Development of project and estimate documentation for the construction of a sewer in the access road to the premises located at ul. 20 and furrow22 in Warsaw District Wilan-w (detailed description is given in Part III of the Terms of Reference).

Preparation of project and estimate documentation for the construction of a sewer on the access road to the premises located at ul. Bruzdowa 20 and 22 in Warsaw. District Wilan-w (detailed description is included in Part III of the Terms of Reference).

1. Contractors, who:

1.1 meet the condition, can apply for the award of the orderand participation in proceedings regarding the possession of competences or entitlements to conduct a specific professional activity, if this obligation results from separate regulations. Not applicable.

1.2 are not subject to exclusion pursuant to art. 24 sec. 1 point 12-23 of the Act on Public Procurement Law (Journal of Laws of 2018, item 1986, as amended), hereinafter referred to as the "Act" or "PPL" (from the provision of Article 133 paragraph 4 of the PPL) and on the basis ofArt. 24 sec. 5 points 1, 4-8 Pzp.

2. The assessment of compliance with the conditions for participation in the procedure (according to the formula "meets - does not meet") and no grounds for exclusion will be made on the basis of: a) the initial statement of the Contractor contained in the single European document "EAT" - for all Contractors who submitted offers, and

b) documents and declarations confirming speechesthe terms of participation in the procedure and the lack of grounds for exclusion regarding the Contractor whose offer will be the highest.

3. The Ordering Party requests: 3.1a) At the stage of submitting bids from all Contractors:

a) Uniform / European ones / their document / in the order - in accordance with item 6.1 a) IDW, constituting Part I of the ToR;

b) Documents about which referred to in point 6.5 IDW

c) Other declarationsand documents, which are indicated in the SIWZ, that they should be attached to the offer.

3.1 b) The contracting party, before awarding the contract, will call the Contractor whose tender will be evaluated as the most advantageous, to submit in the shortened date, not shorter than 10 days. on the day of submitting statements or documents confirming the circumstances referred to in art. 25 para. 1 Pzp, ie documentow, referred to in items 6.1b) and 6.1d) IDW.

3.1 c) Each Contractor, in accordance with art. 24 sec. 11 PPL, is obliged to submit within 3 days from the date of posting on the website of the Employer information referred to in art. 86 par. 5 of the PPL, ie the document referred to in item 6.1.c) IDW.

3.1 d) Contractor established in the territory of the Republic of Poland, in relation to persons who residethe territory of the Republic of Poland, to which the document specified in item 6.1b) sub-item a) of the IDW applies, submits relevant documents in accordance with the guidelines contained in IDW.

4. In order to confirm the fulfillment of the condition referred to in point 1 item 1.1, the Contractor whose tender will be evaluated as the most advantageous will present: Not applicable.

5. The Contracting Authority will assess (if applicable) whether it is made available to the Contractor by other entities fromtechnical or professional abilities or their financial or economic situation, allow the Contractor to demonstrate compliance with the conditions for participation in the proceedings and examine whether there are any grounds for exclusion referred to in art. 24 sec. 1 point 13 22 of the Act (subject to Article 133 paragraph 4 of the Act) and art. 24 sec. 5 points 1, 4-8 of the Act. The ordering party will request a reference in the referenceeniu to these entities appropriate documents referred to in item 6.1.b) IDW.

1. If for justified reasons, the Contractor can not submit documents required by the Awarding Entity in point III.1.3 sub-point 2 of the notice, the Contracting Party allows the Contractor to submit other relevant documents to confirm compliance with the conditions for participation in the procedure set out in point III 1.3, 1.1.down.

2. Refers to item III.1.3 respectively): The Contractor may, in order to confirm compliance with the conditions of participation in the proceedings, in relevant situations and in relation to the order or parts thereof, rely on technical or professional capacity or financial or economic situation of other entities, regardless of the nature the legal relationship that binds him to him, onprinciples specified in IDW (item 6.5 of IDW, including the obligation to submit documents indicated therein).

3. If the Contractor has his registered office or place of residence outside the territory of the Republic of Poland, he shall submit an appropriate document or documents in accordance with the rules set out in item 6.6. IDW.

4. The period of binding the offer: 60 days.

5. The Contracting Authority does not provide for the order referred to in art. 134 sec. 6 point 3 Ujoints.

6. The offer should be made in Polish. Documents in a foreign language should be submitted along with a translation into Polish.

7. The offer, along with the required documents, should be prepared and submitted in accordance with the principles set out in the announcement, IDW and applicable laws, including the Regulation of the Minister of Development of 26.7.2016 on the type of documents that may be requested by Z.I am seeking from the Contractor in the proceedings for the award of the order and Pzp. 8. The main code is 71320000-7.

9. Required order delivery time:

1. Handing over to the Ordering Party 2 copies of a photocopy of the Protocol from the coordination meeting on the reconciliation of the location of the proposed network of utilities along with map attachments confirming the reconciliation and bringing the route to the main maphub (including one copy with boundaries and parcel numbers and registration precincts) [hereinafter referred to as: "Report from the coordination meeting"] and Materials necessary to obtain the right to dispose of the land, including cross-section through a road lane showing the location of the proposed and existing network utilities [hereinafter referred to as "Materials to the land"], and an excerpt and outlinefrom the Local Spatial Development Plan for the area covered by the investment [hereinafter: "Local Plan"], and if necessary (ie in the case of designing conductors in an existing or planned roadway) Materials Necessary to the Ordering Party to obtain a derogation from the provisions of - 140 section 8 of the Regulation of the Minister of Transport and Maritime Economy of 2.3.1999 on technical conditionsshould be the responsibility of public roads and their location [hereinafter referred to as "Materials for derogation"] within 150 (in words: one hundred and fifty) calendar days from the day of conclusion of the contract;

2 transferring to the Employer project-estimate documentation [hereinafter: "Documentation project "or" Documentation ") within 120 (in words: one hundred and twenty) calendar days from the day of deliveryContractor by the Employer of documents confirming the right to dispose of the land for construction purposes for the planned investment and consent to the derogation (if necessary) or written information obtained from the Employer on the need to start project work. This order is part of a larger order given in parts. Each part is an objectseparate proceedings as part of the order awarded in parts (Article 32 (4) of the Act). The estimated value of the part does not exceed the amount specified in the regulations issued on the basis of art. 11 para. 8 of the Act.
