Development of project-estimate documentation for the construction of a water supply network in ul. Kkujecińska in the Wawer District of the Capital City of Warsaw (a detailed description is included in Part III of the ToRZ).

1. Contractors who can apply for the contract:

1.1. meet the conditions for participating in the proceedings regarding the possession of competences or powers to conduct specific activities withemergency service, provided that this obligation results from separate provisions. Not applicable.

1.2. are not subject to exclusion pursuant to art. 24 paragraph 1 point 12 23 of the Public Procurement Law Act, hereinafter referred to as the "Act" or "Public Procurement Law" (from the provision of Article 133 (4) of the Public Procurement Law) and pursuant to Art. 24 paragraph 5 points 1, 4 8 Pzp

2. Assessment of compliance with the conditions for participation in the procedure (according to the formula "meets - does not meet") and the lack of grounds for exclusionthe contract will be made on the basis of:

a) the Contractor`s initial statement contained in the Single European Order Document "EAT" - in relation to all Contractors who have submitted bids, and;

b) documents and statements confirming the fulfillment of the conditions for participation in the proceedings and the lack of exclusion grounds for the Contractor whose highest bid is

3. OrderThe requesting party submits:

3.1 a) at the stage of submitting offers from all Contractors:

a) the offer in accordance with the content of the offer form, constituting Annex No. 1 to IDW, Part I of the ToR;

b) single European order document (EAT);

c ) power of attorney / power of attorney according to the rules described in IDW;

3.1 b) The Awarding Entity, before awarding the contract, will call the Contractor, whose offer will be assessed as the mostmore compact, to be submitted within a specified period, not shorter than 10 days, valid on the day of submitting the statements or documents confirming the circumstances referred to in art. 25 paragraph 1 Public Procurement Law, i.e. documents referred to in items 6.1b) and 6.1d) IDW;

3.1 c) each Contractor, in accordance with art. 24 paragraph 11 Public Procurement Law, is obliged to submit within 3 days of posting on the website They are orderingall information referred to in art. 86 section 5 Public Procurement Law, i.e. the document referred to in item 6.1.c) IDW;

3.1 d) the Contractor having its registered office in the territory of the Republic of Poland, in relation to persons residing outside the territory of the Republic of Poland to whom the document referred to in point 6.1b applies point a) IDW, submits relevant documents in accordance with the guidelines contained in IDW.

4. To confirm compliance with the condition, aboutreferred to in point 1 point 1.1 The Contractor whose tender will be assessed as the most advantageous will submit: Not applicable.

5. The Awarding Entity will assess (if applicable) whether technical or professional capacities made available to the Contractor or their financial or economic situation allow the Contractor to demonstrate compliance with the conditions for participation in the procedure and will examine whether there are anythis entity`s grounds for exclusion referred to in art. 24 paragraph 1 point 13 22 of the Act (subject to Article 133 (4) of the Act) and Article 24 paragraph 5 points 1, 4 8 of the Act. The Awarding Entity will request the submission of relevant documents referred to in item 6.1.b) of IDW for these entities.

1. If, for a justified reason, the Contractor cannot submit the documents required by the Employer in point III.1.3 point 2 of the announcement, the Employer allows the Contractor to submit other relevant documents to confirm compliance with the conditions for participation in the procedure specified in point III 1.3 point 1.1 of the announcement.

2. It applies accordingly to point III.1.3): The Contractor may confirm the fulfillment of the conditions for participation in the procedure, in appropriate situations and in relation to the contract in question, or part thereof, rely on the technical or professional capacity or financial or economic situation of other entities, regardless of the legal nature of the legal relations that connect it with it, on the principles set out in the IDW (point 6.5 of the IDW, subject to the obligation to submit documents indicated therein).

3. If the Contractor has its registered office or place of residence outside the territory of the Republic of Poland, he shall submit a replyappropriate document or documents, in accordance with the principles set out in point 6.6. IDW.

4. Offer validity period: 60 days.

5. The awarding entity does not envisage the award of the contract referred to in art. 134 section 6 item 3 of the Act.

6. The offer should be made in Polish. Documents in a foreign language should be submitted together with a translation into Polish.

7. The offer together with the required documents should be prepared andsubmit in accordance with the principles set out in the notice, IDW and applicable law, including the Regulation of the Minister of Development of 26.7.2016 on the type of documents that the Awarding Entity may request from the Contractor in the procurement procedure and Public Procurement Law

8. These proceedings are conducted under an open tender pursuant to art. 134 section 1 of the Public Procurement Law

9.The contract in question is part of a larger contract in parts. Each part is the subject of a separate procedure under the contract awarded in parts (Article 32 (4) of the Act). The estimated value of the part does not exceed the amount specified in the provisions issued under Art. 11 paragraph 8 of the Act. The estimated value of the entire order exceeds the amount specified in the regulationsissued on the basis of art. 11 paragraph 8 of the Act.
