Development of project-estimate documentation for the construction of a water supply and sewage network together with the construction of a sewage pumping station at ul. Leśny Potok in Warsaw Białołęka divided into tasks (for a detailed description, see Part III of the Terms of Reference).

1. For awarding the contractContractors may apply, who:

1.1 meet the conditions for participation in the proceedings regarding the possession of competences or rights to conduct specific professional activities, provided that this obligation results from separate provisions. Not applicable;

1.2 are not subject to exclusion under Article 24 paragraph 1 point 12 23 of the Public Procurement Law Act, hereinafter referred to as the "Act" or "Public Procurement Law" (from the provision of Art. 133 para. 4Pzp) and pursuant to art. 24 paragraph 5 points 1, 4 8 Pzp

2. Assessment of compliance with the conditions for participation in the procedure (according to the formula "meets does not meet") and the absence of grounds for exclusion will be made, based on:

a) the Contractor`s initial statement contained in the Single European Order Document "EAT" in relation to all Contractors who have submitted offers, and

b) documents and statementsthat confirming the fulfillment of the conditions for participation in the procedure and the lack of grounds for exclusion regarding the Contractor whose tender is the highest rated.

3. The Awarding Entity requests the submission of:

3.1 a) At the stage of submitting bids from all Contractors:

a) the offer in accordance with the content of the Bid Form, constituting Annex 1 to IDW, part I of the ToR;

b) single European order document (EAT);

c ) Fullpower of attorney / power of attorney according to the rules described in IdW

3.1 b) The Awarding Entity, before awarding the contract, will call the Contractor, whose tender will be assessed as the most advantageous, to submit within a designated, not shorter than 10 days, deadline valid on the day of submitting statements or documents confirming the circumstances, about referred to in art. 25 paragraph 1 Public Procurement Law, i.e. documents referred to in item 6.1 b and 6.1 d IDW;

3.1 c) Each Contractor, in accordance with art. 24 paragraph 11 Public Procurement Law, is obliged to submit within 3 days from the date of posting on the Employer`s website information referred to in art. 86 section 5 Public Procurement Law, i.e. the document referred to in item 6.1.c IDW;

3.1 d) the Contractor having its registered office in the territory of the Republic of Poland, in relation to persons who reside outside the territory of the Republic of Poland, whoThe document specified in item 6.1.b (a) IDW wishes, submits relevant documents in accordance with the guidelines contained in IDW.

4. In order to confirm that the condition referred to in point 1 point 1.1 has been met, the Contractor whose tender will be assessed as the most advantageous will present: Not applicable.

5. The Employer will assess (if applicable) whether technical or professional capabilities made available to the Contractore or their financial or economic situation, allow the Contractor to demonstrate compliance with the conditions for participation in the procedure and will examine whether there are grounds for exclusion for this entity, as referred to in art. 24 paragraph 1 point 13 of the Act (subject to Article 133 (4) of the Act) and art. 24 paragraph 5 points 1, 4 8 of the Act. The contracting authority will request the submission of relevant entities in relation totheir documents referred to in item 6.1.b of IDW.

1. If, for a justified reason, the Contractor cannot submit the documents required by the Employer in point III.1.3 item 2 of the announcement, the Employer allows the submission by the Contractor of other relevant documents to confirm compliance with the conditions for participation in the procedure specified in point III 1.3 point 1.1 of the announcement.

2. Applies to pointIII.1.3: The Contractor may rely on the technical or professional ability or financial or economic standing of other entities to confirm compliance with the conditions for participation in the procedure, where appropriate and in relation to the contract in question, or in part, irrespective of the legal nature of it legal relations under the terms specified in IDW (item 6.5 IDW, subject to the obligation to submit the documents specified therein.

3. If the Contractor has its registered office or place of residence outside the territory of the Republic of Poland, he shall submit a relevant document or documents in accordance with the principles set out in point 6.6. IDW.

4. Offer validity period: 60 days.

5. The awarding entity does not envisage the award of the contract referred to in art. 134 section 6 item 3 of the Act.

6. The offer should be maderuled in Polish. Documents in a foreign language should be submitted together with a translation into Polish.

7. The offer together with the required documents should be prepared and submitted in accordance with the principles set out in the notice, IDW and applicable law, including the Regulation of the Minister of Development of 26.7.2016 on the type of documents that the Employer may request from the Contractor in progressfor the award of the contract and Public Procurement Law

8. These proceedings are conducted under an open tender pursuant to art. 134 section 1 of the Public Procurement Law

9. The contract in question is part of a larger contract in parts. Each part is the subject of a separate procedure under the contract awarded in parts (Article 32 (4) of the Act). The estimated value of the part is notexceeds the amount specified in the regulations issued on the basis of art. 11 paragraph 8 of the Act. The estimated value of the entire contract exceeds the amount specified in the provisions issued under Art. 11 paragraph 8 of the Act.
