1. Contractors, who:

1.1 meet the conditions for participation in proceedings regarding the possession of competences or entitlements to conduct a specific professional activity, can apply for the award of the contract, how much this obligation results from separate regulations. Not applicable.

1.2 are not subject to exclusion pursuant to art. 24 sec. 1 point 12-23 of the Act on Public Procurement Law (Journal of Laws of 2017, item 1579, volume as amended) hereinafter referred to as the "Act" or "PPL" (from the provision of Article 133 paragraph 4 of the PPL) and pursuant to art. 24 sec. 5 points 1, 4-8 PzP.

2. Assessment of meeting the conditions for participation in the proceedings (according to the formula "meets - does not meeta ") and no grounds for exclusion will be made, based on: - a) the initial statement of the Contractor contained in the uniform European document" EAT "- in relation to all Contractors who submitted bids, and - b) documents and statements confirming the fulfillment of conditions participate in the proceedings and no grounds for exclusion regarding the Contractor whose offer will be highestassessed.

3. The Ordering Party requests: 3.1a) At the stage of submitting bids from all Contractors:

a) Uniform / European ones / their document / in the order - in accordance with item 6.1 a) IDW, constituting Part I of the ToR;

b) Documents referred to referred to in point 6.5 IDW

c) Other declarations and documents, which are indicated in the SIWZ, that they should be attached to the offer.

3.1 b) Purchaser before grantingiem orders, will call the Contractor, whose offer will be evaluated as the most advantageous, to submit in the designated, not shorter than 10 days, the current date as of the day of submitting statements or documents confirming the circumstances referred to in Article. 25 ust. 1 Pzp, ie documents referred to in item 6.1b) and 6.1d) IDW.

3.1 c) Each Contractor, in accordance with art. 24 sec. 11 Pzp, is required byt to submit within 3 days from the date of posting information on the website of the Employer referred to in art. 86 par. 5 of the PPL, ie document referred to in item 6.1.c) IDW.

3.1 d) Contractor having its registered office in the territory of the Republic of Poland, in relation to persons who reside outside the territory of the Republic of Poland, to which the document specified in item 6.1b applies) point a) IDW, submit the relevant documents in accordance with-guidelines contained in IDW.

4. In order to confirm the fulfillment of the condition referred to in point 1 item 1.1, the Contractor whose tender will be evaluated as the most advantageous will present: Not applicable.

5. The Contracting Authority will assess (if applicable) whether the technical or professional capacity or their financial or economic situation made available to the Contractor by other entities, allow the Contractor to demonstratefulfillment of the conditions for participation in the proceedings and will examine whether the subject of exclusion referred to in art. 24 sec. 1 point 13 22 of the Act (subject to Article 133 paragraph 4 of the Act) and art. 24 sec. 5 points 1, 4-8 of the Act. The Awarding Entity shall request the submission of relevant documents in relation to these entities, referred to in item 6.1.b) IDW.

1. If for a valid reason, Wthe Contractor may not submit the documents required by the Awarding Entity in point III.1.3 sub-point 2 of the notice, the Contracting Authority allows the Contractor to submit other relevant documents to confirm the fulfillment of the conditions for participation in the proceedings referred to in point III 1.3, 1.1 of the notice. Refers to item III.1.3 respectively): The Contractor may confirm the fulfillment of the conditions for participation in the proceedingsin appropriate situations and with reference to the order or parts of it, rely on technical or professional abilities or financial or economic situation of other entities, regardless of the legal nature of its legal relationship, as specified in IDW (item 6.5 of the IDW, including the obligation to submit the documents indicated therein).

3. If Wthe contractor has its registered office or place of residence outside the territory of the Republic of Poland, submits the appropriate document or documents, in accordance with the principles set out in item 6.6. IDW.

4. The offer binding period: 60 days

5. The Awarding Entity does not provide for the order referred to in art. 134 sec. 6 point 3 of the Act

6. The offer should be made in Polish. Documents in a foreign language must be submitted together with the translationinto Polish.

7. The offer, along with the required documents, should be prepared and submitted in accordance with the rules specified in the announcement, IDW and applicable laws, including the Regulation of the Minister of Development of 26.7.2016 on the type of documents that the Employer may request from the Contractor in proceedings for ordering and Pzp.

8. This order is part of the majororder placed in parts. Each part is the subject of a separate procedure under the order granted in parts (Article 32 paragraph 4 of the Act). The estimated value of the part does not exceed the amount specified in the regulations issued on the basis of art. 11 para. 8 of the Act. The estimated value of the whole order exceeds the amount specified in the regulations issued on the basis of art. 11 para. 8 of the Act.
