1. The subject of the contract is a comprehensive supply of electricity, including the sale of electricity and the provision of electricity distribution servicesryczna.

The subject of the contract is a comprehensive supply of electricity, including the sale of electricity and provision of electricity distribution services for the needs of the Jonkowo Commune.

Part 1- lighting of public space in the Jonkowo Commune located in the ENERGA Operator SA area: • Number of measuring systems accounting for consumed electricityRyczna 47;

• Total contracted capacity [kW] 314;

• Estimated consumption over the duration of the contract [MWh] 790;

1. Contractors who meet the conditions for participation in the procedure regarding the competence or rights to conduct a specific professional activity may apply for the award of the contract, provided that it results from separate provisions, i.e. (the same condition for parts 1 and 2):

a) The Contractor hasa license valid for the period of implementation of the subject of the contract, issued by the President of the Energy Regulatory Office, for conducting business activity in the field of electricity trading in accordance with the Energy Law of 10 April 1997, and

b) The Contractor has a valid license for the period of implementation of the subject of the order, issued by the President of the Energy Regulatory Office, on prorunning business activity in the scope of distribution of electricity in accordance with the Act of 10 April 1997 Energy Law or general distribution agreement for the comprehensive service for institutional entities concluded with the Distribution System Operator for Parts 1 and 2 of ENERGA Operator SA during the course of the contract.

You can ordercontractors who are not subject to exclusion - Contractors are excluded from the contract award procedure in relation to which any of the circumstances referred to in art. 24 paragraph 1 point 12-23 of the Public Procurement Law;

1. In order to confirm that the conditions for participation in the procedure have been met and to show that there are no grounds for exclusion, the Contractor shall submit together with the offer the following statements anddocuments:

1) current, as at the date of submitting the bids, a statement to the extent indicated in the ToR. The information contained in the statement will constitute preliminary confirmation that the Contractor is not subject to exclusion from the procedure and meets the conditions for participation in the procedure. The Contractor shall submit this declaration in the form of a Single European Contract Document (EAT), drawn up in accordance with the standard templatethe form specified in the European Commission implementing regulation issued on the basis of art. 59 clause 2 of Directive 2014/24 / EU.

2) in the case of jointly applying for the Contractors to order the declaration (EAT), referred to in point 1), is submitted by each of the Contractors jointly applying for the order.

2. The Contractor, within 3 days of placing it on the Order websiteinformation on the opening of offers, provides the Employer with a declaration of belonging or not belonging to the same capital group as referred to in art. 24 paragraph 1 point 23 of the Public Procurement Law

3. Documents submitted at the request of the Employer:

1) information from the National Criminal Record in the scope specified in art. 24 paragraph 1 item 13, 14 and 21 of the Public Procurement Law, issued not earlier than 6 months byd the deadline for submitting bids;

2) the contractor`s statement that he has not issued a final court judgment or final administrative decision regarding late payment of taxes, fees or social security or health insurance contributions, or - in the case of such a judgment or decision confirming payment these receivables together with any interestor fines or the conclusion of a binding agreement on the repayment of these receivables, in accordance with the specimen constituting Annex 6 to the ToR;

3) the contractor`s statement that he has not been awarded a preventive measure against him by applying for public procurement, in accordance with the specimen constituting Annex 7 to ToR;

4) documents listed in para. 3 points 1-3 in relation to entities on whichh resources The Contractor relies, on the principles set out in Art. 22a of the Public Procurement Law,

5) list of deliveries made, also made, within the last 3 years before the offer submission deadline, and if the period of business activity is shorter in this period, together with the subject, dates of performance and entities for whom the deliveries were made (according to the model indicated in Annex 3to the Terms of Reference) and attachment of evidence stating whether these deliveries have been made properly.

6) Current for the period of implementation of the subject of the concession contract, issued by the President of the Energy Regulatory Office, for conducting business activity in the field of electricity trading in accordance with the Act of 10 April 1997 Energy Law.

7) Current for the duration of the contractthe concession issued by the President of the Energy Regulatory Office to conduct business in the field of electricity distribution in accordance with the Energy Law of April 10, 1997 or the general distribution contract for the implementation of the subject of the contract for a comprehensive service for institutional entities concluded with the relevant ( i.e. according to cof the order) the Distribution System Operator (DSO) for the provision of electricity distribution services in the area where the place of energy supply is located, or a declaration of possession contained agreement.
