1. The subject of the contract is the implementation of services related to the implementation of project documentation for the construction of a Ś / c gas network together with connectionsami in Krzczonowice sectoral order.

1. The subject of the contract is the implementation of services related to the preparation of project documentation for the construction of a ś / c gas network together with connections in the city of Krzczonowice, sector order.

2. The subject of the order includes in particular:

1) performanceDesigning the detailed construction design and bill of quantities:

a) PE dn90 gas pipeline with a total length of approx. 2985 m,

b) PE dn63 gas pipeline with a total length of approx. 522 m

c) PE dn40 gas pipeline with a total length of approx. 986 m,

d) PE gas connections dn 25 with a total length of approx. 106 m (13 pcs), hereinafter referred to as the Project,

2) obtaining all required opinions, permits and decisions, including yieldin the name and on behalf of the Employer, from the competent authority, the final decision on the building permit or notification on behalf of and for the Employer the intention to start construction works or construction not requiring a building permit

3) execution of investor cost estimates,

4) supervision copyright.

3. Detailed Description of the Subject of the Contract, obligations of the Contractorand other terms and conditions for the implementation of the contract constituting a description of the Description of the Object of the Order can be found in Annex 1 to the Contract Template (DETAILED DESCRIPTION OF THE SUBJECT OF THE ORDER) Annex 7 to this Specification of the Essential Terms of the Contract (hereinafter: SIWZ) which is also an integral part thereof.

I. Contractors who can apply for the contract:

1. not underare subject to exclusion,

2. meet the following conditions for participating in the procedure:

2.1. have technical and professional capacity - specified in section III.1.3) announcements

2.2. are in an appropriate economic and financial situation - as specified in section III.1.2) of the advertisement

Assessment of compliance with the abovementioned conditions will be made in accordance with the formula "meets not meets", based on the information contained in JEDZ, statements and documents to be provided by the Contractor to confirm that the conditions for participation in the procedure have been met. 24 paragraph 1 point 12) - 23) of the PPL and in art. 24 paragraph 5 point 1) and 8) Public Procurement Law, subject to art. 133 section 4 Public Procurement Law and art. 24 paragraph 7-12 Pzp.

II. List of declarations and dockment to be provided by the Contractors in order to confirm the fulfillment of the conditions for participation in the procedure and the lack of grounds for exclusion.

1. Documents and statements submitted with the offer by all Contractors:

1.1. Bid form, prepared in accordance with the content of Annex 1 to the ToR.

If the bid is submitted by several Contractors jointly applying for the contract (consortiumcjum), indicate all entities included in the consortium, indicating the Proxy (leader) of the consortium.

1.2. Proof of payment of the bid security, in accordance with point 10. SIWZ.

1.3. Power of attorney pursuant to point 12.6 12.7 of the ToR (if applicable).

1.4. Third party obligation to make resources available according to Annex 6 to the ToR (if applicable).

1.5. Valid on the day of submitting offers/ statements in the scope indicated in the ToR in the formula of the Single European Procurement Document (EAT).

1.6. The offer with attachments, including declarations submitted in the form of a single document and the declaration indicated in item 8.2. ToR and documents referred to in points 8.3., 8.13. and 10 of the Terms of Reference, the Contractor submits in compliance with the requirements specified in points 8.4. 8.11 of the SETC. remainede, the Contractor shall submit documents at the request of the Employer.

2. Declaration of belonging or not belonging to the same capital group, made obligatorily by all Contractors within 3 days from the date of placing by the Employer on the website the information referred to in art. 86 section 5 of the Act, i.e. information from the opening of offers.

3. Contractor who refers toresources of other entities, in order to demonstrate the absence of grounds for exclusion and compliance with them, to the extent that reference is made to their resources, conditions for participation in the proceedings, also submits uniform documents regarding these entities, prepared in electronic form and bearing a qualified electronic signature by entity to which the documents relate, subject to the requirements of approxreferred to in points 8.4 8.11 of the SETC.

4. The single document shall be prepared in accordance with the template of the standard form set out in the European Commission implementing regulation issued on the basis of art. 59 clause 2 of Directive 2014/24 / EU and art. 80 deg. 3 of Directive 2014/25 / EU. A template of the standard uniform document form is available on the Awarding Entity`s website athttps://zamycji.psgaz.pl in the present proceedings.

5. The offer and attachments including the Single Document should be prepared and submitted under pain of nullity in an electronic form with a qualified electronic signature, via the PSG Purchasing Platform.

1. Contractors who are in an appropriate economic and financial situation may apply for the contract - the Employer does not describe how to assess compliance with this condition.

2. In order to pre-confirm compliance with the conditions for participation in the proceedings specified inpoint 6.1.2. ToR, the Contractor submits the relevant statement in part IV, section α of the Single European Procurement Document (EAT form). The Employer indicates that the Contractor may limit himself to completing only section α in Part IV of the Single European Procurement Document, then he need not complete any of the other sections (A, B, C, D) in Part IV EAT, because the Employerzwomie that the Contractor has confirmed that he has met all the required conditions for participation in the procedure (qualification criterion) specified in Chapter VI of the ToR.

3. The Employer may, at any stage of the procedure, consider that the Contractor does not have the required capabilities, if the involvement of the contractor`s technical or professional resources in other economic activities of the Contractor may have a negative impactto complete the order.

4. The Contractor may rely on the technical or professional ability or financial or economic standing of other entities to confirm compliance with the conditions for participation in the procedure, where appropriate and in relation to a specific contract, or part thereof, irrespective of the legal nature of the legal relations with it.

5. The contractor whorelies on the abilities or situation of other entities, must prove to the Employer that in carrying out the contract will have the necessary resources of these entities, in particular presenting the commitment of these entities to provide him with the necessary resources at the disposal of the contract, prepared in accordance with the template constituting Annex 6 to the ToR.

6. The awarding entity assesses or makes availableContractor`s technical or professional capacity or other financial or economic situation by other entities, allows the contractor to demonstrate compliance with the conditions for participation in the procedure and examines whether there are grounds for exclusion for this entity, as referred to in point 7 of the ToR.

7. The contractor, which relies on the economic or financial situation of other entities, is liableie with the entity that has undertaken to make the resources available for the damage suffered by the contracting authority as a result of the failure to make these resources available, unless he is not responsible for the failure to make the resources available.

8. In relation to conditions regarding education, professional qualifications or experience, contractors may rely on the capacities of other entities, if these entities carry out work, toimplementations for which these abilities are required

I. The Awarding Entity, before awarding the order, will call the Contractor whose tender has been rated the highest to submit it within a designated period, not shorter than 10 days, valid on the day of submitting the following statements or documents confirming the circumstances referred to in art. 25 paragraph 1 of the Act:

1. Information from the National Criminal Record inscope specified in art. 24 paragraph 1 item 13, 14 and 21 of the Act, issued not earlier than 6 months before the submission deadline.

Subject to the content of art. 133 section 4 of the Act, the Contractor is not subject to exclusion in the case referred to in art. 24 paragraph 1 point 13 lit. d, and in the case referred to in art. 24 paragraph 1 point 14, if the person referred to in this provision has been convicted ofoffense mentioned in art. 24 paragraph 1 point 13 lit. d.
