view the award documentation uploaded in the SEAP it is necessary for the economic operators to own / install on the workstation the application that allows the verification of the electronic signature and the visualization of the electronically signed documents (available on the websites of the electronic signature providers),

- For sending clarification requests regardingthe attribution documentation, the economic operators will be registered in the SEAP (www.e-licitatie.ro) as economic operator according to the provisions of art. 5 paragraph (1) of H.G. no. 394/2016 and will submit the requests taking into account the response time of the contracting authority provided in art. 172-173 of Law no. 99 / 2016.

Clarification requests and answers to clarification requests seeor posted in legal term under the "Request for clarifications / questions / communications" section of the participation notice published on the website www.e-licitatie.ro in the form of one or more distinct documents / files signed with the electronic signature.

The financial proposals submitted by the bidders in SEAP are not accessible to the contracting entity until the completion of the document checksqualification and technical proposal.

The winning bid will be designated on the basis of the "best value for money" criterion, in compliance with all the specifications in the award documentation.

The correspondence and all the documents submitted by the economic operators will be in Romanian, or accompaniedte of authorized translation into Romanian.
