Electricity distribution.

Supply and distribution of traction energy for 2020 2022

Reference Number: KW-WWA-280.85.2019.WK

The subject of the order is the sale of 3kV DC electricity compliant with the PN-EN 50163 standard, called traction energy, and providing its distribution services for the purposes ofof electric traction transport specified in detail in Annex 1 to the Specification of Essential Terms of the Order (hereinafter SIWZ) of the Bid Form and Annex 2 to the Terms of Reference of the essential provisions of the contract.

Main Site: Area of the Employer`s activity.

3kV DC electricity supplied to electric the Employer`s vehicles meets the quality parametersenergy in accordance with the PN EN 50163 standard. The power delivered to each train consisting of the Awarding Entity`s electric vehicles will not be higher than 4 MW. Employer, with the limit of ownership of the network used for deliveryTraction Energy is located at the power supply terminals from the traction network.

Until the Employer installs all metering billing and traction systems, the Contractor in algorithms determining the amount of Traction Energy consumed will take transport work (tariff group Bt21) or the amount of Energy as the basis for calculations Traction acquired frommeasuring devices installed for this purpose on individual traction vehicles.

References to the Description of the subject of the order should be read in such a way that they are accompanied by the term "or equivalent", in accordance with Article 30 (4) of the PPL Act

1. the contract may be awarded by Contractors who:

1) are not subject to exclusion in the circumstances referred to in Article 24 ust. 1 point 12-23 of the PPL Act and in art. 24 paragraph 5 item 1 of the PPL Act, with the proviso that in the procedure for awarding a sectoral contract, the Contractor is not subject to exclusion in the case referred to in art. 24 paragraph 1 point 13 lit. d of the PPL Act, and in the case referred to in art. 24 paragraph 1 item 14 of the PPL Act, if the person referred to in this provision has been convicted of an offense listed in Articlevol. 24 paragraph 1 point 13 lit. d of the Public Procurement Law

2) meet the conditions for participation in the procedure specified by the Employer in the Notice of Order and the Terms of Reference.

2. Contractors who meet the conditions for participation in the procedure regarding:

1) competence or authorization to conduct specific professional activity, provided that it results from separate provisions,

a) the Contractor can meet the award of the contractcondition, if it shows that it has a current license to trade in electricity issued by the President of the Energy Regulatory Office,

b) The Contractor will meet the condition if he shows that he has: - a current license for the distribution of electricity - regarding the situation when the Contractor is the owner distribution network

Or

- declaration of having signed a general distribution agreement with the relevantm the distribution system operator - regarding the situation when the Contractor is not the owner of the distribution network.

The Purchaser does not set any detailed condition in this respect.

1. The Awarding Entity shall use the right provided in art. 24aa of the Public Procurement Law, i.e. it will first evaluate the offers and then examine whether the contractor whose offer has been assessed as the most advantageous is not subject to exclusion andmeets the conditions for participation in the proceedings.

2. Information clause from art. 13 and 14 GDPR is located in Chapter 21 of the ToR.

3. The price is the only evaluation criterion - 100%.

4. The offer must contain the following statements and documents:

1) The completed Offer Form, prepared under pain of nullity, in electronic form with a qualified electronic signature - usingm of the template - Annex No. 1 to the ToR.

2) Power of attorney for persons signing the offer on behalf of the Contractor, if the offer is signed by a proxy - in electronic form or in an electronic copy of a document certified by a notary public for compliance with the original (confirmation of compliance with the original is made by a notary public using a qualified electronic signature).

3) Unified EuropeOrder Document (EAT), referred to in chapter 6 of the ToR, prepared, under pain of nullity, in electronic form with a qualified electronic signature - JEDZ constitutes Annex 3 to the ToR.
