Selection of electricity supplier and balancing group coordinator for the needs of BDZ - Passenger Transport Ltd.

The procurement subject to tender shall be carried out according to the technical specification for selection of electricity supplier and coordinator of Electricity. balancing group for the needs of BDZ - Passenger Transport EOOD of the contracting authority from the documentation for

Main Site: The place of delivery of the electricity are objects owned by BDZ - Passenger Transport Ltd. - electric traction rolling stock and objects using traction electricity - No. 1 to their specification

Delivery by purchase of 150 280 MWh net active electricity and balancing group coordinator for electric traction rolling stock and traction facilitiesand electricity of BDZ-PP EOOD listed non-exhaustively in the list of electric traction rolling stock and objects using traction electricity owned by BDZ-PP EOOD - Annex No. 1 to the technical specification for selection of an electricity supplier and coordinator of a balancing group for needs of BDZ - Passenger Transport Ltd. from the documentation for participation.

1. The participant shouldis licensed to engage in the activity of "electricity trading" and the activity "coordinator of a standard balancing group" in accordance with the Energy Act (EE) and other relevant regulatory acts, as well as with the administrative acts issued by the Energy and Water Commission regulation (CEWR). Foreign participants can prove that they meet the requirement by analogyour licenses under the law of the Member State in which they are established.

When submitting the offer, the participants declare in the box "Entry in the relevant professional register" of Section A "Eligibility" in Part IV "Selection Criteria" of the Single European Procurement Document (OEDOP) compliance with the selection criterion under item 1, explicitly indicating the number and date of issue of the license, web address, authority or office issuing the document, accurate reference to the document.

Demonstration:

Compliance with this requirement is evidenced by a certified copy of a valid license for the activity "electricity trading" and for the activity "coordinator of a standard balancing group", issued by EWRC, or equivalent document for foreign participants, certifying the right of the person concerned(according to its national law). The same shall be submitted by the tenderer upon request by the contracting authority at any time after the opening of the tender for participation in accordance with Art. 67, para. 5 of the PPA and under the conditions of Art. 112, para. 1, item 2 of the Public Procurement Act.

2. The participant must be included in the Register of commercial participants and in the Register of coordinators of standard balancing groups of the Electricity System Operop "EAD (ESO EAD) with the status" active "and for foreign persons - in similar registers according to the legislation of the Member State in which they are established.

When submitting the offer, the participants declare in the field" Entry in the relevant professional register "from section A "Eligibility" in Part IV "Selection Criteria" of the Single European Procurement Document (EDES)Selection under item 2, by explicitly specifying the registration numbers and links to the registers, if they are publicly available in electronic format. declare that the participant is registered in the Trade Stakeholder Register and the Standard Balancing Coordinators RegisterESO EAD groups with "active" status or in similar registers according to the legislation of the Member State in which they are established. shall be submitted by the tenderer upon request of the contracting authority at any time after the opening of the tender for participation in accordance with Art.67, para. 5 of the PPA and under the conditions of Art. 112, para. 1, item 2 of the Public Procurement Act

Requirements of the contracting authority

1. The participant has realized a minimum total turnover calculated on the basis of the annual turnover for the last 3 (three) financial years (2016, 2017, 2018), depending on the date on which the participant was established or started its activity.

According to -2, item 66 of the Supplementary Provisions of the Public Procurement Act "yearn total turnover "is the sum of the net sales revenue within the meaning of the Accounting Act.

When submitting the offer, participants declare in the box" Total annual turnover "of section B" Economic and financial status "in part IV" Selection criteria "of the Single European Procurement Document (EDES) complying with the selection criterion under item 1 by completing the "total annual turnover" forthe previous 3 financial years ended (2016, 2017 and 2018).

Proof:

To prove compliance with the selection criterion under item 1, the rules of Art. 62 of the PPA, according to which the fulfillment of such selection criteria is certified by presentation of the annual financial statements or their constituent parts, when their publication is required by the legislation ofthe country in which the participant is established. They shall be presented by the participant upon request by the assignor at any time after the opening of the applications for participation in accordance with Art. 67, para. 5 of the PPA and under the conditions of Art. 112, para. 1, item 2 of the Public Procurement Act

According to Art. 62, para. 2 of the Public Procurement Act, where for a valid reason the tenderer is unable to present the documents requested by the contracting authority, he may proveis its economic and financial status with the help of any other document that the contracting authority considers appropriate. 62, para. 1, Item 3 covers the last 3 financial years (2016, 2017, 2018). The information may also cover a shorter period depending on the date on which the participant was created or started its activity.
