Choosing an Active Net Electricity Provider and Low Voltage Balancing Group Coordinator for the purposes of the Regional Health and Safety Association - Silistra

The subject of the contract includes:

Main Site: Gr. Silistra, 3 Partenii Pavlovich Str.smoke documents for the registration of the sites of the contracting authority on the free electricity market and the complete procedure for their registration;

2. Inclusion of the contracting authority as an indirect member of the Contractor`s balancing group in accordance with the "Electricity Trading Rules" (EEE), without the contracting authority paying a registration and participation fee;

3. Energy monitoring, forecasting consumptionthe contracting authority`s electricity and hourly schedules. Notification (registration) of hourly schedules in the MMS of ESO as well as carrying out all necessary activities related to the participation of the contracting authority in the free electricity market, in accordance with PTEE, EA and PICEA;

4. Supply of required amounts of net active electricity for low e.g.Appendix to this documentation, with possible deviations in the positive or negative direction. The estimated amount of electricity does not oblige the contracting authority to use it. The contracting authority reserves the right to change the quantity consumed according to the need, and the contractor undertakes todeliver the required amount of electricity per day, per month and for the entire delivery period;

5. The projected amount of active electricity for 12 (twelve) months is determined on the basis of the measured quantities of electricity consumed in the past 12 months and is estimated at 85 mWh

1. Participants should be licensed to trade electricity with rightsand obligations of a standard balancing group coordinator in accordance with Art. 39 of the Energy Act, issued by the Energy and Water Regulatory Commission (EWRC).

To certify compliance, the participants complete part IV, letter "A" in the OEDOP, where they submit information about the license issued by EWRC.

2 Participants should be registered in ESO E.AD, as an electricity trader and as coordinator of a standard balancing group with code number and status "active".

3. Pursuant to Article 67, paragraph 5 of the Public Procurement Act, the contracting authority may at any time require the participants to submit the documents proving the information specified in the EDESP in accordance with Article 64, para 1 of the Public Procurement Law, when this is necessary for the lawful conduct of the procedure.Entities, by which it is proved its compliance with the criteria set by the client for suitability for pursuing a professional activity, in accordance with Art. 112, para. 1, item 2 of the Public Procurement Law, as follows:

- Under item 1, a certified copy of a valid license for the activity "electricity trading", including the activity "coordinator of a standard balancing group" in accordance with the EA and the other oapplicable legal acts, as well as with the administrative acts issued by the Energy and Water Regulatory Commission (EWRC),

- A certified copy of a document issued by ESO EAD for available registration, as an electrician trader, is submitted under item 2 energy and as a coordinator of a standard balancing group with a code number and status "active".

With the participation of non-legal entitiespersons compliance with the selection criteria under items 1 and 2 shall be demonstrated by each participant in the grouping, in accordance with the distribution of the persons` participation in the performance of the activities provided for in the agreement establishing the grouping. The documents referred to in items 1 and 2 shall also be submitted to the subcontractors and third parties, if any and applicable, in view of the case and the type of activities they will perform.the pledger has no requirements regarding the economic and financial situation of the participants.

1. Upon signing the contract, the tenderer designated as a contractor shall submit a guarantee for performance of the contract for the amount of 5% of the contract value excluding VAT.

2. The guarantee is presented in one of the following forms:

- original of a bank guarantee issued by Bulgarianor a foreign bank, in favor of the Silistra Regional Health Insurance Fund, with a validity of at least 30 (thirty) calendar days from the contract term. Bank guarantees issued by foreign banks should be advised through a Bulgarian bank confirming the authenticity of the message, translated into Bulgarian.

The bank guarantee should contain an obligation of the bank- a guarantor to make an irrevocable and unconditional payment upon the first written request of the contracting authority. an insurance policy to insure performance through coverage by the insurer of the contractor`s liability.as the third beneficiary of this insurance. The insurance should cover the liability of the contractor and cannot be used to secure the liability of the contractor under another contract.

3. Where the selected contractor is a non-legal entity, any of its partners may be the originator of the bank guarantee, respectively, the depositor of the guarantee amount orthe holder of the insurance.

4. Upon presentation of the security, the document, according to the type in which it is presented, shall explicitly state the object of the contract for which the guarantee is presented. The contracting authority shall release the performance guarantee without paying interest for the period during which the funds were legally with him.

5. The terms and conditions under which the performance guarantee is withheld or ofreedoms shall be settled by a contract concluded between the contracting authority and the contractor within the framework of the public procurement.

6. The procurement contract shall not be concluded before the successful tenderer has been presented with a performance guarantee.

7. The assignor shall remove from participation a participant for whom there are, in addition to the grounds under Art. 54, para. 1 of the Public Procurement Act, Art. 55, para. 1 and Art. 107of the PPA, as well as when it is established that the participant is a company registered in a jurisdiction with preferential tax regime or controlled by such a company, or one of the members of the association is registered or controlled by a registered company, unless there is an exception under Art. . 4 of the Law on Economic and Financial Relations with Companies, Registered in the Jurisdiction of ExEffective tax regime, the persons controlled by them and their beneficial owners, as well as when a participant is a related party within the meaning of - 2, item 45 of the Public Procurement Law of the PPA with another participant in the procedure, and when identification and verification cannot be carried out. of customer identification, through the methods prescribed by the Law on Measures against Money Laundering, including when the clientis a legal entity - to the natural persons who are its real owners, within the meaning of -2 of the DR of the LMML, and when the circumstances under Art. 69 of the Anti-Corruption and Forfeiture of Illegal Acquisition Act.
