The subject of the contract is: "Development of design documentation for the construction of gas pipelines and connections in the city of Gdynia (3 parts)". The subject of the contract includes in particular: preparation of project documentation for the construction of a gas network, provision of expert servicessubject and value of the contract in each award procedure for the execution of construction works indicated in the project documentation, exercising author`s supervision, registration of the Construction Log, one-time update of the investor cost estimate, obtaining on behalf of and for the benefit of the Employer, from the competent authority, the final permit decision for construction, cost estimatesinvestor. A detailed description of the subject of the contract is specified in the model contract constituting Annex 2 to the ToR and in the description of the subject of the contract constituting Annex 1 to the contract

1. Contractors who can apply for the contract:

1.1. are not subject to exclusion,

1.2. meet the following conditions for participating in the procedure:

1.2.1. have the competence or authority to conduct a specific professional activity, provided that it results from separate provisions, i.e. the Employer does not specify this condition,

1.2.2. are in an economic and financial situationj ensuring the performance of the contract, but this condition will be met if the Contractor has an insurance policy documenting that the Contractor is insured against civil liability in the scope of conducted activities related to the subject of the contract for an insurance sum of a minimum of PLN 200, 000 gross,

1.2.3. have technical or professional skills, i.e.

1.2.3.1. made in stthe last three years before the deadline for submission of tenders, and if the period of business is shorter, during this period, at least 3 services consisting in the performance of, project documentation for gas or water or sewage or heating networks with a length of the designed network of at least: - part 1 39.00 mb,

- part 2 22.50 mb,

- part 3 42.00 mb,

1.2.3.2. dispays at least one person authorized to design in the specialty of networks, installations and heating, ventilation, water supply and sewage systems or the corresponding valid building permits, which have been issued on the basis of previously binding regulations, having:

a) at least 3 years of experience professional in design in the above specialtyb) current certificate of belonging to the Chamber of Civil Engineers,

They are in an economic and financial situation ensuring the performance of the contract, this condition will be met if the Contractor has an insurance policy documenting that the Contractor is insured against civil liability activities related to the subject of the contractand a minimum insurance sum of PLN 200, 000 gross

1. The procedure for the award of the contract in question is conducted in Polish.

2. The contractor will be bound by the offer for 60 days. The offer validity period begins with the submission deadline.

3. The offer, together with attachments, and a single document, otherwise being null and void, should be made in electronic formand bearing a qualified electronic signature, in accordance with the requirements specified in the ToR.

4. The offer with attachments and a single document must be signed by the person (s) authorized to represent the Contractor using a qualified electronic signature. Unless it results from other documents attached by the Contractor, authorization (power of attorney) to sign the offer

winno be attached to the offer and prepared in electronic form and bearing a qualified electronic signature.

5. In addition to the offer form, the Ordering Party requires submission of the Price Form. The price form will not constitute an offer and is ancillary, it does not include calculations of all unit prices that make up the price contained in the Offer Form. The pricing form will bewas an annex to the contract and the prices indicated therein will be binding for the Contractor during the performance of the contract.

6. If the Contractor plans to entrust part of the contract to Subcontractors, he should also indicate in the Bid Form which part of the contract he intends to entrust to subcontractors and provide the companies to Subcontractors.

7. In accordance with art. 13 section 1 and paragraph 2 of the General Regulation of the European Parliament and the Council(EU) 2016/679 of 27.4.2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46 / EC (Journal of Laws of the European Union, 2016 No. 119), hereinafter the GDPR inform that personal data will be processed in accordance with generally applicable law. A detailed description in the field of personal data protection is provided in the Model Contracty.

8. The Awarding Entity, before awarding the order, will call the Contractor whose bid has been best rated to be submitted within a designated period, not shorter than 10 days, valid on the day of submitting the statements or documents confirming the circumstances referred to in art. 25 paragraph 1 of the Act, referred to in point 8.19 of the ToR.

9. Documents or statements submitted on call, the Contractor shall forward Zamawith the use of electronic communication means to the e-mail address provided in point 9.1. SIWZ.

The documents or statements are submitted in the original in the form of an electronic document bearing by their issuer a qualified electronic signature or in the form of an electronic copy certified as true by the Contractor. In the case of transfer bythe contractor of an electronic copy of the document or statement, signing it by the Contractor with a qualified electronic signature is tantamount to certifying by the Contractor an electronic copy of the document or statement for compliance with the original. If the Contractor submits an electronic document or statement in a format that submits the data for compression, include the filecompressed data by a qualified electronic signature is tantamount to certification by the Contractor for compliance with the original of all electronic copies of documents or statements contained in this file, with the exception of copies certified respectively by another Contractor applying jointly with him to award the contract, by an entity whose capacity or situation pContractor is alleged, or by a Subcontractor.
