Development of design and cost documentation for the construction of the DN 100/150 water supply and sewage network 0 0.30 / 0, 20 / 0.16 m in the Rembert-w and Targowek districts of the Capital City of Warsaw (for a detailed description, see Part III of the Terms of Reference).

1. You can apply for the orderonenders, who:

1.1. meet the conditions for participation in the proceedings regarding the possession of competences or authorizations to conduct specific professional activities, provided that this obligation results from separate provisions. Not applicable,

1.2. are not subject to exclusion pursuant to art. 24 paragraph 1 item 12 23 of the Public Procurement Law, hereinafter referred to as the "Act" or "Public Procurement Law" (from the provision of Article 133 (4) of the Public Procurement Law) and on the basis ofe art. 24 paragraph 5 points 1, 4 8 Pzp

2. Assessment of compliance with the conditions for participation in the procedure (according to the formula "meets / does not meet") and the absence of grounds for exclusion will be made on the basis of:

a) the Contractor`s initial statement contained in the Single European Order Document "EAT" in relation to all Contractors who submitted offers, and

b) documents and statements confirming spconditions for participation in the procedure and no grounds for exclusion regarding the Contractor whose highest bid will be given.

3. The Awarding Entity requests the submission of:

3.1a) at the stage of submitting bids from all Contractors:

a) the offer in accordance with the content of the offer form, constituting Annex 1 to IDW, part I of the ToR,

b) single European order document (EAT),

c ) power of attorney / powers of attorneyand on the terms described in IDW;

3.1b) The Awarding Entity, before awarding the contract, will call the Contractor, whose tender will be assessed as the most advantageous, to submit within a designated, not shorter than 10 days, deadline valid on the day of submitting statements or documents confirming the circumstances, about which referred to in art. 25 paragraph 1 Public Procurement Law, i.e. documents referred to in items 6.1b and 6.1d IDW;

3.1c) KaContractor, in accordance with art. 24 paragraph 11 Public Procurement Law, is obliged to submit within 3 days from the date of posting on the Employer`s website information referred to in art. 86 section 5 Public Procurement Law, i.e. the document referred to in item 6.1.c IDW;

3.1d) the Contractor having its registered office in the territory of the Republic of Poland, in relation to persons who reside outside the territory of the Republic of Poland to whom the document referred to in pointt 6.1b (a) IDW, submits relevant documents in accordance with the guidelines contained in IDW.

4. In order to confirm that the condition referred to in point 1 point 1.1 has been met, the Contractor whose tender will be assessed as the most advantageous will present: Not applicable.

5. The Awarding Entity will assess (if applicable) whether technical or professional capabilities or their financial situation made available to the Contractoror economic, allow the Contractor to demonstrate compliance with the conditions for participation in the procedure and will examine whether there are grounds for exclusion against this entity, as referred to in art. 24 paragraph 1 point 13 22 of the Act (subject to Article 133 (4) of the Act) and Article 24 paragraph 5 points 1, 4 8 of the Act. The contracting authority will request the submission of relevant documents referred to in these entitiesand in item 6.1.b IDW.

1. If, for a justified reason, the Contractor cannot submit the documents required by the Employer in point III.1.3 item 2 of the announcement, the Employer allows the submission by the Contractor of other relevant documents to confirm compliance with the conditions for participation in the procedure specified in point III 1.3 point 1.1 of the announcement.

2. Refers to point III.1.3, as appropriate: The contractor may have a purposeu confirming compliance with the conditions for participation in the procedure, where appropriate and in relation to the contract in question, or part thereof, rely on the technical or professional capacity or financial or economic situation of other entities, regardless of the legal nature of the legal relations that connect it with it, on the principles set out in IDW (point 6.5 IDW, subject toand submission of documents indicated therein.)

3. If the Contractor has its registered office or place of residence outside the territory of the Republic of Poland, he shall submit a relevant document or documents in accordance with the principles set out in point 6.6 of IDW.

4. Offer validity period: 60 days.

5. The awarding entity does not envisage the award of the contract referred to in art. 134 section 6 item 3 of the Act.

6. The offer should be made in Polish. DocumentsEntries in a foreign language should be submitted together with a translation into Polish.

7. The offer along with the required documents should be prepared and submitted in accordance with the principles set out in the notice, IDW and applicable law, including the Regulation of the Minister of Development of 26.7.2016 on the type of documents that the Employer may request from the Contractor in proceedings regarding awarding the orderonce Pzp.

8. These proceedings are conducted under an open tender pursuant to art. 134 section 1 of the Public Procurement Law

9. The contract in question is part of a larger contract in parts. Each part is the subject of a separate procedure under the contract awarded in parts (Article 32 (4) of the Act). The estimated value of the part does not exceed the amount specified inwritings issued on the basis of art. 11 paragraph 8 of the Act. The estimated value of the entire contract exceeds the amount specified in the provisions issued under Art. 11 paragraph 8 of the Act.
