III. SpecThe project will be elaborated in accordance with the GD no. 907/2016, on the stages of development and the framework content of the technical and economic documentation related to the investment objective (s) financed by-public funds.

Timisoara shall exclude at any time the procedure for the award of the service contract, any economic operator who is in one of the situations provided in art. 60, 164, 165 and 167 of Public Procurement Law 98/2016.

Exclusion reasons will also be applied to associates / subcontractors / third-party supporters, as appropriate.subject to the rejection of the offer as unacceptable, each economic operator participating in the awarding procedure (tenderer, associated tenderer, subcontractor, third party, as the case may be) will present with the offer and the DUAE completed in accordance with the provisions of art. 193 of Law 98/2016, with information related to their situation.

Will be presented:

(a) Declaration of non-compliancepotentially generating conflicts of interest, as defined in Art. 60 of Law no. 98/2016, by all participants in the procedure, (b) and, where appropriate, the firm's firm commitment of the supporting party accompanied by documents demonstrating the actual manner in which its support will materialize, the subcontracting agreement and / or the association . The supporting documents asto prove the fulfillment of the obligations assumed by completing the DUAE shall be submitted, only at the request of the contracting authority, by the tenderer first placed after the application of the award criterion on the admissible tenders.

The supporting documents may be:

1) to pay taxes, taxes or contributions to the gene budget(2) the criminal record of the economic operator and of the members of the administrative, management or supervisory body of the respective economic operator or of those having the power of representation, decision or control within it, as it results from the certifying certificate issued by the ONRC / constitutive act; 3)as the case may be, documents demonstrating that the economic operator may benefit from the derogations provided for in art. 166 par. (2), art. 167 par. (2), art. 171 of Public Procurement Law 98/2016

1) Within the documents attached to the SEAP publication, DUAE is available to economic operators interested in the format editable in order to complete it by the bidders. The participating economic operators will fill in the relevant information / responses-(ie where they are clearly stated) and will not have the right to intervene on the format of the DUAE, respectively on the requirements imposed by the contracting authority;) 3) The economic operators have the right to submit the offer (the DUAE completed, the declaration regarding non-compliance with the provisions of Article 60 of the Law No. 98/2016, the technical proposal, the financial proposal, the document proving the constitution of the part-guarantee(4) Requests for clarification regarding this tender documentation shall be addressed in the following terms: (a) the terms of reference for the award of the contract; exclusively in SEAP within the award procedure conducted by electronic means, the authority conthe tractant will not respond to the requests addressed by means of communication other than the established one. Any interested economic operator has the right to request clarifications or additional information regarding the awarding documentation, in compliance with the deadline specified by the contracting authority in section II.1.4 of this document, not later than 15 daysis before the deadline set for the submission of tenders. Clarifications submitted after this deadline will no longer be taken into account. According to art. 160 161 of Law 98/2016, the contracting authority will respond in a clear and complete manner to all clarification requests / additional information on the 11th day before the deadline set for the submission of tenders, insofar as thisthey will be addressed within the deadline stipulated in the tender notice. The answers to the requested clarifications will be published in the SEAP in the tender notice; 5) If the contracting authority requests the submission of certain clarifications / completions in order to check the conformity of the offer with the required requirements, both the request and the bidder's response shall be sent to the SEAP only in electronic format, signed with extended electronic signature. If the bidder's response is posted in SEAP without the extended electronic signature, its offer will be assimilated to the provisions of Art. 137 par. (2) lit. j) from GD 395/2016, being rejected as unacceptable; 6) If, following the application of the award criterion, the "lowest price" is found to be two or moreyou ranked the first place with equal prices, you will be asked to re-pay via SEAP. If this is not feasible for reasons attributable to the SEAP operator, a new offline financial proposal will be requested from bidders.
