The bidders, third partiesor subcontractors should not find themselves in the situations provided by art. 164, 165, 167 of Law no. 98 / 2016.

The manner by which the fulfillment of the requirement can be demonstrated: It will be completed by the economic operators participating in the award procedure with information related to their situation. Completing the DUAE will be done by accessing the following link: https://ec.europa.eu/growth/tools databases / ESPD / filter. The supporting documents proving the fulfillment of the undertaken by the DUAE completion are to be presented, at the request of the contracting authority, only by the tenderer placed on the first place in the intermediate rankings drawn up at the completion of the evaluation of the tenders.

These documents may be: (a) lack of overdue debts on payment i(b) The judicial record of the economic operator and of the members of the administrative, management or supervisory body of the economic operator (local budget, state budget, etc.) at the moment of presentation; or those who have the power of representation, decision-making or control within it, as it emerges from heaven(c) Where applicable, documents demonstrating that the economic operator may benefit from the derogations provided in Art. 166 par. In the sense of the provisions of art. 59 60 of the Law no. 98/2016, will be submitted by all the participants (tenderer, subcontractor, third party).

Declaration of non-compliance with the provisions of art. 60 of Law no. 98/2016. The declaration will be presented with the DUAE.

Foreign legal persons will provide supporting documents for proof of eligibility. For non-resident bidders-will apply the provisions of art. 165 of Law 98/2016. Documents will be presented in original, legalized copy or legible copy with the mention "according to the original", accompanied by their authorized translation into Romanian.

To the extent that the procedure for issuance of these certificates does not allow confirmation of the debt situation at the requested date, economic operators can make a statement-on its own responsibility according to art. 168 of Law no. 98 / 2016.

The economic operator (leader, associate, third party) will fill in the appropriate requirement in the DUAE form of the awarding documentation.

Minimum information and / or level (s) needed to evaluate the above mentioned requirements: The tenderer (economic operator or members the association together) must demonstrate the average of the total turnover for the last three years (2015, 2016, 2017) of at least the estimated value of RON 834, 023.74, excluding VAT.-who meet the qualification criteria are assessed by awarding the scores according to the selection criteria mentioned above.

The offer that meets the qualification criteria and obtains the highest score after applying the selection criteria will be declared winner by the evaluation committee. In the event of a tie, the winning bid will be declared prethe awarding authority will award the contract to the tenderer with the lowest price.

If the prices are equal, the contracting authority may ask them, if the price is equal, new financial proposals through SEAP. The contracting authority shall ensure the right to requesta single referral.
