Electricity supply for 61 consumer places belonging to DGRFP Brasov, according to the tender book. The contracting authority will respond clearly and completely to all clarification requests or additional informationis on the 10th day before the deadline for submitting bids. Electricity supply for 61 consumer places belonging to DGRFP Brasov, in the amount of 4 905 MWh, according to the specification. 1. Declaration on non-compliance with the provisions of art. 164 of Law no. 98/2016 on public procurement.

The economic operator (leader, associate, third party, scontractor) will fill in the appropriate requirement in the DUAE form in the awarding documentation. The framing of the situation stipulated in art. 164 of Law no. 98/2016 regarding the public procurement attracts the exclusion of the bidder from the procedure applied for awarding the public acquisition contract. 2. Statement regarding non-compliance with the provisions of art. 165 of Law no. 98/2016 privpublic acquisitions, in conjunction with art. 166 par. (2) of the same normative act. The economic operator (leader, associate, third party, subcontractor) will fill in the appropriate requirement in the DUAE form, according to art. 193 par. (1) of Law 98 / 2016.

The manner by which the fulfillment of the requirement can be demonstrated: the economic operators participating in the award procedure will be filled in with the information related to their situation. The supporting documents proving the fulfillment of the undertaken by completing the DUAE are to be submitted, at the request ofcontracting authority, only by the bidder placed on the first place in the interim ranking made at the completion of the tender evaluation. These documents may be: a declaration on the sole responsibility of the tenderer / subcontractor / third party to avoid conflicts of interest, in accordance with the form provided by the contracting authority. Statement requested for uscompliance with the provisions of art. 60 par. (1) lit. b) of Law no. 98/2016 will have to be submitted both by the subcontractor / associate and by the supporting third party, if applicable, certifying certificates regarding the lack of overdue debts regarding the payment of taxes, taxes or contributions to the general consolidated budget (local budget, state budget etc .) at the time of submission; criminal recordr of the economic operator or of the members of the management, management or supervisory body of that economic operator or of those who have the power of representation, decision or control within the economic operator as it results from the certifying certificate issued by the ONRC / ; as the case may be, documents demonstrating that the economic operator can benefit dthe derogations provided in art. 166 par. Economic operators submitting a tender must prove an average of turnover over the past 3 years (2015, 2016), 2017) of RON 5, 782, 450, depending on the date of setting up or starting the bidder's activity.

In the case of the joint offer, all signatories of the Association Agreement will fill out each DUAE separately with information related to their situation. The supporting documents demonstrating the fulfillment of the undertaken by completing the DUAE shall be submitted, at the request of the contracting authority, only fortenderers placed on the first place in the intermediate rankings, at the end of the evaluation of the offers. Bidders assume sole responsibility for the legality and authenticity of the Bid Loaded in SICAP. All documents submitted to SICAP (regardless of their nature and time of submission, eg bid, clarification requests regarding the awarding documentation and the responses lrequests for clarification by the evaluation committee) will be signed with an extended electronic signature, based on a qualified certificate, issued by an accredited certification service provider.

The way of awarding equal offers will be as follows: in if the evaluation committee finds that more than two admitted offers have been submitted / entered into the SICAPthe contracting authority will submit a clarification request regarding the submission of new improved financial proposals (with 2 decimal places) and the economic operators will send their off-line response (only if there are no technical facilities of re-encryption encrypted in SICAP), in which case the contract will be awarded to the bidderhas the lowest price. The way of ranking the bids with the same score will be achieved by selecting the lowest bid. The way of awarding the bids with the same price will be made by submitting a request for reopening by the contracting authority.

Without prejudice to the provisions of Law no. 182/2002 on the information protectionthe economic operator will specify in the submitted offer the information contained in the technical proposal and in the financial proposal considered to be confidential, classified, protected by an intellectual property right insofar as objectively the disclosure this information would be prejudicial to the legitimate interests of the operator economic, particularly in terms of commercial secret and intellectual property
