The subject of the contract is: "Development of design documentation for the execution of construction works consisting in reconstruction of gas networkswith connections in the city of Gdańsk: ul. Chełmińska / Chwaszczyno ul. Sambora SG / 00000418 ". The contract has not been divided into parts. The subject of the contract includes in particular: preparation of design documentation for the construction of a gas network, provision of services of an expert on the subject and value of the contract in each procedure for the award of a contract for the execution of construction works indicated in the documentation ofdesign, author supervision, registration of the Construction Log, update of the investor`s cost estimate, obtaining on behalf of and for the Employer, from the competent authority, the final decision on the building permit, performance of the investor`s cost estimates. A detailed description of the subject of the contract is specified in Annex 2 to the ToR constituting the model contract and Annex 1 to the contract -Description of the subject of the order.

List and brief description of conditions:

1. For awarding the contractand Contractors who can apply:

1.1. not subject to exclusion;

1.2. meet the following conditions for participating in the procedure:

1.2.1. have the competence or authority to conduct a specific professional activity, provided that it results from separate provisions, i.e. the Employer does not specify this condition.

1.2.2. are in an economic or financial situation, i.e. the Employer does not specify this conditionthe genre;

1.2.3. have technical or professional skills, i.e.

1.2.3.1. has performed within the last 3 years before the deadline for submission of bids, and if the period of business is shorter, during this period, at least 1 service consisting in the performance of, project documentation for the construction of a gas or water supply or sewage or heating network with a length of at least 744, 00 mb;

1.2.3.2. has at least 1 person authorized to design in the specialty of networks, installations and heat, ventilation, water supply and sewage systems or the corresponding valid building permits, which have been issued on the basis of previously applicable regulations, having:

a) at least 2 years of experience professional in design in the abovespecialization;

b) a current certificate of belonging to the Chamber of Civil Engineers, the Awarding Entity, by specifying the requirements for its qualifications, allows for demonstrating the availability of persons who meet the conditions for providing cross-border services within the meaning of Art. 20a of the Act of 15.12.2000 on professional self-governments of architects, construction engineers or urban planners.

2. When orderingy may, at any stage of the procedure, consider that the Contractor does not have the required capabilities if the Contractor`s involvement of technical or professional resources in other economic activities of the Contractor may have a negative impact on the performance of the contract.

3. The Contractor may, in order to confirm compliance with the conditions for participation in the procedure, in appropriate situations and in relation to a specific casespeaking, or part thereof, rely on the technical or professional capacity or financial or economic situation of other entities, regardless of the legal nature of the legal relations which it has with it.

4. The contractor, which relies on the abilities or situation of other entities, must prove to the contracting authority that in carrying out the contract will have the necessary resources of these entities, in allstating the commitment of these entities to make available to him the necessary resources for the implementation of the contract. The undertaking must specify:

4.1. scope of resources available to the Contractor;

4.2. method of using the resources of another entity by the Contractor in the performance of the public contract.

5. The Employer assesses whether the capabilities made available to the Contractor by other entitiestechnical or professional or their financial or economic situation, allow the Contractor to demonstrate compliance with the conditions for participation in the procedure and examines whether there are grounds for exclusion against that entity.

6. The contractor, which relies on the economic or financial situation of other entities, is jointly and severally liable with the entity that has undertaken to make the resources available, for damage caused byhanged by the Employer resulting from the failure to make these resources available, unless he is not at fault for failure to make the resources available.

7. With respect to conditions regarding education, professional qualifications or experience, Contractors may rely on the abilities of other entities, if these entities provide the services for which these abilities are required. Assessment of compliance with the abovementioned conditionswill be made in accordance with the formula "meets does not meet", based on the information contained in the single document and documents to be provided by the Contractor to confirm compliance with the conditions for participation in the procedure.

The Employer does not specify this condition, thus does not describe how to assess its fulfillment.

1. The procedure for the award of the contract in question is conductedPolish.

2. The contractor will be bound by the offer for 60 days. The offer validity period begins with the submission deadline.

3. The offer with attachments and a uniform document, otherwise being null and void, should be made in electronic form and provided with a qualified electronic signature, in accordance with the requirements set out in the ToR.

4. Offer with attachments and jThe uniform document must be signed by the person (s) authorized to represent the Contractor using a qualified electronic signature. Unless it results from other documents attached by the Contractor, the authorization (power of attorney) to sign the offer should be attached to the offer and made in electronic form and bearing a qualified electronic signature.

5. arrPurchaser requires submitting the price form before the bid form. The price form will not constitute an offer and is ancillary, it does not include calculations of all unit prices that make up the price contained in the offer form. The price form will constitute an annex to the contract and the prices indicated therein will be binding for the Contractor during the performance of the contract.

6. If Performca plans to entrust part of the contract to subcontractors, it should also indicate in the bid form which part of the contract it intends to entrust to subcontractors and provide the companies to Subcontractors.
