Bidders, third partiessupporters and subcontractors must not be found in the situations provided in art. 164, 165, 167 of Law no. 98/2016 regarding public procurement.

The way in which the requirement can be demonstrated: THE DUAE WILL BE COMPLETED by the economic operators participating in the award procedure with the information related to their situation. The DUAE will be completed by accessing the "Documentations from the participation notice "on the electronic page https: //sicap-prod.e-licitatie.ro

The supporting documents proving the fulfillment of those assumed by completing the DUAE will be presented, at the request of the contracting authority, only by the tenderer classified on 1st place in the intermediate ranking prepared at the end of the evaluation of the offers.

These documents can be:

(a) certifihow much is the tax certificate regarding the lack of outstanding debts regarding the payment of taxes, taxes or contributions to the general consolidated budget (local budget, state budget, etc.), at the time of presentation,

(b) the criminal record of the economic operator and the members of the body administration, management or supervision of the respective economic operator or of those who have the power to representment, decision or control within it, as it results from the certifying certificate issued by the ONRC / the constitutive act,

(c) as the case may be, documents proving that the economic operator can benefit from the derogations provided in art. 166 para. (2), art. 167 para. (2), art. 171 of Law 98/2016 on public procurement,

(d) the participation guarantee will be charged in the SEAP until the date and time limit for submission of tenders,

(e) other documents, as the case may be

In the sense of the provisions of art. 59-60 of Law no. 98/2016 regarding public procurement, a declaration will be submitted by all participants (tenderer, subcontractor, third party supporter).

Foreign legal entities will present edifying documents for proof of eligibility. For the non-tenderersteeth will apply prev. art. 165 of Law 98/2016 on public procurement. The documents will be presented in the original, a certified copy or a legible copy with the mention "in accordance with the original", accompanied by their authorized translation into Romanian. eco operatorsnomici can submit a declaration on their own responsibility according to art. 168 of Law no. 98/2016 regarding public procurement.

Annual general turnover. The bidder (economic operator or members of the association together) must demonstrate the average of the global turnover for the last 3 years (2016, 2017, 2018) with a minimum estimated value of RON 778 291.46 excluding VAT.

Offers that meet the qualification criteria are evaluated by awarding scores according toSelected criteria.

The offer that meets the qualification criteria and obtains the highest score after applying the selection criteria will be declared a winner by the evaluation committee. In case of equal points, the winner will be declared the winner with the lowest price.

The way to divide the offers with equal scores: if the offers ranked on the firstplace have equal scores, the contracting authority will award the contract of the tenderer with the lowest price.

If the prices are equal, the contracting authority can request new financial proposals through SEAP. The contracting authority assures the right to request a single re-offer.
