Framework Agreement for Electricity Supply, including Transportation and Distribution for Consumer Points belonging to the Regional Public Finance Regional Direction Craiova. 1.

Declaration on non-compliance with the provisions of art. 164 and art. 165 of Law no. 98/2016 on public procurement-(leader, associate, third party, subcontractor) will fill in the appropriate requirement in the DUAE form in the awarding documentation. The framing of the situation stipulated in art. 164 of Law no. 98/2016 regarding the public acquisitions attracts the exclusion of the bidder from the procedure applied for awarding the public procurement contract.

The contracting authority requests the tenderer to declarethe winning rat to submit all supporting documents as evidence of the information contained in the DUAE in original after applying the award criterion (including the associated offeror or the supporting third party, as the case may be) until the conclusion of the award procedure report, 196 par. (2) of the Law no. 98/2016 on public procurement. 2.

The economic operator (leader, associate, third party, subcontractor) will fill in the appropriate requirement in the DUAE form in the award documentation. The framing of the situation stipulated in art. 167 of Law no. 98/2016 on public procurement leads to the exclusion of the bidder from the procedure applied for the awardof the public procurement contract. The contracting authority asks the successful tenderer to submit all supporting documents as evidence of the information contained in the DUAE in original after applying the award criterion (including by the associated offeror or the supporting third party, as the case may be) until the closing date of the award procedure report, . 196 par. (2) of Legea nr. 98/2016 on public procurement. 3.

The economic operator (leader, associate, third party, subcontractor) will fill in the corresponding requirement in the DUAE form in the original documentation. The framing of the situation stipulated in art. 59 and 60 of the Acta no. 98/2016 on public procurement leads to the exclusion of the tenderer from the procedure applied for awarding the public procurement contract. The contracting authority shall require the successful tenderer to submit all supporting documents as proof of the information contained in the DUAE in original after applying the award criterion (including the associated bidder or third partyas the case may be) until the conclusion of the award procedure report, according to art. 196 par. (2) of the Law no. 98/2016 regarding the public procurement.

Situation with the annual general turnover for the last three years

Identification data - the way of fulfillment :

1) Agreement-cadru will be concluded with an economic operator; 2) Awarding the bid with the same price placed first: if two or more bidders placed on the first place have the same price, the contracting authority will ask for clarifications through SEAP and will request bidders in this situation to submit in electronic format through SEAP a new financial proposal, and conthe tract shall be attributed to the tenderer whose new financial proposal has the lowest price; 3) Without prejudice to the provisions of Law no. 182/2002 on the protection of classified information, with subsequent modifications and completions, the economic operator shall specify in the submitted offer the information contained in the technical proposal and in the financial proposal considered to be confidential, protected by an intellectual property right to the extent that the disclosure of such information would objectively prejudice the legitimate interests of the economic operator, in particular as regards commercial secrecy and intellectual property; (4) communication of the outcome of the proceedings: according to the provisions Of Law no. 98 / 2016.

The item subject to re-listing is priceul. For the first place: if it is found that the first ranked offers have equal prices, the contracting authority will request the re-offer, in order to divide the bids. The lowest bidder will be designated the winner. If and after re-offerment the bid prices are equal, then the contracting authority will ask for a new price offer, until-the DUAE document is available electronically through the dedicated online service provided free of charge by the European Commission, available at: https://ec.europa.eu/growth/tools -databases / espd / filter

For viewing the awarding documentation uploaded in SEAP, economic operators must have a necessary visual programThe tenderers are obliged to confirm electronically the receipt of the communication on the outcome of the procedure.

The contract form will be submitted together with any proposals for modification of the specific contract clauses, proposals that will be accepted only insofar as they will not be obviously disadvantageous for the contracting authority. If-• To submit requests for clarifications regarding the awarding documentation, the economic operators will register in SEAP (www.elicitatie.ro) as an economic operator, according to the provisions of art. 5 par. (1) of H.G. no. 395/2016 and will forward the requests taking into account the deadlines-reply of the contracting authority provided for in art. 160 161 of Law no. 98/2016
