The subject of the contract is the supply of electricity for the needs of the University Hospital Karol Marcinkowski in Zielona G-ra sp.z o.o.

The subject of the contract is the supply of electricity in an estimated quantity of 16, 129, 392 kWh for the needs of the University Hospital. Karol Marcinkowski in Zielona G-ra sp.z o.o. ul. Zyty 26, 65-046 Zielona Gora, POLAND.

A detailed description of the subject of the contract is included in Annex 2 to the ToR.

1. The contractor must demonstratethat it has:

a) a concession / permit / license or a document confirming that the Contractor is entered in one of the professional or commercial registers kept in the European Union Member State in which the Contractor has its registered office or place of residence;

b) the current General Distribution Agreement with an energy company operating in the field of energy distribution elektryczna called distribution system operator (DSO) defining their mutual rights and obligations related to the provision of distribution services in the area where electricity collection points are located in the Employer`s facilities.

2. The Employer will exclude the Contractor from the proceedings in the cases referred to in art. 24 paragraph 1 points 12-23 of the Act (grounds for mandatory exclusione).

3. The Employer shall also exclude the Contractor from the procedure for awarding the contract in the following cases - the prerequisites for optional exclusion selected by the Employer, as provided for in Article 24 paragraph 5 points 1, 2, 4 of the Act.

4. In order to confirm the lack of grounds for excluding the Contractor from the procedure referred to in art. 24 paragraph 1 point 23 of the Act, the Contractor shall provide, pursuant to the content of art. 24 paragraph 11 of the Act (within 3 days from the date of placing by the Employer on the website information from the opening of offers, i.e. information referred to in Article 86 (5) of the Act), a declaration of belonging or not belonging to the same capital group, about referred to in art. 24 paragraph 1 point 23 of the Act. Together with the submission of the declaration, the Contractor may provide evidence that they have a relationshiprelations with another Contractor do not lead to a distortion of competition in the procurement procedure.

5. In order to demonstrate the lack of grounds for exclusion from the contract award procedure and to meet the conditions for participation in the procedure specified by the Employer in point 3, the offer should be accompanied by a statement valid as at the date of submission of tenders, in the form of the Uniform European Document Formof the Order (abbreviated: EAT) constituting Annex 3 to this ToR. The information contained in the JEDZ Form constitutes preliminary confirmation that the Contractor is not subject to exclusion from the procedure and meets the conditions for participation in the procedure.

6. The contractor whose bid is the highest rated in order to demonstrate the lack of grounds for exclusion from the contract award procedure (point 2.1. And2.2. of this section of the ToR) will be invited to submit the following statements and documents (current as at the date of submitting the statements or documents):

6.1. information from the National Criminal Register in the scope specified in art. 24 paragraph 1 item 13, 14 and 21 of the Act, issued not earlier than 6 months before the deadline for submission of tenders;

6.2 of the Contractor`s declaration of non-issue against snowon a final court judgment or final administrative decision on arrears in the payment of taxes, fees or social security or health insurance contributions or in the case of issuing such a judgment or decision documents confirming the payment of these claims together with any interest or fines or concluding a binding agreement on the repayment of these claims;

6.3the Contractor`s statement of the lack of a decision against him as a precautionary measure forbidding public procurement;

6.4 an excerpt from the relevant register or from the central register and information on business activity, if separate provisions require an entry in the register or register in order to confirm the absence of grounds for exclusion on based on art. 24 paragraph 5 point 1 of the Act.

Employer ndoes not set a detailed condition in this respect.

1. The Employer informs that at the stage of the contract implementation it will accept the receipt from the Contractors of structured electronic invoices sent via a free electronic invoicing platform. Rules for sending electronically structured electronic invoices and other structured related documentswith the implementation of public orders via the ICT system, i.e. the electronic invoicing platform, is specified in the Act of 9.11.2018 on electronic invoicing in public contracts, concessions for works or services and public-private partnership / Journal of Laws. 2018 item 2191 /. The contractor is not obliged to send structured invoices for its intermediationednictwem.

2. When choosing the best bid, the Employer will be guided by the following criteria: offer price = 100 points

3. The offer should include:

3.1. a statement that the Contractor has read the terms of the contract and the attached model contract and that he accepts their content without any reservations - on the offer form in accordance with Annex 1 to the ToR.

3.2. uniform formfor a European procurement document to be submitted electronically. EAT, in accordance with chapter XIII point 4 of the ToR;

3.3. price and technical form (for the task offered) in accordance with Annex 2 to the ToR.

3.4. power of attorney established to represent the Economic Operator applying for the public contract.

3.5. proof of payment of the bid security:

- in the event of paymentsecurity in non-monetary form, the original of the document confirming payment of the security in accordance with point 2.1 should be attached to the offer. chapter XIX of the Terms of Reference,

- in the event of a bid bond in cash, it is recommended to attach a copy of the confirmation of sending the transfer to the offer.

3.6. Document (e.g. obligation) of other entities to place the Contractor at the disposal of the necessary resources for the needs of real estatepublic procurement, as long as the Contractor uses the situation of other entities on the principles set out in art. 22a of the Act, submitted in the form of an original or a copy certified true to the original together with the offer by the entity providing the resources.

6.4. The complaint should meet the requirements provided for in the pleading and include the designation of the contesteddecisions, citing allegations, concise reasons for them, indication of evidence, as well as a request to set aside the decision or change the decision in whole or in part.

6.5. In proceedings pending as a result of a complaint, the appeal request may not be extended or new requests submitted
