1. The object of the order is to perform works within:

Main Site: Sosnowiec

1. The subject of the orders has been divided into 2 tasks.

1.1. Task I concerns the Sosnowiec Commune and includes: - Preparation of project documentation along with obtaining a legally valid administrative decision on the construction permit, legally valid administrative decision on the permission for logging trees and the exercise of author's supervision for the task titled. "Construction of rainwater drainage systemsalong with the reconstruction of the road in the area of Ostr-w Gornicze in Sosnowiec "as part of the investment task" Water and sewage management in Sosnowiec Stage III "

1.2. Task II concerns Sosnowieckie Wodociąg-w SA and includes: - Preparation of project documentation along with obtaining a legally valid administrative decision on the building permit, valid administrative decision on the permission for tree felling and-exercising author's supervision for the task titled "Construction of sanitary sewerage network and reconstruction of the water supply network in the Ostrowy Gornicze district in Sosnowiec" (in: Starzyński, Metalowa, Klubowa, Gorna, Juliuszowska, Feliks boczna, Gałczyński, Poniatowski, Orzeszkowa, Limbowa, Maczkowska and Niecała streets) as part of an investment project "Water and sewage management in Sosnowiec-Stage III "

2. A detailed description of the subject of the order is attached as Appendix 3 to the ToR.

3 The contracting authority provides for the award of contracts referred to in Article 67 paragraph 1 point 6 of the Public Procurement Law Act relying on the return of similar design services. the scope of similar services for Task I is to develop project documentation (PB, PW, STWIORB, PR KI), including obtaining the required decisions, permits, arrangements regarding the elements specified in the description of the subject of the order for the basic order. On the terms specified for the single-source mode.

5. The date of execution of the order given in Section II, point II.2.7) only concerns the preparation of project documentation.

6. Deadline for implementation:

6.1. The project documentation agreed with the contracting authority up to 14 months from the date of conclusion of the contract;

6.2. Valid dadministrative decision on building permit and final administrative decision on felling trees: up to 10 weeks from the date set in point 6.1.

6.3. The author's supervision will be performed during the construction works, but not longer than 4 years from the day of conclusion of the contract.

1. The ordering party, prior to the order being awarded, will call the Contractor whose offer has been the highest rated for submission tomarked, not shorter than 10 days, valid as of the date of submitting declarations or documents confirming the circumstances referred to in art. 25 ust. 1 of the Public Procurement Law. The Ordering Party will call the Contractor, in particular to submit the following documents:

1.1. information from the National Criminal Register in the scope specified in art. 24 sec. 1 points 13, 14 and 21 of the Public Procurement Lawissued not earlier than 6 months before the deadline for submission of tenders;

1.2. certificate of the competent head of the tax office confirming that the contractor is not in arrears with paying taxes, issued not earlier than 3 months before the deadline for submission of tenders, or other document confirming that the contractor has entered into an agreement with the competent tax authority inhe repays the repayment of such receivables together with any interest or fines, in particular he obtained the legally required exemption, postponement or spreading of overdue payments into installments or suspension of the execution of the decision of the competent authority in its entirety

1.3. certificate of the relevant local organizational unit of the Social Insurance Institution or Agricultural Social Insurance Fund or other dthe document confirming that the contractor is not in arrears with paying social security or health insurance contributions, issued not earlier than 3 months before the deadline for submission of tenders, or other document confirming that the contractor has concluded an agreement with the competent authority regarding repayment of such claims with possible interest or fines, in particular, obtained predicted-the right to release, postpone or spread installments of overdue payments or suspend in full the execution of the decision of the competent authority;

1.4. the contractor's statements about not paying taxes and local fees, referred to in the Act of January 12, 1991 on taxes and local fees (ie, Journal of Laws of 2017, item 1785, as amended);

1.5 . excerpt from the relevant register or from the central registerrecords and information on business activities, if separate regulations require an entry in the register or records, in order to confirm the absence of grounds for exclusion under Art. 24 sec. 5 point 1 of the Public Procurement Law,

1.6. the contractor's statement that he has not been the subject of a final court judgment or a final administrative decision on his late payment, fees orb social or health insurance premiums, or in the event of issuing such a verdict or decision, documents confirming the payment of such claims together with any interest or fines or a binding agreement regarding repayment of such claims;

1.7. the contractor's statement about the lack of a ruling against him as a preventive measure for the prohibition of applying for• ordering before the order is awarded, the contractor will call the Contractor whose tender has been best assessed to submit in the designated, not shorter than 10 days, current declarations or documents confirming the circumstances referred to in art. 25 ust. 1 of the Public Procurement Law. The ordering party will call the Contractor, in particular to submit the documentsthat the contractor is insured against civil liability in the scope of activities related to the subject of the order for a guarantee sum determined by the ordering party. The Contractor is obliged to submit a completed offer form drawn up according to the template constituting Annexe No. 1 to the Terms of Reference together with Annexes 1A and 1B to the SETC and filled out Annexesem No. 7 to the SIWZ.

2. The Contractor is obliged to attach to the offer:

2.1. valid as of the day of submitting bids a statement constituting preliminary confirmation that the Contractor is not subject to exclusion and meets the conditions for participation in the proceedings in the form of a single European order document, drawn up in accordance with the standard form set out in the Commission Implementing RegulationEuropean Union issued on the basis of art. 59 par. 2 of Directive 2014/24 / EU, hereinafter referred to as "Single Document." The Contractor is obliged to submit a Single Document to the extent specified in Annex 4 to the ToR,

2.2 documents referred to in Chapter VIII point 2) and 4) SIWZ;

2.3 appropriate original or notarized attorney or other appropriate document if the offer is being signedby proxy or in the case when the authorization to sign the offer does not result from the Contractor's registration document.

3. In order to assess whether the Contractor, relying on the abilities or situation of other entities under the principles set out in Article 22a of the Public Procurement Law, will have the necessary resources to the extent that it is possible to properly execute the public order and evaluation, party the ratio between the contractor and these entities guarantees real access to their resources, the Ordering Party requests documents, which specify in particular:

3.1. the scope of resources of another entity available to the Contractor;

3.2. the manner of using resources of another entity, by the Contractor, while executing the order;

3.3. scope and period of participation of another entity when performing public order;

3.4.whether the entity, on the capacities of which the Contractor relies, in relation to the conditions of participation in the proceedings concerning education, professional qualifications or experience, will perform services whose indicated capacities relate to.

4. Contractor, within 3 days of posting information on the website referred to in art. 86 par. 5, provides the Employer with a declaration of affiliation albo not belonging to the same capital group, referred to in art. 24 sec. 1 point 23 of the Act on Public Procurement Law in accordance with the model constituting Annex 2 to the Terms of Reference. In the case of being part of the same capital group, the Contractor may submit together with the declaration documents or information confirming that connections with another contractor do not lead to distortion of competition in the posextinguishing the order.

5. The Contractor will be bound by the submitted offer for a period of 60 days. The period of being bound by the offer starts as soon as the deadline for submission of tenders expires.

6. The Contractor is obliged to lodge a bid bond before the deadline for submitting bids in the amount of PLN 12, 000.00 (in words: twelve thousand PLN 00/100).

7. The contractor is obliged to pay before signing the contractto secure the due performance of the contract for a total amount of 10% of the offer price specified in the Offer Form. The Contractor will be obliged to provide a performance bond for each contract concluded separately.

8. The ordering party will choose the best offer based on the following evaluation criteria:

8.1. gross prices (weighting - 60%),

8.2. manager experienceproject team (weight - 40%).

9. Declarations referred to in Section VI point VI.3) items 2.1., 2.2., 4 and III.1.1), item III.1.2), item III.1.3) concerning the Contractor and other entities on whose capabilities or the situation is the Contractor based on the principles set out in Article 22a of the Public Procurement Law are submitted in the original
