The subject of the Order is the replacement of a two-section BCA 6kV switchboard with technical design, adaptation and renovation of a room at PGE Energia Ciepła Elektrocie BranchPłownia in Rzesz-w.

The subject of the Order is replacement of a 2-section BCA 6kV switchgear along with the implementation of a technical design as well as adaptation and renovation of a room at PGE Energia Ciepła. Elektrociepłownia Branch in Rzesz-w.

The scope of the subject of the contract includes in particular:

1) services:placement, execution, assembly and commissioning of a new switchboard, design and installation of a new ventilation and air conditioning unit, design and implementation of modernization of the DC system, billing systems and connections with the existing DCS master control and control system. All assembly work involves the dismantling of existing equipment,

2) in the scope of supply: delivery inclcomplete design and as-built documentation, delivery of a complete new switchgear with devices included in the scope of work listed in points 1,

3) in the scope of construction works: repair of switchgear rooms (floor renovation, wall painting, door replacement).

The detailed scope is defined in Terms of Reference.

1. Contractors who can apply for the contract:

a) are not subject to exclusionand on the basis of art. 24 paragraph 1 point 12 23 of the Act of 29.1.2004 Public Procurement Law (i.e. Journal of Laws of 2019, item 1843), hereinafter referred to as the Public Procurement Law, subject to art. 133 section 4 of the PPL Act and are not subject to exclusion pursuant to art. 24 paragraph 5 item 1 of the Public Procurement Law

2. In order to demonstrate that the Contractor has met the conditions for participating in the procedure and to demonstrate that there are no grounds for exclusion, The Contractor is obliged to submit, together with the offer, the current statement on the day of submitting the offers, referred to in art. 25a section 2 of the Public Procurement Law, in the form of a single European order document (EAT) according to the Commission Implementing Regulation (EU) 2016/7 of 5.1.2016 establishing the standard form for the single European order document (Journal of Laws EU L 3/16). Information contained inEAT constitute preliminary confirmation that the Contractor is not subject to exclusion and meets the conditions for participation in the procedure. The Employer expects the Contractor to submit in the JED form a general statement on the fulfillment of the conditions for participation in the procedure in section α in part IV of EAT. Therefore, the Contractor does not need to complete the further sections in Part IV of the EAT relating to the detailed conditionsdepartment in proceedings (selection criteria) specified by the Employer.

3. In order to demonstrate the lack of grounds for exclusion, the Contractor is obliged to submit within 3 days of placing on the website the information referred to in art. 86 section 5 of the PPL Act, a declaration of belonging or not belonging to the same capital group as referred to in art. 24 paragraph 1 point 23Public Procurement Law

4. Based on Article. 26 section 1 of the Public Procurement Law, in order to demonstrate compliance with the conditions for participation in the procedure and to demonstrate the lack of grounds for exclusion, the Awarding Entity, before awarding the contract, will call the Contractor whose tender has been rated the highest to be submitted within a designated period of not less than 10 days, within the following documents:

a ) Information from the National Criminal Record, in scopee specified in art. 24 paragraph 1 point 13 of 14 Public Procurement Law, subject to art. 133 section 4 of the Public Procurement Law (applies to: natural persons, board members, supervisory board members, proxies, associates of public and partner companies, general partners in a limited partnership or limited joint-stock partnership) valid as at the date of submission (issued not earlier than 6 months before the deadline for submission of bids) ;

b) Information from the National Criminal Register, to the extent specified in art. 24 paragraph 1 point 21 of the Public Procurement Law (information should relate to collective entities), issued not earlier than 6 months before the deadline for submitting bids;

c) Copy from the relevant register or from the central register and information on business activity, if separate provisions require an entry in the register or records, into confirm the absence of grounds for exclusion under Article 24 paragraph 5 point 1 of the Public Procurement Law;

d) the Contractor`s statement on the lack of issuing a final court judgment against him or the final administrative decision on arrears in the payment of taxes, fees or social security or health insurance contributions or in the case of issuing such a judgment or the decision of documents confirmingpayment of these receivables together with any interest or fines or conclusion of a binding agreement on the repayment of these receivables;

e) the Contractor`s statement that he has not been subjected to a preventive measure against him from applying for public procurement.

5. Contractors having their registered office or place of residence outside the territory of the Republic of Poland shall submit relevant documentsin accordance with the ToR.

6. In the case of joint application for the award of this contract, Contractors submit relevant documents in accordance with the ToR. The contracting authority informs that the public procurement procedure will be conducted using the PGE CG purchasing system. To make an offer in proceedings Contractor jis obliged to register in the PGE CG purchasing system available at: https://www.swpp2.gkpge.pl. Other information regarding the purchasing system and the submission of bids is contained in the ToR.

2. The content of the Terms of Reference with attachments is available on the website of the Employer in the SWPP2 PGE system, https://swpp2.gkpge.pl.

3. The contractor may, to confirm compliance withconditions for participation in the procedure, where appropriate and in relation to a specific contract, or part thereof, rely on the technical or professional capacity or financial or economic situation of other entities, regardless of the legal nature of the legal relations with it.

4. The Contractor, which relies on the abilities or situation of other entities, must prove the Purchaserthat, when carrying out the contract, he will have the necessary resources of these entities, in particular, together with the offer presenting the undertaking of these entities to make available to him the necessary resources for the purposes of the contract.

5. Contractor, which refers to the resources of other entities, in order to demonstrate the absence of grounds for exclusion and fulfillment, in the scope, inwhich is referred to their resources, conditions for participation in the proceedings, also submits together with the JEDZ offer regarding these entities and at the request of the Employer relevant documents in accordance with the ToR.

6. The offer binding period is 60 days from the day of submitting the offer.

7. The awarding entity envisages application in accordance with art. 24aa of the PPL Act, reverse procedure (i.e. in first colhe will evaluate the offers and then examine whether the Contractor whose offer was rated highest is not subject to exclusion and meets the conditions for participation in the proceedings).

8. The contracting authority allows the possibility of amending the public procurement contract on the terms set out in the draft contract annexed to the ToR.

9. The Ordering Party informs that detailed information on the protection of data of personsbowe were included in item 32 of the ToR.
