Required information and formalitiesin order to assess compliance with the above mentioned requirements:

The bidders, the supporting third parties and the subcontractors must not find themselves in the situations stipulated in art. 164, 165, 167 of Law no. 98 / 2016.

The manner by which the fulfillment of the requirement can be demonstrated: It will be completed by the economic operators participating in the award procedure with information related to their situation. complThe DUAE will be accessed by accessing the following link: https://ec.europa.eu/growth/tools-databases/espd/filter.- The supporting documents demonstrating the fulfillment of the undertaken by completing the DUAE are to be presented at the request of the contracting authority, only by the bidder placed on the first place in the interim ranking made when bid evaluation is finalized.

These documents may be:

(a) what(b) the criminal record of the economic operator and of the members of the administrative body, as well as the amount of the outstanding debts relating to the payment of taxes, duties or contributions to the general consolidated budget (local budget, state budget, etc.);, management or oversight of that economic operator or of those having power of repre- sence(c) as the case may be, documents demonstrating that the economic operator may benefit from the derogations provided for in art. 166 par. (2), art. 167 par. (2), art. 171 of Law 98/2016 on Public Procurement, (d) the participation guarantee will be charged to the SEAP until the closing date and time of submission of tenders,

(e) other editing documents, as the case may be.

In the sense of the provisions of art. 59 60 of the Law no. 98/2016, will be submitted by all the participants (tenderer, subcontractor, third party).

Declaration of non-compliance with the provisions of art. 60 of Law no. 98/2016. The statement will be presented with the DUAE.

Foreign legal persons will present papersas proof of eligibility. For non-resident tenderers the provisions of art. 165 of Law 98/2016. Documents will be presented in original, legalized copy or legible copy with the mention "according to the original", accompanied by their authorized translation into Romanian.

As far as the issuance of these certificates does not allow confirmationthe economic operators may lodge a declaration on their own responsibility according to art. 168 of Law no. 98/2016

The economic operator (leader, associate, third party) will fill in the corresponding requirement in the DUAE form in the award documentation.

- Florica Popa -Conformity and / or level (s) required to assess compliance with the above mentioned requirements: The tenderer (economic operator or members of the association together) must demonstrate the average of the figure for the last three years (2015, 2016, 2017) of at least the estimated value of RON 3 126 109.68.

The "SIAL" Paris 2018 Fair has been the subject of aopen auction auctions where no participant was registered according to the procedure report 123688 / 1.8.2018. This open tender will be carried out in respect of the deadline for submitting offers by economic operators in accordance with the provisions of art. 74 par. (3) of Law 98 / 2016.

Tenders fulfilling the qualification criteria are assessed by granting thein accordance with the selection criteria mentioned above.

The offer that meets the qualification criteria and obtains the highest score after applying the selection criteria will be declared winner by the evaluation committee. In the event of a tie, the lowest bid will be declared the winner.

The way to tie up bids with equal scores: dwhere the first ranked tenders have equal scores, the contracting authority will award the contract to the bidder with the lowest price.

If the prices are equal, the contracting authority may request new financial proposals through SEAP. The contracting authority ensures the right to request a single referral.

For viewing the awarding documentation yetin SEAP, economic operators must have a program to view the electronically signed files (this program being available free of charge on the websites of the electronic signature providers), and accessing the DUAE will be done at the following link: https: //ec.europa. eu / growth / tools-databases / espd / filter.

After finalizing the procedure and designating the winning bidder, signing the contractit will be done only in the conditions of budget and commitment credits approved at the date of signing the MMACA budget. Otherwise, the award procedure is canceled.
