Electricity supply for the Purchasing Group of Dyn-w Commune. Reference Number: 170/2018

1. The subject of the order is the delivery of electricity with a total estimated volume of 3 918 750 kWh.

Main Site: Area of the Dyn-w Commune, Municipal Commune Dynow, Dubiecko Commune

1. Electricity will be supplied on terms specified in the provisions of the Act of 10.4.1997 Energy Law (consolidated text Journal of Laws of 2018, item 755) and in accordance with the executive regulations issued to that Act, in particular with the standards the quality of customer service specified in the Ordinance of the Minister of Energy of 29/12/2017 on detailed rules of the shapecalculation and calculation of electricity tariffs (consolidated text: Journal of Laws of 2017, item 2500).

2. The distribution services will be provided on the basis of a separate agreement concluded by the Ordering Party with the appropriate Distribution System Operator, ie PGE Dystrybucja S.A.

3. The Contracting Authority will grant the power of attorney selected in the Contractor's proceedings to:

3.1. applications on behalf of the Orderthe sales contract to the Distribution System Operator in order to implement the concluded electricity sales contract,

3.2. representing the Ordering Party in the process of changing the seller.

4. Attachment No. 2 to the SETC indicates distribution parameters (contracted capacity / tariff group), which may be subject to change during the term of the contract for the sale of electricity within the tariff groups included inSIWZ and offers quoted in the form. 5. The amount of electricity volume specified in section II.1.4) item 1 is the estimated value based on the current consumption. The Ordering Party reserves the right to reduce or increase the total amount of electricity purchased in relation to the quantity specified in section II.1.4) item 1, caused by reduced or increased consumptionem of electricity in the amount corresponding to the actual needs of the Employer, regardless of the estimated consumption forecast. The Contractor shall not be entitled to any claim for not charging the anticipated amount of electricity by the Employer. A possible change in the estimated consumption specified in section II.1.4) item 1 will not result in additional costs-for the Purchaser, in addition to the settlement for the actually used amount of electricity according to the prices specified in the contract. The occurrence of the circumstances referred to will result in a corresponding reduction or increase in the remuneration due to the Contractor under the Contract.

In order to confirm the fulfillment of the condition concerning the competence or entitlements to conduct a specific professional activity as far as it appears-from separate regulations, the Ordering Party will demand:

1) an important license for conducting business in the scope of trade in electricity, issued by the President of the Energy Regulatory Office, in accordance with art. 32 of the Act of 10.4.1997 Energy Law (consolidated text Journal of Laws of 2018, item 755) - the Contractor will show that: a) has a current license to conduct business in the scope ofe of electricity trading issued by the President of the Energy Regulatory Office, pursuant to art. 32 of the Act of 10.4.1997 Energy Law (consolidated text Journal of Laws of 2018, item 755) - Note: In the case of submitting an offer by Contractors jointly applying for the award of contract, each of these Contractors jointly appearing, who will perform the order in the scope of supplies, which realization requires the rights indicated in point 1, it must demonstrate the possession of such rights.

In order to confirm the fulfillment of the condition regarding the economic or financial situation, the Employer will request:

1) information of the bank or cooperative savings and credit institution confirming the amount of funds held or the Contractor's creditworthiness in the period not earlier than 1 (eden) one month before the deadline for submitting bids - 2) documents confirming that the contractor is insured against civil liability in the scope of conducted activities related to the subject of the order for the guarantee sum specified by the ordering party - if for justified reasons the Contractor can not submit documents regarding the financial situation or economic required byfrom the Employer, he can submit another document, which sufficiently confirms fulfillment of the condition of participation in the procedure described by the Employer. The ordering party sets a deposit for the entire subject of the order in the amount of 30, 000.00 PLN (in words: thirty thousand zlotys).

2. The Contractor is bound by the offer for a period of 60 days

3. The contractor will submit a uniform European order document (J.EDZ) in accordance with art. 25a of the Act of 29.1.2004 Public Procurement Law (Journal of Laws of 2017, item 1579 with later amendments), hereinafter referred to as the Act, using means of electronic communication via e-mail to the following e-mail address: Przetargi @ dynow.regiony.pl - in electronic form, with a qualified electronic signature, by persons authorized to represent entities which EATapplies, at the latest, until the deadline for submitting bids expires.

4. Declarations and documents for demonstrating fulfillment of the conditions for participation in the proceedings and no grounds for exclusion The Contractor is obliged to submit in a form consistent with the provisions of -14 of the Regulation of the Minister of Development of 26.7.2016 on the type of documents that the Employer may request from the Contractor in proceedings for udzielenNo order (Journal of Laws 2016, item 1126), hereinafter referred to as "the document regulation" and with regard to the EED requirements laid down in Commission Implementing Regulation (EU) 2016/7 of 5.1.2016 establishing a standard form a uniform European order document (Dz.UE L 3/16 of 6.1.2016).

5. The Employer will exclude from the Contractor's proceedings in the circumstances indicatedch in art. 24 sec.1 and art. 24 sec. 5 points 1, 2 and 8 of the Act

6. A list of statements or documents to demonstrate the absence of grounds for exclusion, which the Employer will demand pursuant to art. 26 of the Act:

1) documents and statements referred to in - 5 items 1-6, 9 of the Regulation on documents;

2) documents or statements referred to in - 7 and 8 of the Regulation on documents - if itthe principal has his registered office or place of residence outside the territory of the Republic of Poland or if the person whose document relates is residing outside the territory of the Republic of Poland;

3) the statement referred to in - 5 point 10 of the Regulation on Documents

6. Detailed information on the manner of preparing and submitting the offer and JEDZ are specified in the ToR.
