Development of design documentation for the execution of construction works called "Modernization of high pressure gas station in Gniew with relocation of the shut-off and relief system Z-455", SG / 00073273

1. The subject of the order is: development of design documentation for the execution of construction works entitled "Modernization of high pressure gas stationia in the city of Gniew with the transfer of the shut-off and relief system Z-455 ", SG / 00073273.

Main Site: Gniew, ul. Krasickiego, plot 4/1, POLAND.

High pressure gas pressure reducing and measuring station with capacity up to 5 000 mn / h.

1. Contractors may apply for the contract if they:or the right to conduct a specific professional activity, provided that it results from separate provisions, i.e. the awarding entity does not specify this condition;

b) they are in an economic or financial situation, i.e. the awarding entity does not specify this condition;

c) they have technical or professional capacity, i.e. .:

2. completed within the last 3 years before the submission deadline, and if the period of keepingand consistency is shorter, in this period, at least 1 service consisting in the execution of project documentation for the construction of a high-pressure gas station or an elevated average pressure gas station or an LNG regasification station;

3. has at least 1 person authorized to design specializing in networks, installations and heating, ventilation, water and sewage systemsor their corresponding valid building licenses, which have been issued on the basis of previously binding regulations, having:

a) at least 2 years of professional experience in designing in the above specialty;

b) a current certificate of belonging to the Chamber of Civil Engineers, the contracting authority specifying the requirements in within the scope of his powers, he allows, demonstration of dispositioniem persons meeting the conditions for providing cross-border services within the meaning of art. 20a of the Act of 15.12.2000 on professional self-governments of architects, civil engineers;

5. the contractor may rely on technical or professional capacity to confirm compliance with the conditions for participation in the procedure, where appropriate and in relation to a specific contract, or part thereof.or the financial or economic situation of other entities, regardless of the legal nature of the legal relations which it has with him;

6. the contractor, which relies on the abilities or situation of other entities, must prove to the contracting authority that in carrying out the contract he will have the necessary resources of these entities, in particular presenting the undertaking of these entities to make available to himnecessary resources for the implementation of the contract. The undertaking must specify:

6.1. scope of the resource available to the contractor;

6.2. the method of using the resources of another entity by the contractor when performing the public contract;

7. the contracting authority assesses whether the technical or professional capacities made available to the contractor by their entities, or their financial or economic situation, allowand demonstration by the contractor that the conditions for participation in the procedure have been met and examines whether there are grounds for exclusion for that entity;

8. the contractor, which relies on the economic or financial situation of other entities, is jointly and severally liable with the entity that has undertaken to make the resources available, for damage suffered by the contracting authority resulting from the failure to make these resources available, and that he is not at fault for failure to make resources available;

9. in relation to conditions relating to education, professional qualifications or experience, contractors may rely on the capacities of other entities, if those entities provide the services for which those capacities are required;

10. assessment of compliance with the abovementioned conditions will be made in accordance with the formula "meets not meets", based on andinformation contained in the uniform document and documents.

The Employer does not specify this condition, thus does not describe how to assess its fulfillment.

1. The procedure for the award of the contract in question is conducted in Polish.

2. The contractor will be bound by the offer for 60 days. The offer validity period begins with the submission deadline.

3. Offer with attachmentconnectors and a uniform document, otherwise being null and void, should be made in electronic form and bear a qualified electronic signature, in accordance with the requirements set out in the ToR.

4. The offer with attachments and a single document must be signed by the person (s) authorized to represent the contractor using a qualified electronic signature. Unless it follows to from other documents attached by the contractor, the authorization (power of attorney) to sign the offer should be attached to the offer and prepared in electronic form and bearing a qualified electronic signature.

5. In addition to the offer form, the contracting authority requires a price form to be submitted. The price form will not constitute an offer and is of an auxiliary nature, it does not include calculations for allunit prices, which make up the price contained in the offer form. The price form will constitute an annex to the contract and the prices in it will be binding on the contractor during the performance of the contract.

6. If the contractor plans to entrust part of the contract to subcontractors, he should also indicate in the bid form which part of the contract he intends to entrust to subcontractors and provide companies withodwykonawcow.

7. In accordance with art. 13 section 1 and item 2 of the General Regulation (EU) 2016/679 of the European Parliament and of the Council of 27.4.2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46 / EC (OJ EU L, from 2016 No. 119, page 1), hereinafter the GDPR inform that personal data will be processed in accordance withgenerally applicable and legal provisions. A detailed description regarding the protection of personal data is provided in the model contract.

8. Before awarding the contract, the contracting authority will call the contractor whose offer has been rated the highest to submit it within a designated period, not shorter than 10 days, valid on the day of submitting the statements or documents confirming the circumstances referred to in art. 25 paragraph1 of the Act, referred to in point 8.19 of the ToR.

9. The contractor shall provide the contracting authority with documents or declarations submitted on call, using electronic means of communication, to the e-mail address indicated in point 9.1. SIWZ.

The documents or statements are submitted in the original in the form of an electronic document bearing by their issuer a qualified electronic signature or in felectronic copy certified by the contractor. If the contractor provides an electronic copy of a document or statement, signing it by the contractor with a qualified electronic signature is tantamount to certifying by the contractor an electronic copy of the document or declaration of compliance with the original. When forwarded bythe contractor of an electronic document or statement in a format that submits compression data, providing a file containing compressed data with a qualified electronic signature is equivalent to the contractor`s confirmation of compliance with the original of all electronic copies of documents or statements contained in this file, with the exception of copies certified as appropriate by anotherthe contractor applying jointly with him for the award of the contract, by the entity on whose abilities or situation the contractor relies, or by the subcontractor.
