Military Unit 02384 Bucharest plans to purchase a tracked excavator, specifications and characteristics according to specifications.

Military unit 02384 Bucharest intends to acquire - 1 piece - tracked excavator, with specifications andcharacteristics according to the specification.

Requirement 1: Declaration of non-compliance with the provisions of art. 164 of Law no. 98/2016 on public procurement. The economic operator (leader, associate, third party) and subcontractor will present the DUAE form in the original documentation. The framing of the situation stipulated in art. 164 of Law no. 98/2016 on public acquisitionswhich entails the exclusion of the bidder from the procedure applied for the award of the public procurement contract.

Requirement 2: Declaration on non-compliance with the provisions of art. 165 of Law no. 98/2016 on public procurement corroborated with art. 166 par. (2) of the same normative act. The economic operator (leader, associate, third party) and subcontractor will submit the DUAE form in the documentaward, in the original. The framing of the situation stipulated in art. 165 of Law no. 98/2016 regarding the public acquisitions attracts the exclusion of the bidder from the procedure applied for awarding the public procurement contract. - Requirement 3: Statement regarding non-compliance with the provisions of art. 167 of Law no. 98/2016 on public procurement. The economic operator (leader, associate, third party support)attorney) and the subcontractor will submit the DUAE form of the awarding documentation, in its original form. The framing of the situation stipulated in art. 167 of Law no. 98/2016 on public procurement, the bidder excludes from the procedure applied for awarding the public procurement contract.

Requirement 4. Statement regarding non-compliance with the provisions of art. 58 63 of Law 98/2016 on acquisitionpublic documents - form 8. Statement according to art. 60 of Law 98/2016 will be submitted by bidders, third-party supporters and subcontractors with the DUAE.

The supporting documents proving the fulfillment of the assumed by the DUAE are to be presented at the request of the contracting authority only by the tenderer ranked first in the intermediate rankings drawn up during the evaluation of the tenders . These documents may be:

The bidder will prepare the tender in accordance with the provisions of the awarding documentation and will indicate in its contents which information in the technical proposal and / or in the financial proposal are confidential, classified or are protected by an intellectual property right.

The offer is binding, from the point of view of the contiduring the entire period of validity set by the contracting authority and assumed by the bidder. The evaluation commission has the obligation to establish the winning bid, among all admissible tenders, based on the criterion for awarding the contract. Prior to awarding the contract, the contracting authority shall ask the tenderer to rank first after applying the criteriaof the awarding body to submit, without delay, updated supporting documents demonstrating the fulfillment of all the qualification criteria, according to the information contained in the DUAE.

In case in which, following the establishment of the final ranking according to the award criteria, the evaluation commission finds that there are two or more tenders of the same value, the contracting authority will request clarification-through the SICAP, for electronic loading by economic operators and documents containing new values. In the re-fermentation process through SICAP, bidders have an obligation to improve or maintain the initial offer submitted to the SICAP. In the event that tenderers do not submit new offers in accordance with the contracting authority's requests-or the submitted offers are not more advantageous than the initial ones or at least at their level, the contracting authority will reject the respective offers as being inconsistent.

Any communication, request, information, notification and the like will be loaded into the SICAP and signed with signature extensive electronics based on a qualified certificate issued by a service providercertification accredited under the Law
